Statutory Variation Clause

  • Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

  • IRS Conditions of Contract The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.

Commercial-Compliance

  • In case of TPI being applicable , as per estimated value of the tender, tenderers must upload a letter of OEM on OEM"s letter head giving address of manufacturers premises where inspection shall be done otherwise the offer will be liable to be ignored. This may be combined with letter of Authorization itself.

  • All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law.Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by bidder.

  • The railways reserves the right to cancel the order, to reduce quantity or to ignore offer of any firm having any pending order without assigning any reason.

  • Terms and Conditions of EMD should be as per in terms of electronic_Tenders_Rev. ITT_Rev_1.21 April 2024.Tenderers seeking exemption from payment of EMD(earnest money deposit) must upload the requisite documentary evidence in support of their claim.

  • 5%(five percent) of PO value may be recovered from the firm as General Damages in case of failure of firm to supply the item.

  • FOR destination rates may be quoted as material is required at the premises of consignee.

  • This tender is governed by Correction Slip No.01 of Instruction to tenderer Rev.1.21 APRIL 2024 .
