IRS Conditions of Contract The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.

General Instructions

Firm should clearly state HSN code of eight digit and also mention that under which chapter and sub- heading of central excise tariff, their GST tariff falls. Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by the bidder.

Special Conditions

1. LD will be levied @ 1/2 % (Half Percent) of P.O value per week or part of the week during which delivery is accepted for delayed quantity (subject to maximum 10%) in case firm failed to execute order within original Delivery Period.
2. Firm to specify all charges including freight taxes clearly and separately.
3. Single Make/Brand of offered material should be clearly mentioned.
4. All the bidders/tendersshould ensure that they are GST compliant and their quoted tax structure/rates are as per GST law.
5. In case the successful tenderer is not liable to be registered nderCGST/IGST/UTGST/SGST Act. The Railway shall deduct the applicable GST fromhis/their bill under reverse charge mechanism (RCM) and deposit the same to the concerned tax authority.
6. The offer shall be evaluated based on the GST rate as quoted by each bidder same will be used for determining the inter se ranking. While submitting offer, it shall be the responsibility of the bidder to ensure that they quote correct GST rate and HSN number.
7. Firm should clearly state HSN code of eight digit and also mention that under which chapter and sub- heading of central excise tariff, their GST tariff falls. Purchaser shall not be responsible for any is classification of HSN number or incorrect GST rate if quoted by the bidder.
8. Wherever the successful bidder invoices the goods at GST rate or HSN number which is different from that incorporated in the purchase order, payment shall be made as per GST rate which is lower of the GST rate incorporated in the purchase order or billed
9. Firm should mention SVC clause clearly in their offer.
10. Any amendment to GST rate or HSN number in the contract shall be as per the contractual conditions and statutory amendments in the quoted GST rate and HSN number , under SVC.
11. Material is used exclusively for Railways.
12. Latest IRS conditions of contract will be applicable.
13. FOR:-Up to Destination
14. Mode of Dispatch: By Rail/Road (IfMode of dispatch is Road, then the date of receipt of material at consignees endwill be considered as actual date of delivery).
Guarantee/Warranty and necessary test certificate (if any) to be provided along with the material.
FOR DESTINATION Firm are advised to quote with delivery term FOR destination, if firm will offer with delivery term FOR ex Works and delivery by Road/Rail than firm shall dispatch the stores in such a way that it shall reach the ultimate consignee before terminal date of delivery mentioned in the contract. In such cases merely the dispatch of material within contractual delivery period does not mean that firm has supplied the material within contractual delivery period but it shall reach to ultimate consignee on or before contractual delivery period as date of supply of material.
