Special Eligibility Criteria

This item is reserved for procurement from sources approved by RDSO. The Railway reserves the right to order entire or bulk quantity on RDSO approved firm, the status of the firm will be reckoned as on the date of tender opening and not thereafter. But, in case of downgrading/removal/ suspension/banning etc. after pening of tender, such changes shall be taken into account while considering the offers.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

IRS Conditions of Contract The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.

General Instructions

Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by the bidder.

In case of successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, The Railway Shall deduct the applicable GST from His/Their Bill under Reverse Charge mechanism (RCM) and Deposit the same to the concerned tax authority.
Other terms & conditions are as per tender condition of SECR General Tender Condition-2019 along with latest correction slips and same is available in ireps site.
Firm are advised to quote with delivery term FOR destination, if firm will offer with delivery term FOR ex Works and delivery by Road/Rail then firm shall dispatch the Stores in such a way that it shall reach the ultimate consignee before terminal date of delivery mentioned in the contract. In such cases merely the dispatch of material within contractual delivery period does not mean that the firm has supplied the material within contractual delivery period but it shall reach to ultimate consignee on or before contractual delivery period as date of supply of material
In case, the Firm failed to supply leading to cancellation of contract/PO then recoveries @5% of value of unexecuted contract will be applicable.

1. All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law.
2. In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, the railway shall deduct the applicable GST from his/their bills under reverse change mechanism [RCM] and deposit the same to the concerned tax authority. Any additional input tax credit (ITC) benefit, if becomes available to supplier, the same shall be passed on to purchaser without any undue delay.

LD will be levied @ 1/2 % (Half Percent) of P.O value per week or part of the week during which delivery is accepted for delayed quantity (subject to maximum 10%) in case firm failed to execute order within original Delivery Period.
The bidder agrees to supply the tendered stores at the rates quoted by him in accordance with the IRS Conditions at Contract, SECR General tender condition 2019 (along with the latest in correction slips) special conditions and other conditions specified/attached with the tender. If there is any contradiction between the terms and conditions mentioned in the SECR General Tender Conditions 2019 (along with the latest correction slips) and the Standard Conditions mentioned in the Tender Schedule, the condition mentioned in the tender schedule shall prevail.
