Technical-Compliances

• The Bid Security shall be deposited either in cash through epayment gateway or submitted as Bank Guarantee bond from a scheduled commercial bank of India or as mentioned in tender documents. The Bank Guarantee bond shall be as per Annexure- 5 and shall be valid for a period of 90 days beyond the bid validity period.

• For Standard Financial criteria and Standard Technical criteria - Tenderers are required to submitted authenticated certificate along with the tenders from officers of government or semi- government/public sector undertakings under whom the work has been executed indicating there in the name of work executed, value of works/payment details and period during which completed. Such certificates should have signature and seal of the concerned officer. In the absence of such certificate the tender may not be considered.

• The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the Railway,make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification by the railway shall not relieve the bidder of its obligations or liabilities hereunder nor will it affect any rights of the railway thereunder.

• Eligibility criteria for works tender in respect of partnership firms:-

• in case the tenderer is a partnership firm s , the experience, solvency and turn over shall be in the name and style of the firm only.

• If the tenderer is a partnership firm, all the partners shall be jointly and severally liable for successful completion of the work and no request for change on the certification of the firm shall be entertained.

• During the currency of the contract, no partner of the firm shall be permitted to withdraw from partnership business and in such and event it shall be treated as breach of trust and abandonment of the contract.

• Any Conditional offer will be summarily rejected.

• All tenderers are expected to submit full credentials with their tender to establish their capacity to undertake and successfully complete the tender work.

• It would be advantageous if the claims of having completed the works after supported by certificates/testimonials given by the agency for whom the work had been done.

• It may be noted that submission of complete and accurate information is the responsibility of the tenderer. The Tender Inviting Authority reserves the right to verify, in any manner at its sole discretion, the accuracy of the information furnished by the Tenderer and if it is revealed that the Tenderer had submitted incorrect information to derive undue benefits, his Tender may be summarily rejected on these grounds

• The Tenderers should ensure that the information given in this part of the tender clearly establishes his capacity to successfully execute the tender work. It may be noted that the Tender Inviting Authority does not have any obligation to seek clarification on the information furnished or the information furnished is incomplete/inadequate to establish the tenderers capacity, the tender is likely to be rejected on these grounds. No plea made by the tenderer on this account by submitting additional information, etc. shall be entertained by the Tender Inviting Authority.

• Date and time of close of Tender Tender would close at the specific time and date. In case the specified date is declared a holiday, the tender would close at the same time on the next working day.

• Tenders have been invited for and on behalf of the President of India for the work mentioned as per NIT.

• Tender documents are not transferable .

• It is understood that you are agreed to abide by the conditions those are laid down in the tender document when you submit the tender.

• The tender document includes various chapters, drawings and annexures as enclosed, those are integral parts of the tender documents.

• Rates enter in to rate page shall only be considered. Rates offered in any other form /letter by the tenderer shall not be considered.

• Tenders other than in form of e-Tendering shall not be accepted against this tender. For this purpose, tenderers are required to submit their offer in IREPS.

• In case of any difficulty faced by the tenderer while submitting their bid in the IREPS website assistance from help desk available with the website may be sought.

• Railway Administration will not be responsible for any delay/difficulties /inaccessibility of the down loading facility for any reason whatsoever. In case of any discrepancy between the tender documents down loaded from internet and the master copy available in the offices, the latter shall prevail and will be binding on the tenderer(s). No claim on this account will be entertained.

• General information about the project/work is attached separately. However the tenderer(s) are advised to visit the site for appreciation before submitting of tender.

• The railway reserves the right to:

• Amend the scope and value of the work.

• Reject or accept any tender; and

• Cancel the tender process and reject any or all tenders, at any time.

• The tenderer(s) have to fill up all the documents as stated in document.

• Incomplete tenders are liable to be rejected without further correspondence.

• If any one or more of the detailed information furnished in the tenderer's documents is proved to be false at any stage, the contractor/ firm will be debarred then and there, from all the commitments connected with the tender and his/their tender/contract will be rejected/terminated and further action will be taken as per extant rules.

• The Railway reserves the right to reject any or all offers without assigning any reasons and his decision shall be final and binding.

• Name & mailing address of the Tenderer(s) shall be clearly mentioned in ENGLISH language.

• All the information requested for Tender shall be answered in the ENGLISH language. Where information is provided in another language, this shall be accompanied by a translation of its pertinent parts into ENGLISH. This translation will govern and be used for interpreting the information.

• In case of two packet system of tendering, the Second packet (Finance Bid) of only eligible tenderers found in the first packet (Technical Bid) will be opened.
