Disposal of Condemned/abandoned Railway Quarters/building of masonry structure in CLW Township-303 Nos.

Instructions to Tenderers for Terms and Condition

1. This Bid(s) has been invited for and on behalf of the President of India for performing of disposal of condemned/abandoned Railway Quarters/ building of masonry structure in CLW Township.
2. The Railway may, of its own or in response to any clarification requested/suggested by any person including that from the bids, may modify this bid document at its sole discretion before the due date of opening of the bid.
3. TENDER VALUE: The published tender value given in the bid Notice is approximate and is meant only for the guidance of the bids.
4. INSPECTION OF SITE: Before submitting bid, bidders will be deemed to have satisfied himself, by actual inspection of the site and locality, that all conditions liable to be encountered during execution of disposal of condemned/abandoned Railway Quarters/ building of masonry structure are taken into account for smooth execution of the same to the entire satisfaction of the Railway.
5. Scope for the Work: List for Condemned/abandoned Railway Quarters is attached as Annexure -I.
6. Bid Security (EMD):Amount of Earnest Money @ 2% of the advertised value required to be deposited through online along with bid. Tender without prescribed Earnest money shall be summarily rejected. Earnest money will be refunded in full without any interest, to all unsuccessful bidders after completion of tender procedure. There will be no liability on the Railway Administration in case of delay in this regard. The Earnest Money of the successful bidder will be retained and adjusted towards the Security Deposit payable by him for the proper & satisfactory execution and due fulfillment of the term & condition of the agreement. In the event of any bidder failing to turn up after the acceptance of his bid the Earnest Money deposited by him will be forfeited by the Railway administration. In the case of withdrawal of offer before expiry of the validity period of bid, Earnest Money deposited for the instant bid shall be forfeited.
7. Care in Submission of Tenders: (a)
   1. Before submitting a tender, the tenderer will be deemed to have satisfied himself by actual inspection of the site and locality of the works, that all conditions liable to be encountered during the execution of the works are taken into account and that the rates he enters in the tender forms are adequate and all inclusive for the completion of works to the entire satisfaction of the Engineer. (a)
   2. Tenderers will examine the various provisions of The Central Goods and Services Tax Act, 2017(CGST)/ Integrated Goods and Services Tax Act, 2017(IGST)/ Union Territory Goods and Services Tax Act, 2017(UTGST)/ respective state's State Goods and Services Tax Act (SGST) also, as notified by Central/State Govt.& as amended from time to time and applicable taxes before bidding. Tenderers will ensure that full benefit of Input Tax Credit (ITC) likely to be availed by them is duly considered while quoting rates.

8. Execution of Contract Document: The Tenderer whose tender is accepted shall be required to appear in person at the office of Principal Chief Engineer, as the case may be, or if tenderer is a firm or corporation, a duly authorized representative shall appear (there would be no need for appear in person if agreement is signed digitally) and execute the contract agreement within seven days of notice from Railways that the Contract Agreement is ready. Failure to do so shall constitute a breach of the agreement affected by the acceptance of the tender. The Contract Agreement shall be entered into by Railway only after submission of valid Performance Guarantee by the Contractor. In such cases the Railway may determine that such tenderer has abandoned the contract and there upon his tender and acceptance thereof shall be treated as cancelled and the Railway shall be entitled to forfeit the full amount of the Bid Security (EMD) and other dues payable to the Contractor under this contract. The failed Contractor shall be debarred from participating in the re tender for that work.
9. The tenderer whose bid is accepted by Railway will be advised in due course and on receipt of such information the successful bidder, the Bid security money deposited online along with the bid -through Net Banking will be retained and held by the Railway Administration as a part of security Deposit. The amount so retained including amount of Security Deposit may not exceed 10% of the overall value of the Contract.
10. If the tenderer deliberately give wrong information in their bids or create circumstances for acceptance of their bid, Railway Administration reserves the right to reject tenders at any stage.
11. If a bidder expires after the submission of his/her bid or after the acceptance of his/her bid the Railway shall deem such bid as cancelled. Also, if a partner of a firm expires after the submission of their bid or after acceptance of their bid, the Railway shall deem such bid as cancelled unless the firm retains its character.
12. The Administration will not be responsible for ignorance of implication of the details mentioned in the Tender Documents including all terms and condition mentioned as SPECIAL SPECIFICATION AND SPECIAL CONDITIONS OF CONTRACT which must be thoroughly read and under stood by the tenderer before tendering.

SPECIAL SPECIFICATION AND SPECIAL CONDITIONS OF CONTRACT :-1The Principal Chief Engineer/ Deputy Chief Engineer/ XEN of CLW are the final Authority to accept the bid. The authority also reserves the rights of rejection any tender/tenders without assigning reasons and no claim on this account will be entertained.

2. Bidder must satisfy himself that he has the capacity (Men, material and resources) to complete the work within the stipulated period mentioned in NIT from the date of issue of Letter of Acceptance.
3. Successful bidder shall be required to deposit non refundable full offered value (accepted value) before execution of the work to Railway Administration//Chittaranjan Locomotive Works Chittaranjan as scrap value of the dismantled materials which will be taken away by the Contractor.
4. All safety measures will be taken by the contractor and no compensation towards any accident whatsoever will be paid by the Railway.
5. List of street and area wise condemned Qrs. for dismantling will be handed over to contractor by the concern SSE/W after deposition of accepted value.
6. Garbage of dismantled Qrs./Godown to be cleared by the contractor immediately in all respect.
7. Agreement to be executed in between contractor and Railway after deposition of Performance Guarantee by the contractor @ 5% of accepted value of work. Security Money will be refunded after successful completion of work and clearance of site in all respect only When with the completion certificate duly signed by SSE/Ws, AENs, DyCE or Approving Authority.
8. The dismantled materials will be taken away by the contractor with proper challan to be issued by concerned SSE(W). The dismantled materials to be taken away by the contractor beyond the jurisdiction of CLW/CRJ. If the contractor is not willing to take the garbage, that should be transported by the contractor to a suitable location decided by the SSE(W). For this transportation by the contractor, no extra payment will be paid to the contractor, as it is included in the schedule.
9. In order to increase transparency in payment of Contractor Labour wages and other payments, a web based e- application has been developed and hosted on website www.shramikkalyan.indianrailways.gov.in.
