Payment Terms

  • 100% payment against receipt, inspection and acceptance of material by the consignee at destination.

Statutory Variation Clause

  • Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/contractor . Standard SVC applicable against documentary evidence. Firm to ensure GST compliance as per Govt. Rules and submit necessary declaration as required.

Standard Governing Conditions

    1. The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract and all other terms and conditions incorporated in the tender document.
    2. The contract shall also be governed by Instructions to Tenderers and General conditions (Indigenous), June 2024 or latest with all corrigendums and amendments, if any issued before tender closing, available as public documents of W. Rly. on IREPS website.
    3. In case of any variation in the terms and condition appearing in IRS Conditions of Contract and General Conditions specified in the tender documents, the latter will prevail. In case of any variation between the General Conditions and Special Conditions specified in the documents, the latter will prevail.

  • EVALUATION CRITERIA

    1. The inter- se-position of all offers received will be decided item wise/consignee wise revised spl.conditions of tender.
    2. Firm should offer their quotation consignee wise and also deliver the quantity consignee wise as per delivery schedule mentioned in tender condition. Offers for delivery location/schedule other than tender condition are likely to be passed over.
  • DELIVERY Free at destination - Material to be delivered at consignee destination.: In case of road delivery, the date of delivery at destination [consignee's end] shall only be treated as delivery date irrespective of F.O.R./ F.O.T. condition mentioned elsewhere in the contract /tender.

  • PAYMENT TERM Applicable As per clause 2900 Instructions to Tenderers and General Conditions (Indigenous), June 2024 attached with the Tender.

  • GOODS AND SERVICE TAX Applicable as per Para 0906 of Instructions to Tenderers and General Conditions of Tender Indigenous Version 14 of June 2024 attached with tender.

  • LIQUIDATED DAMAGE Recovery of Liquidated Damage (LD) shall be levied @ 1/2% (half percent) of the price of the store per week or part of the week during which delivery is accepted and the upper limit for recovery of Liquidated Damages in Supply Contracts is 10 Percent of value of contract irrespective of delays, unless otherwise provided, specifically in the contract.

  • MSE CLAUSE Applicable as per Para 1700 of Instructions to Tenderers and General Conditions of Tender Indigenous Version 14 of June 2024 attached with tender.

Special Conditions

  • Due to technical issue, Approved Agency selected on header as NO however, it may be ignored. As per the Railway Board policy for the procurement of medicines, it is restricted to the sources as per the tender eligibility criteria only.

Technical-Compliances

  • SHELF LIFE

    1. The remaining shelf life of the offered product should not be less than 80% of the total shelf life or it should not be older than 6 months from the date of manufacture (whichever is more) at the time of supply.
    2. In specific cases, CMD/CHD may relax this condition on case basis with the written undertaking by the manufacturing firm that the firm will replace unused quantity free of cost before the expiry date of that item with fresh batch. A strict watch has to be kept in all cases of such relaxation.
  • PACKING AND MARKING INSTRUCTION Packing & Marking will be as per provisions of applicable Pharmacopeia as specified under Drugs and Cosmetic Act 1940 as amended to date

    1. Primary and Secondary packing: The stores will be supplied in packing as approved by the NPPA.
    2. Marking: Each packing shall also be marked with:
      1. Manufacturers name and address.
      2. Batch No, License No, and Date of manufacture and date of expiry.
      3. Quantity contained therein.
      4. Any other particulars as specified under Drugs and Cosmetics Act 1940 as amended to date.
    3. Labels of all Containers, Cartons, Wrappers, Vials, Strips etc. should invariably be marked in block letters. Each strip/packet/bottle that contains the drug should have a printing/stamping with indelible ink of FOR INDIAN RAILWAY USE ONLY. NOT FOR SALE. Firms are advised to put their holograms on their products/cartons.
    4. The firm shall provide products with drug standards printed, such as, IP/USP/BP/EURO/ PHARMACOPOEIA standards, at the time of supply.
  • PRODUCT INFORMATION

    1. Product offered by the firm should be available in open retail market in regions for sale by same brand name. One product sample or scanned outer paper package or label of the product (TAB/CAP/INJECTION vial) as applicable must be submitted with the tender wherever called for.
    2. For imported medicines scanned copy of product packing is sufficient if it contains detailed information. The Railways reserve the right to verify the same.
  • MAXIMUM RETAIL PRICE In case of rates of items in Purchase Order is more than Maximum Retail Price (MRP) mentioned in the Packaging / Products, consignee shall immediately write a letter to concerned Purchase Officer for issue of amendment for lower rates, only after receipt of amendment, bill should be passed.

  • DRUG SAMPLING Whenever drug samples on analysis are found to be not conforming to standards, the firms / suppliers are required to replace the whole batch free of cost with another batch to all consignees, irrespective of whether the batch has been used completely / partially or not.

  • COLLECT BACK SCHEME UNDER SWM Collection of non- biodegradable solid waste after successful delivery of the product / material from consignee place will be arranged by the supplier.

  • BIO-WASTE COLLECTION Collection of non-biodegradable solid waste packing materials, after successful delivery of the products / material from consignee place will be arranged by the supplier.
