Special Financial Criteria

Financial Eligibility Criteria as per Clause 10.2 of GCC 2022. The tenderer must have minimum average annual contractual turnover of V/N or V, whichever is less where, V= Advertised value of the tender in crores of Rupees N= Number of years prescribed for completion of work for which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information as per Annexure-VIB, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet.
Special Technical Criteria

Technical Eligibility Criteria as per Clause 10.1 of GCC 2022. The tenderer must have successfully completed or substantially completed any of the following (From Govt. Organization) during last 07(seven) years ending last day of the month previous to the one in which tender is invited. 3 (Three) similar works each costing not less than the amount equal to 30% of advertised value of the tender, Or 2 (two) similar works each costing not less than the amount equal to 40% of advertised value of the tender, Or 1 (one) similar work each costing not less than the amount equal to 60% of advertised value of the tender. Work experience certificate from private individual shall not be considered. However, in addition to work experience certificates issued by any Govt. Organization, work experience certificate issued by Public listed company having average annual turnover of Rs. 500 Crore and above in last 3 financial years excluding the current financial year, listed on National Stock Exchange or Bombay Stock Exchange, incorporated/registered at least 5 years prior to the date of closing of tender, shall also be considered provided the work experience certificate has been issued by a person authorized by the Public listed company to issue such certificate. In case tenderer submits work experience certificate issued by public listed company, the tender shall also submit a long with work experience certificate, the relevant copy of work order, bill of quantities, bill wise details of payment received duly certified by Chartered Accountant, TDS certificates for all payments received and copy of final/last bill paid by company, in support of above work experience certificate.

- Details of Foundation work (either Open foundation or pile or well foundations).In case any component of work is not clearly defined in submitted certificate the certificate will not be considered for evaluation of Technical Eligibility Criteria and Railway will not ask any clarification from certificate issuing authority.
- In case a tenderer submits a certificate involving a composite work (where apart from Civil Engineering works, other than Civil Engineering works are also included), the value of Civil Engineering components of the work should be clearly mentioned in the certificate which will be used to adjudge the fulfilment of technical eligibility criteria as prescribed. In case, the component of Civil Engineering Work is not mentioned in the certificate submitted, the same will not be considered for evaluation of Technical Eligibility Criteria and Railway will not ask any clarification from certificate issuing authority.

Partnership firm/Joint Venture (JV) / Hindu Undivided Family (HUF) / Limited Liability Partnership (LLP) etc.

Notes for all schedules Standard Schedule of Rates (SSOR) Items: Any item of work carried out by the Contractor on the instructions of the Engineer which is not included in the accepted Bill(s) of Quantities but figures in the Standard Schedule of Rates (SSOR), shall be executed at the rates set forth in the "Standard Schedule of Rates (SSOR)" modified by the tender percentage as accepted in the contract for that chapter of Standard Schedule of Rates (SSOR). However, the cumulative value of all such extra item(s) together (modified by the respective tender percentage) shall not exceed 10 % of the original contract value.
Option of Payment through Letter of Credit (L.C.): Tenderer(s) may submit option for taking payment through Letter of Credit (L.C.). [Refer para 7.1 of tender document].
Credentials if submitted in foreign currency shall be converted into Indian currency i.e., Indian Rupee as under: The conversion rate of US Dollars into Rupees shall be the daily representative exchange rates published by the Reserve Bank of India for the relevant date. Where, relevant date shall be as on the last day of month previous to the one in which tender is invited. In case of any other currency, the same shall first be converted to US Dollars as on the last day of month previous to the one in which tender is invited, and the amount so derived in US Dollars shall be converted into Rupees at the aforesaid rate. The conversion rate of such currencies shall be the daily representative exchange rates published by the International Monetary Fund for the relevant date.
Electronic Reverse Auction (eRA) is applicable in works tender valued more than Rs 50 crore in each case. [Refer para 7.2 of tender document].
Contract under EBR (IF) It is agreed by and between the parties that Railway shall continue to be held responsible for all obligations, risk and liabilities, whatsoever, arising out of or in connection with the Principal agreement and this novation agreement, whether during the progress of the work or after its completion. It is further agreed and understood by and between the parties that IRFC shall be the owner of assets, if any, arising out of execution of works as defined in the Principal Agreement, except the land whose ownership shall continue with Railway. Accordingly, the invoices shall be issued by capturing GSTIN of contractor (as the supplier) and GSTIN of IRFC (as bill to party). Also, the contractor shall submit the invoice, issued in the name of IRFC, to railway for processing payment by Railway to contractor subject to applicable TDS under the Income Tax, GST or any other applicable laws. It is further agreed by and between the Parties that IRFC shall be responsible to comply with Income Tax and GST laws in relation to filling of returns.
There are several changes in the tender document after the new GCC April 2022 is issued. Tenderer(s) are requested to go through the tender document & GCC carefully before the submission of the offer.
Clarification of Bids To assist in the examination, evaluation & comparison and pre-qualification of the Tender, the Railway may, at its discretion, ask any Bidder for a clarification of its Bid. Any clarification submitted by a Bidder that is not in response to a request by the Railway shall not be entertained or considered. The Railway request for clarification and the response of the bidder in this regard shall be in writing. However, if a Bidder does not provide clarification of its bid by the date and time communicated in the Railway request for clarification, the bid shall be evaluated as per the documents submitted along with the bid.

Special Conditions
All works under this schedule to be executed as per detailed specifications and procedure given in Indian Railways Construction Manual & of Indian Railway Unified Standards Specification-2021(IRUSS- 2021)
(Remaining specification of item no. 1 of schedule G) -All the steel materials required for girder fabrication shall be procured from integrated steel manufacturer as given in the tender document.
- The fabrication of girder shall be made in accordance with conditions laid down in tender document & as per IRS Steel bridge Code IRS Welded Bridge Code, IRS-B1-2001, IS-800, IS-814, IS-822, IS-823.
- The Contractor will observe safety as per IS-1179, IS-3016.
- The rate shall include all the inspection cost & testing required by the inspection authority as per guideline given below:
- Inspection prior to welding includes parent metal, edge preparation, operators qualifications, WPSS, micro etching test, charpy test, etc.
- Inspection during welding includes filler materials dimensional checks, non-destructive tests such as Radio-graphic tests (if required) dye-penetration test and other suitable non- destructive tests & any other tests as per IS Codes and IRS Welded Bridge Code.
- The fabrication is to be done in workshop only with approved WPSS, QAP, WPQR, etc. The workshop shall be equipped with all required tools, plants, machineries etc. The engineer-in-charge before commencement of the fabrication work shall approve fabrication site.
- Regarding inspection & passing of the girders by the nominated Inspecting agency/RDSO, decision of the Inspecting agency/RDSO will be final & binding on the contractor.The Rate is including assembling, erection/launching of fabricated bow string steel girders in proper position, line, level, alignment including supply, fabrication, assembling and dismantling of launching nose, erection of staging and scaffolding, dismantling the same after completion of work. The rate shall be inclusive of grouting of sleeve bolts on the bed block complete in all respect with all materials, labour tools and plants, lead & lift. Assembling and erection to be done as per specification laid in RDSO Booklet Sl. No. B-1. This item pertains to erection of girders by contractor's own cranes/derricks/stagings, machineries, plants and equipments etc. wherever required to complete the job, as per approved drawing. The rate is inclusive of all standby cranes, equipments, machineries etc. as directed by Engineer- in-Charge to complete the work. Notes:
- The detail of launching/erection and temporary arrangements scheme shall be submitted by the contractor by approved consultant from Railways for approval before execution. The Erection/ Launching scheme should be proof checked from the nominated proof consultant/IITs. Nomination of proof Consultant for erection of girders will be decided by Chief Engineer. Cost of proof checking works will be borne by the contractor.
- Contractor will be required to do works like riveting/ bolting, cutting etc. to join different parts or pieces of fabricated/released steel structures in connection with assembling, erection & launching of the girders. The rate of this item includes all such misc. works of assembling, erection & launching. No further claim in the regard will be entertained.
- While executing work, safety of traffic is to be ensured as per extant rule and tender condition. Speed restriction boards are required to be supplied by the contractor for which no extra payment will be made. Further, in case of any damage to any member during assembling & erection, the members will be rectified /replaced as per Engineer-at-Site's instructions.

(Remaining specification of item no. 1 of schedule G in continuation of S.I No. 2)-
- The rate includes incidental and other unforeseen costs arising due to cancellation of blocks, wastage of labour, idling of machinery etc. The contractor must quote rates to take into these eventualities, as cancellation of blocks etc. are likely to take place at short notice as per traffic requirements of the section.
- The contractor during erection of the work should provide competent surveyors equipped with total station at site, competent engineers, skilled & experienced staff & workmen.
- Assembling to be done initially by service bolt steel drift and finally with riveting/HSFG Bolts as per approved drawing with supply of Rivet/HSFG Bolt. Vii) Rails ,if required ,for erection shall be supplied free of cost from any Railway Store. Cost of transportation for carrying of rails from railway store to site of work and back after completion of work should be bared by contractor at his own cost.
Apostille Clause
- A power of attorney (PoA) executed outside of India should meet following requirements:
- If the PoA is in a foreign language, it must be translated into English and certified.
- The PoA must be authenticated by an Indian consulate in the country where it was executed. If the PoA was executed in a country that is a member of the Hague Convention, it can be apostilled instead of being authenticated by an Indian consulate. The apostille should be verifiable online.
- The PoA must be stamped in India within three months of its arrival, with the appropriate stamp duty.
- The PoA must comply with Indian laws, including the Indian Registration Act and Power of Attorney Act.
- Documents issued out of India (Balance Sheets, Statutory Auditor's certificate etc) should meet following requirements:
- If the document is in a foreign language, it must be translated into English and certified.
- The document must be authenticated by an Indian consulate in the country where it was executed. If that document was executed in a country that is a member of the Hague Convention, it can be apostilled instead of being authenticated by an Indian consulate. The apostille should be verifiable online.
