The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

Special Eligibility Criteria

• 1. Tenderer with satisfactory past performance for the tendered item (with same/equivalent drawing/specification) within last 3 years for minimum 20 percent of the tendered quantity against a single order to any Zonal railway or railway Pus shall only be eligible for full/bulk order. Other sources may be considered for developmental order, provided the firm submits documentary proof in support of their credentials/satisfactory performance.
  2. All other offers can be considered only for developmental order upto 20 percent of the net procurable quantity provided tenderer is a manufacture or registered with any of the Zonal Railways/PU/CORE or MSE firm for the tendered item [Or for the item having same description, but of different sizes/ratings /capacitiesl subject to their rate being lower than the rate of the lowest bidder eligible for bulk order.
  3. The onus of submission of requisite doiuments (such as copies of Receipt note for stock items, receipt & acceptance for Non Stock items, capacity & capability credential, M&P required for manufacturing tendered item, T&p, Technical manpower, in house testing facilities, MSE credentials, financial credential PAN no/lrcc etc.) along with their e-offer regarding 'Bulk order' or 'Developmental order' lies with the tenderer. In case the tender do not submit the requisite documents as detailed above along with their e-offer, the tender will be decidled on the basis of their past supp]y performance records as available with SECR [if any].
  4. In case tenderer participate as an authorized agent, then the performance as required above shall be that of the Principal, authorizing the agent. lt may so happen that the agent has credentials of past supply for a different Principal but this will not be considered as performance for placing bulk order in case of change of Principal.

Payment Terms

• 100% payment against receipt, inspection and acceptance of material i.e. Receipt Note.

Statutory Variation Clause

• Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

• IRS Conditions of Contract The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.

Commercial-Compliance

• Firm should note that amount of charges related to Forwarding, Freight, Packing Charges etc, if any are considered if they are clearly mentioned in Financial Bid. Charges mentioned at different location other than Financial/ Commercial bid are not considered and to be treated as Nil.

General Instructions

• Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by the bidder.

• The minimum offer validity should be 90 days.
