Railway reserves the right to procure bulk or full quantity from bidders who have credential of supplying at least 20% of the same/similar item against single order in last three years to any Zonal Railways/Production units. (Proof of supplying the material to be attached along with offer. )

Applicable. Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

All other terms and conditions as per IRS Conditions of Contract with latest amendments and latest Bid document as attached with NIT and/or available in Public Documents of South Coast Railway Stores Department on IREPS website updated latest as on Tender Opening Date will be applicable.

I/We hereby undertake not to withdraw or modify or impair or derogate from the bid in any respect within the period of validity of this bid/tender. I/we undertake that the information/documents furnished in this bid are not false, misleading or forged. On later date any documents/Information furnished by me/us is found misleading or forged or false, we shall bear the responsibility for the same and we are liable to be prosecuted and penalized as per law of the land.

MSE bidder will be eligible for exemption of EMD irrespective of product category for which the bidder is registered. However, purchase preference will be given to those eligible MSEs who are registered for the product category of the tendered item.

Wherever SD has been exempted, for any reason, and the supplier fails to supply goods as per conditions of contract, as amended from time to time, Purchaser shall have right to levy damages from the supplier for failing to comply with the contractual conditions, not by way of penalty, an amount equal to SD amount, as would have been applicable if the contract was with a non-exempted vendor. These damages shall be treated as recoveries outstanding against the vendor and dealt with accordingly.

In case of conflict between special conditions of contract and IRS conditions of contract/Bid document, the provisions of special conditions of contract shall prevail.

Inspection by Consignee if tender value is less than 5 lakhs. For tender value above 5 lakhs TPI inspection shall be applicable

Offers with long delivery period Full/bulk quantity order may not be placed on the lowest bidder who is eligible bidder for bulk order if the bidder has quoted unreasonably long Delivery period against Railway requirement. In such a case, order may be split and placed on other bidders also.

Offers with short validity The bidders will keep the offer open for acceptance for a period as mentioned in the NIT. Offers with bid validity less than the one prescribed in NIT may be considered at the discretion of the Railway, provided that the validity offered is considered adequate for completion of the tender evaluation process and placement of the order/contract. However offers having an unduly short bid validity, which does not provide reasonable time for completion of the tendering process, shall be liable to be treated as unresponsive and rejected. The decision of Railway regarding the adequacy of the bid validity offered shall be final and binding on the tenderer.
