Special Eligibility Criteria

The Railways reserves the right to order entire or bulk quantity from firms having satisfactory past performance for same or similar items as per clause no. 16.4 of General Tender Conditions. The firms need to upload copies of performance documents like R/Note, Receipted Challan, Inspection Certificate etc. for the tendered/equivalent items failing to which their offers are liable to be ignored. Dealers/Distributors should upload Tender Specific authorization from the Original Manufacturer failing which their offers will be ignored without any back reference.
Keeping in view with the Public Procurement (Preference to Make in India) order 2017 as amended time to time , this tendered item is restricted to be procured from Class 1 Local Supplier only (Class-1 Local Supplier means a supplier quoting local content equal to or more than 50% ). Procurement will not be made from Non-Local Supplier having local content less than 50%. It will be applicable as per clause No.28.0 of Eastern Railway General Tender Condition (GTC), as same is applicable for the tender.

Statutory Variation Clause

Statutory variation in taxes and duties ,or fresh imposition of taxes and duties by state/Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract ,or last unconditionally extended delivery period shall be to Railway's account. Only such variation shall be admissible which takes place after the submission of bid .No clam on account of statutory variation in respect of existing tax/ duty will be accepted unless the tender has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor

IRS conditions of contract The contract shall be governed by latest version (along with all correction slips) of IRS condition of contract, and all other terms and conditions incorporated in the tender documents.
General Tender Conditions of Contract The contract shall be governed by latest version (along with all correction slips) of General Tender Conditions of Eastern Railway Stores Department, and all other terms and conditions incorporated in the tender documents .

Validity of offer should be minimum 90 days from the date of tender opening.
1. All the bidders / tenderers should ensure that they are GST compliant and their quoted tax structure /rates are as per GST Law.
2. In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act .The railway shall deduct the applicable GST from his/their bills under reverse change mechanism (RCM) and deposit the same to the concerned tax authority.
3. The offers shall be evaluated based on the GST rate as quoted by each bidder and same will be used for determining the inter se ranking. While submitting offer, it shall be the responsibility of the bidder to ensure that they quote correct GST rate and HSN number.
4. Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by the bidder.
5. Wherever the successful bidder invoices the goods at GST rate or HSN number which is different from that incorporated in the purchase order, payment shall be made as per GST rate which is lower of the GST rate incorporated in the purchase order or billed.
6. Any amendment to GST rate or HSN number in the contract shall be as per the contractual conditions and statutory amendments in the quoted GST rate and HSN number, under SVC.
7. All other terms and conditions are as per IRS Conditions of Contract and General Tender Conditions of Eastern Railway.
The Warranty / Guarantee shall be as specified in the IRS conditions of the contract i.e. 30 months from the date of supply. The offer of firm quoting Warranty/ Guarantee in deviation of tender schedule will be summarily rejected. Suppliers shall ensure that the materials are invariably stamped with manufacturer%u2018s name and month & year of manufacture as may be detailed in drawing/specification of material to enable correct reckoning of warranty.

Paint must be offered for inspection maximum within one month from the date of manufacture of paint.
The supply of inspected paint must be effected maximum within three months from the date of manufacture of paint.
1. Bidders are advised to go through the latest Eastern Railway General Tender Condition for Earnest Money Deposit , Security Deposit ,Liquidated damage and other clauses. Instructions to tenderers and Eastern Railway General tender conditions are available at www.irep.gov.in.
2. EMD and SD as per clause 8.0 and 9.0 of ER general tender conditions will be applicable. (2a) Bid securing declaration to be signed and submitted by bidders (along with bid) availing exemption from submission of EMD.
3. Firms ,who are exempted from submitting the EMD ,will have to attach relevant document as per clause 8.1.0 otherwise their status will be considered non exempted firm.
