1. Railway reserved the right to procure the item from OEM/Distributor/Agent. OEMs can authorize and give tender specific authorization to its Agent / Dealers to quote on their behalf provided the manufacturer takes full responsibility for the quality of the material including all the contractual obligations i.e., quality aspects, replacement of parts / items and Warranty / Guarantee obligations and providing genuine replacement supplies.
2. Bidder should have executed same or similar nature of items in any government organisation. Documentary evidence must be submitted along with offer such as copies of recent Purchase Orders, Receipt notes, GeM Contract & CRAC/CRAN etc. Please note that non submission of such documents shall be taken as they are not having any such past performance and their offers may be ignored.
3. Firm should submitted OEM authorization in tender bid.

Tenderers are hereby instructed to supply the tendered quantity to the respective consignee(s) as indicated in tender document (b) If tenderer(s) mentioned anywhere in its offer contrary to (a) above and/or mentions not to supply to some of the consignees, such offer may not be considered for ordering for such consignee(s) where the tenderer has not agreed to directly deliver the stores without any back reference.

100% payment against receipt, inspection and acceptance of material by the consignee at destination.

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

The Contract shall be governed by

1. The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.
2. As per Drug Procurement Policy of Ministry of Railway, Rly. Board, L/No.2014/RS(G)/779/13, New Delhi Dated: 03.02.2015.

Tenderers have to quoted rate as free delivery on FOR destination basis.

MRP of the offered Brand must be mentioned.

The materials shall be subject to inspection, which will be carried out by consignee or authorized representative on receipt of the material in the hospital. The material may also be subject to tests in Railway/Govt./Govt. recognized Laboratory on random basis or whenever found necessary by the concerned consignee.

Acceptance of tender

1. The purchaser reserves the right to reject any or all of the tenders in part or full at his sole discretion without assigning any reason.
2. Railway does not pledge itself to accept the lowest or any tenders and reserves to itself the right of acceptance of the whole or any part of the quantity offered.

Samples All bidders shall, if required by the Consignee/User Department at any stage of bid evaluation, arrange and provide sample of the offered product at a location as decided by the Consignee/User Department, at no additional cost, within 7 (seven) days from the date of intimation. Failure to arrange the demonstration within the stipulated time or unsatisfactory performance during demonstration shall render the bid liable for rejection.

Firms should quote all financial terms only in the relevant columns of the financial bid. Such terms quoted anywhere else will be ignored. Bidders are advice to upload the limited document required in the bid/tender.
