  • This Price Agreement shall operate in the nature of a Running Contract. The validity of this Running Contract (interchangeably referred to as the Price Agreement) shall be one (1) years for the placement of Supply Orders / Covering Purchase Orders as and when basis for the respective consignees located at Zonal Railways/ Production Units (PUs) . Supply order/Covering Purchase order to be placed against the Price Agreement shall be the Authority for the supplier to make supplies to respective consignee(s). The validity of the price agreement may be extended for another six months before expiry of original validity at the option of the Purchaser. Overall Quantity on the supply orders will be minimum70% of the Price Agreement quantity

  • FOR BULK ORDER FOR BULK ORDERIndian Railways reserves the right to procure the entire or bulk quantity (Min. 80% of NPQ) of 'Electrical Signal Exchange System' from the firms who have successfully completed Prototype Inspection against specification no- CLW/MS/3/0670/Alt-1 or latest. However, the firm who have completed prototype inspection against CLW specification no- CLW/MS/3/0670/Alt-1 should go through the consistency type test as per Specification no CLW/MS/3/0670/Alt-2 or latest without affecting bulk supply. Bidders have to submit Final Inspection Certificate against specification no-CLW/MS/3/0670/Alt- 1 or latest issued by approving agencies along with their offer.

  • FOR DEVELOPMENTAL ORDER A. Other than above, orders for small quantity upto 20 % of NPQ as a development order may be placed on approved and developmental vendor appearing in U-VAM for CLW item ID: 2100408- LED Based Marker Light or CLW item ID: 2100409 - LED Based Flasher Light or RDSO Item ID: 3100109 - LED Based Twin Beam Head Light with prototype inspection clause. However, offers of firms on whom order has been placed with prototype inspection clause and Final prototype inspection certificate has not been issued till tender opening date, will not be considered for repeat developmental order.B. New vendor may be considered for small quantity of developmental order (up to 5 Percent of outside NPQ). Their offer will be considered for developmental order only if along with offer, they enclose required past credential of supply of same item/ similar to tendered item, details of Plant & Machinery, Testing Facility, QAP, ISO Certificate and other relevant document to substantiate their capacity to develop and supply the tendered item subject to successful capacity-cum-capability assessment as per CLW STR for LED Based Marker Light, LED Based Flasher Light and Electrical Signal Exchange System (STR No.CLW/2022/ELDO/E/STR/0153, Rev.1 or Latest) with prototype inspection clause and completion of formalities as per the bid condition. Offers of firms on whom developmental order with capacity- cum- capability assessment and/or prototype inspection of CLW/Other PU/Other Zonal Railway is pending i.e. Final prototype inspection certificate has not been issued till tender opening date, will not be considered for repeat developmental order.

  • Public Procurement (Preference to Make in India) Order, 2017 :

    1. In view of the Public Procurement (Preference to Make in India) Order, 2017, as amended, it has been found that there is sufficient local capacity and competition in supply of the tendered item of required quality and therefore procurement of the tendered item is restricted to Class-I Local Suppliers or Class-II Local Suppliers only subject to satisfying other qualifying criteria. The vendors who do not classify to be Class-I Local Suppliers or Class-II Local Suppliers should not quote in the tender as their offers shall not be considered for any ordering. Validity of the Contract

  • This tender will be governed by Public Procurement (Preference to Make in India) revised rules as per order of Ministry of Commerce and Industry Department for Promotion of Industry and Internal Trade as per BLW TENDER DOCUMENT REV. Year - 2026 Ver-01 (Copy Attached).

  • New criteria for classification of enterprises based on investment and turnover vide Gazette Notification dated 26.06.2020 has been issuedby the Ministry of Micro, Small and Medium Enterprises and further issued by Railway Board letter No.2020/RS(G)/361/1 dated 01/10/2020. The same is applicable in this tender as per BLW Tender Document Rev. Year 2022-23 along with corrigendums (Copy Attached). In case conditions contained in the above notification contradict with any of the tender conditions, conditions contained in the above notification will prevail

  • Delivery Schedule Delivery to Commence within 1 days after issue of supply order/covering purchase order and to be Completed within 12 months thereafter. Rate of Supply: 200 set per month.

  • Bidders may please note that order may be placed on severable contract basis.

  • GSTIN for State of Uttar Pradesh in the name of Ministry of Railways is: 09AAAGM0289C1ZH. The contractor shall give following declaration while claiming payment:-a. We agree to pass on such additional set off/input tax credit as may become available in future in respect of all the inputs used in the manufacture of the final product on the date of supply under the GST scheme by way of reduction in price and advice the purchaser accordingly.b. As per anti- profiteering measure, section 171 of GST Act 2017 firm will give declaration that "We hereby declare that any reduction in rate of tax on any supply of goods or services or the benefit of input tax credit shall be passed on to the recipient by way of commensurate reduction in prices.c. We hereby declare that additional setoffs/input tax credit to the tune of Rs.----, has accrued and accordingly the same is being passed to the purchaser and to the effect the payable amount may be adjusted.d. We hereby declare ;that any additional input tax credit benefit, if become available to use, the same shall be passed on to the purchaser without anyundue delay.e. Apart from above references of the PO no. Date, and Bill/invoice No. with date is to be mentioned on GST certificates from statutory audit or cost auditor of the company (In case of companies) or practicing cost accountant or practicing chartered account.

  • Contractor shall submit e-invoice of material to be supplied however, if the supplier is exempted from e- invoices following declaration shall be furnished by supplier while claiming the payment as per CGST 2017 Rules available at https://taxinformation.cbic.gov.in/ :- "We hereby declare that through our aggregate turnover in any preceding financial year from 2017-18 on wards is more than the aggregate turnover notified under sub-rule (4) of rule 48, we are not required to prepare an invoice in terms of the provisions of the sub-rule."

  • It is obligatory for the successful tenderer to furnish the manufacturer's Test Certificate or any other Test Certificate specified in the specification along with the supply of stores. In the event of their inability to furnish the Test Certificate, the cost of the test to be carried out will be to the tenderer's account as per Clause 2.6 (A) of BLW Tender Document (latest revision).

Special Conditions

  • BLW reserves the right to distribute the procurable quantity on one or more than one of the eligible tenderers. For detailed tendercondition in this regard bidders to please refer to the relevant tender condition mentioned in BLW TENDER DOCUMENT REV. Year - 2026 Ver-01 (copy attached)

  • Splitting Criteria Splitting Criteria will be as per clause 2.16 and 2.17 of BLW TENDER DOCUMENT REV. Year - 2026 Ver-01 (Copy Attached). It will be applicable at Price Agreement stage.

  • Failure and Termination If the contractor fails to deliver the goods or any installment thereof within the period fixed for such delivery in the contract or as extended or at any time repudiates the contract before the expiry of such period the Purchaser may without prejudice to his other rights:-

    1. Recover from the Contractor as agreed liquidated damages and not by way of penalty a sum equivalent to 1/2 (half) percent of the price of any goods (including elements of taxes, duties, freight, etc.) which the Contractor has failed to deliver within the period fixed for delivery in the contract for each week or part of a week during which the delivery of such goods may be in arrears where delivery thereof is accepted after expiry of the aforesaid period. Upper limit for recovery of liquidated Damages in supply contracts will be 10% (Ten Per cent) of value of delayed supplies irrespective of delays, unless otherwise provided, specifically in the contract, or
    2. Without prejudice to the Purchaser's right to record adverse performance of the contractor for taking appropriate administrative action, cancel the contract or a portion thereof and forfeit the security deposit.
    3. Wherever security deposit has been exempted for any reason, levy damages from the supplier, not by way of penalty, an amount equal to security deposit amount, as would have been applicable had he not been an exempted vendor. These damages shall be treated as recoveries outstanding against the Contractor and dealt with accordingly."
    4. In case of failure by contractor to meet deliveries for any lot, Railways may cancel the Contract for defaulted part by forfeiting SD commensurate to that lot. (Authority Railway Board letter: No.2004/RS(G)/779/11/Pt. Dated:23.12.2019. [Note- It may be noted that clauses (a), (b),
      1. and
      2. above are applicable to regular (bulk) orders, whereas only clauses (b), (c) & (d) are applicable to in-side developmental orders up to 20% of the Net Procurement Quantity (NPQ)].
  • Non Stock Material should be accounted in UDM and digitally signed Receipted Delivery Challan (if applicable), Receipt Note and RO should be issued through UDM.

  • Instructions to suppliers

    1. Payment will be made against e-Bills. Digitally signed e-Bills should be submitted through IREPS for claiming payment against supplies.
    2. It is advised to generate "e-Dispatch Note" through IREPS while dispatching the materials to consignee.
  • Individual consignee will release the consignee e- Receipt Note (e- CRN)/Release Order (RO) only after receipt, inspection, acceptance of the material at the consignee's site.

  • For "classification of Class-I/Class- II/Non-Local vendor" please refer 1.15.3.1 of BLW TENDER DOCUMENT REV. Year - 2026 Ver-01.

  • Option Clause

    1. (+) 30 % option clause shall be applicable against the contracts to be placed against this tender which will authorize the Purchaser to increase the ordered quantity upto 30% in following manner:
    2. (+) 30% option clause is applicable on individual supply orders/ covering purchase orders within the delivery period (including extended delivery period of supply orders/ covering purchase orders) on the same terms and conditions.
    3. New supply orders/ covering purchase orders may be placed on firms under (+) 30% option clause on price agreement quantity within the validity of price agreement (including extended validity of agreement) on the same terms and conditions.
    4. However, the total quantity under (+) 30% option clause will not exceed more than +30% of the price agreement quantity including both(b) & (c) above.
  • Qty. Allocation: : This Price Agreement/Running contract for supply of Electrical Signal Exchange System for Three Phase Locomotive (Each system consists of

    1. Two sets of LED lights
    2. Operating Panel/Switches for loco pilot and assistant loco pilot separately and
    3. Harnessed cable for Connection)Spec:CLW/MS/3/0670 ALT. 2 shall be operated to make direct supplies to various consignees/locations mentioned in this NIT document . Quantity and Consignee details shown in this tender of Price Agreement/ Running Contract is tentative. Zonal Consignee, Zone and Shed- wisequantity allocation may change during the currency of the price agreement/running contract as per requirement of the Railways.
  • It is clarified that the bidders offering imported products will fall under the category of Non-local suppliers. They can't claim themselves as Class-I localsuppliers/Class-II local suppliers by claiming the services such as transportation, insurance, installation, commissioning, training and after salesservice support like AMC/CMC etc. as local value addition.

  • All bidders may please note :

    1. All the bidders/Tenderers while quoting the rates should clearly indicate HSN Code, the rate of applicable duties and taxes included in the prices quotedby them. Any variation in tax structure/rate due to introduction of GST shall be dealt with under Statutory Variation clause.
    2. all the bidders/Tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law.
    3. All vendors should have GST Registration Number.
    4. GST Act and Rules as applicable from time to time is applicable.
    5. In case the successful tenderer is not liable to be registered under CGST/GST/ UTGST/SGST ACT, the railway shall deduct the applicable GST from his/theirbills under reverse charge mechanism [RCM] and deposit the same to the concerned tax authority
    1. The offers shall be evaluated based on the GST rate as quoted by each bidder and same will be used for determining the inter se ranking. While submitting offer, it shall be the responsibility of the bidder to ensure that they quote correct GST rate and HSN number.
    2. Goods & Services Tax (GST): All tenderers to quote correct HSN code and corresponding GST rate for the item/items quoted. Misclassification in HSN code, if quoted by any bidder, shall be dealt as per following conditions. The Purchaser shall not be responsible for any misclassification of HSN Number or incorrect GST rate, if quoted by the bidder. Any increase in GST rate due to misclassification of HSN number shall have to be absorbed by the supplier. Wherever the successful bidder invoices the goods at GST rate or HSN Number which is different from that incorporated in the purchase order; payment shall be made as per GST rate which is lower of the GST rate incorporated in purchase order or billed. Vendors will be required to adjust basic price to the extent required by higher tax billed as per invoice to match the all-inclusive price as mentioned in the purchase order.
  • In case you have quoted GST, or any other levy, statutory variation will be applicable for these levies.

    1. Revised 'Public Procurement (Preference to Make in India), Order 2017 dated 15.06.2017 revised vide letters dated 04.06.20, 16.09.20 & 19.07.24 (referred as PPP-MII order 2017 in subsequent Paras), for the tendered item(s) has been circulated by Railway Board vide letterno. 2020/RS(G)/779/2/Pt.1 dtd. 25/09/2020. Refer Clause 1.15.3 to BLW Tender Document Rev. Year- 2026 Ver-01 uploaded with the tender and also available on website www.ireps.gov.in.
    2. The vendor who do not qualify to be Class-I local supplier or Class-II Local supplier should not quote in the tender as their offers will not considered for any ordering.
  • If an agent submit bid on behalf of the principal/OEM, the same agent shall not submit a bid on behalf of another Principal OEM in the same tender for the same item/product. In such cases both the bids of that agent will be summarily rejected. (Details as per Para 2.12.7 of BLW Tender Document Rev. Year-2026 Ver-01.

  • Material to be procured from OEM or their authorized dealers / distributors. [For details kindly refer Para 2.13.3 of BLW Tender Documents (Rev. Year-2026 Ver.1)].

  • In a tender either the Agent on behalf of the Principal/ OEM or Principal/ OEM itself can bid but both cannot bid simultaneously for the same item/product in the same tender. In cases where both principal/OEM and their agent participate in bidding for same item/product, any orboth the bids shall be liable to be rejected.   • Manufacture or their sole selling agents may note that an agent can represent only one firm in a tender and any manufacturer cannot submit two offersagainst a tender through different sole selling agents or one directly and one through sole selling agent. In such a situation both the offers will be rejected.

  • The Contractor/ Seller hereby covenants that it is a condition of the contract that all goods furnished to the Purchaser under this contract shall be of the highest grade, free of all defects and faults and of the best materials, quality, manufacture and workmanship throughout and consistent with the established and generally accepted standards for materials of the type ordered and in full conformity with the contract specification, drawing or sample, if any and shall, if operable, operate properly. Unless otherwise mentioned in drawings/specification, Standard warranty period as per IRS conditions of contract [ i.e. The Contractor also guarantees that the said goods would continue to conform to the description and quality as aforesaid, for a period of 30 months after their delivery and this warranty shall survive notwithstanding the fact that the goods may have been inspected, accepted and payment therefore made by the Purchaser.] shall be applicable.

  • The tenderers in their bids shall indicate the details of their Jurisdictional Tax Assessing Officers (Designation, address and e-mail id). In case of a contract award, a copy of the LOA/Purchase Order shall be immediately forwarded by Purchaser to the Jurisdictional Tax Assessing Officer mentioned in the Tenderers bid.

  • Handling of Warranty and Rejections For Warranty and Rejections kindly refer para 2.18(A) of BLW Tender Document Rev. Year 2026 ver.-01.

  • Part Supply Part Supply is allowed. Transit insurance up to destination i.e. BLW, Varanasi to be borne by the firm. Failure and Termination of the contract shall beenforced as per relevant Clauses of IRS conditions of contract. Manufacturer to follow packing and marking instructions as per the specification/drawing and as per IRS conditions of contract 2025 clauses No 4.11 , failing which supplies received are liable to be rejected by consignee. To avoid fire hazard, non flammable material only to be used for packing

  • Please note that in case of non acceptance of inspection clause or acceptance with any deviation/rider, the offer is liable to be ignored. In case it is neither confirmed nor denied, it would be presumed that bidder has accepted this special condition of Tender.
