• In terms of clause 3.0 of the Instructions to Tenderers for e-tenders, ITT rev. 1.21 of April 2024 and corrigendum 1 ITT rev.1.21 of April 2024 dated-19.09.2024. Bidders not falling in the exempt category for furnishing EMD, are required to Mandatorily furnish the requisite EMD along with their offer, Failing which their offer will be summarily rejected. Commercial-Compliance

The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

Special Eligibility Criteria

• 1. In terms of para 2.1 of Instructions to Tenderers Rev_1.21_ April 2024, Railway reserves the right to order either the entire or the bulk quantity on the RDSO approved vendor for Item ID: 3100674, Energy Efficient LED Luminaire for Passenger Coaches approved sources or their authorized dealer only. Status of approval of tenderer shall be reckoned as on the date of tender opening and not thereafter, unless it is a case of downgrading/ removal/suspension/banning.
  2. ) Vendors approved for developmental ordering shall be eligible for developmental order of up to 20% of Net Procurable Quantity [NPQ] after submitting the successful Prototype test report after completion of field trial.
  3. Authorized dealers/distributors need to quote with tender specific authorization from the approved vendors/developmental vendors/Manufacturers failing which offer will be summarily rejected. While issuing such authorizations by the approved vendors must ensure that these authorized dealers/distributors are in a position to raise inspection requests on the online portal of inspecting agencies as the case may be. Authorized dealer must furnish EMD along with their offer, failing which offer will be summarily rejected.
  4. In keeping with the Public Procurement(Preference to Make in India) Order, 2017, as amended, and in terms of clause 2.4.2, 2.4.5 and 2.4.6 of Instructions to Tenderers for e-Tender, Rev_1.21_ April2024, Public procurement of this item is restricted to Class - I and Class-II local suppliers only. Thus, only class-I and class-II local supplier as defined under the public procurement (preference to Make in India) Order, 2017, as amended shall be eligible to bid in this tender. Offer from vendors who do not quality to be Class - I(Local Content : minimum 50% ) or Class-II (Local Content: minimum 20% but less than 50%) local supplier, shall be summarily rejected and, therefore, such vendors should not participate in the tender. In case any vendor who does not qualify to be a Class - I or Class- II local supplier for the tendered item participates in the tender, such a bidder does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the bidder on this account.

Payment Terms

• 100% payment against receipt, inspection and acceptance of material by the consignee at destination.

Statutory Variation Clause

• Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account.Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

• The Contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract,and all other terms and conditions incorporated in the tender documents. In case of any conflict between the IRS conditions and Tendered terms and conditions, tendered terms and conditions shall prevail.

Commercial-Compliance

• In terms of clause as per Para 2.4.3 of Instructions to Tenderers for Electronic tenders ITT_Rev_1.21_APRIL_2024 regarding Restrictions on procurement from a bidders of a country which shares a land border with India, I, hereby confirm that I have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India and I certify that I am not from such a country.

• Security deposit (SD) Performance Security for stores contracts will be applicable 5% of contract value as per para 12.0 of Instruction to tenderers ITT_Rev_1.21_APRIL_2024

• No Exemption for EMD will be given to firms except to those firms as mentioned in the Instruction to tenderers ITT_Rev_1.21_April_2024. If the firms, other than those exempted, fail to submit EMD along with the offer, their offer will be summarily rejected.

• DP Extension In case of failure to supply the material within stipulated DP. The delivery period shall be granted in view of rates received in the subsequent tender or by imposing the LD whichever will be beneficial to Railway. Hence it is advised to supply within stipulated original DP.
