1. Bidders may please note that DPIIT vide their OM number P- 45021/102/2019-BE- I1-Part(1)E-503 (10) dated 04.03.2021 has clarified the following: It is clarified that the bidders offering imported products will fall under the category of Non local supplier. They can not claim themselves as Class-I/Class-II local suppliers by claiming the services such as transportation, insurance, installation, commissioning, training and after sales service support ;like AMC/CMC etc as local value addition.
2. The estimated Tender Value being less than Rs 10 Crore, the Vendors/Bidders are required to indicate percentage of local content and also mandatorily furnish [Self Certification] as per PPP-MII order 2017 as amended that the item offered meets the local content equirement for Class-I local supplier failing of which offers may likely to be ignored.
3. This item is classified as the item where there is sufficient local capacity and competition and where public procurement shall be done only from Class-I local suppliers under clause 3(a) of PPP-MII, order dated 04.06.2020 as per Rly Board letter No. 2015/RS(G)/779/5 (Vol.III) dated 22.06.2020. Rly Board letter in this regard is attached as PPP RB Dtd 22062020 as PDF file. Therefore, in keeping with the Public Procurement (Preference to Make in India) order 2017, as amended, it has been found that there is sufficient local capacity and competition in supply of the tendered item of required quality and therefore public procurement of the item is restricted to Class-I local suppliers only and the vendors who do not qualify to be Class-I local suppliers should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a Class-I local supplier for the tendered item participates in the tender, it does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor. It is mandatory for the tenderer to provide certification as per PPP- MII order 2017, as amended, in addition to other qualifying criteria of the tender.

Special Eligibility Criteria

Railway reserves the right to procure full/bulk quantity of the tendered item from RDSO approved sources for tendered item or their authorized dealers/agents only. Authorized dealer / agent must upload the tender specific authorization along with their offer, failing which their offer will be summarily rejected without back reference. The OEM/Authorized Dealers/Agents must comply with the following conditions failing which their offers are liable to be rejected without further reference:
1. In a tender, either the authorized dealer/agent on behalf of the Principal/OEM or the Principal/OEM itself can bid, but both cannot bid simultaneously in the same tender for the same item.
2. If an authorized dealer/agent submits bid on behalf of the Principal/OEM, the same dealer/agent shall not submit a bid on behalf of another Principal/OEM in the same tender for the same item. For details refer Clause No 9.2.4 of Section- I (Instructions to Tenderers) and 10.10 of Section-II (General conditions of Tenders) of ECoR Tender document uploaded in website www.eastcoastrailway.indianrailways.gov.in and www.ireps.gov.in NB: The Developmental Order will be placed on Developmental Vendors only and as per RB Letter No. 2021/RS(G)/779/7 dated 09.05.2025, the "Developmental Vendors" are only such vendors which are listed as Developmental vendors on UVAM without any condition.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor. SVC ( Statutory Variation Clause) will be applicable within the validity of the Contract as per Clause No 3 of General Conditions of Tender in ECoR Tender Conditions uploaded in website as well as attached with this tender.

Standard Governing Conditions

IRS Conditions of Contract The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.

Commercial-Compliance

F O R Destination, i.e. [I] Materials pertaining to GSD/MCS to be delivered to the respective consignees in Mancheswar (MCS) .Firms quoting F O R other than F O R Destination, their offers will summarily be rejected.

General Instructions

Guarantee/Warranty Firms are advised to offer Guarantee/Warranty minimum 04 years for each cell.
Mode of Despatch By Road.
1. All the Bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law.
2. In case the successful tenderer is not liable to be registered under CGST/IGST/SGST/UTGST Act, the Railway shall deduct the applicable GST from his /their bills under reverse charge mechanism and deposit the same to the concerned tax authority.
3. The offers shall be evaluated based on the GST rate as quoted by each bidder and the same will be used for determining the inter se ranking. While submitting offer, it shall be the responsibility of the bidder to ensure that they quote correct GST rate and HSN number.
4. Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by the bidder.
5. Wherever the successful bidder invoices the goods at GST rate or HSN number which is different from that incorporated in the Purchase Order, payment shall be made as per GST rate which is lower of the GST rate incorporated in the Purchase Order or billed.
6. Any amendment to GST rate or HSN number in the contract shall be as per the contractual conditions and statutory amendments in the quoted GST rate and HSN number, under SVC.

Other Conditions

1. A wall mounting type Tool Board of suitable material and protected against acid fumes shall be supplied along with set of 12 Nos. each battery. The tool Board should comprise:
  1. One syringe for adding or taking out electrolyte from the cells.
  2. One syringe type hydrometer of requisite range for measuring the specific gravity of electrolyte in the cells. This shall be provided with a graduated scale, one division of which representing at the most 0.005 unit of specific gravity with accuracy of calibration not less than 0.005 units of specific gravity.
  3. One cell-testing- voltmeter,0-3V of accuracy, class 0.5 in accordance with IS: 1248-1968.The resistance of the voltmeter shall be 1000 ohms/Volt.
  4. One thermometer with an appropriate scale for measuring temperature of electrolyte. One division of the graduated scale of the thermometer shall represent at the most 1 deg. C, the accuracy of calibration being not less than 0.5 deg.
2. Each cell shall be supplied preferably with dual terminals.

Nature of item - Safety

Price Variation Clause The price of battery is based on HZL's price of lead (min.99.99%) @ Rs.2,20,100.00 Per MT of Chanderiya Lead Zinc smelter's price dt.04.05.2026. (exclusive of all statutory duties and taxes) and also considering the discount offered by M/s HZL in its price circular. The basic price will be subject to variation as follows:- For every increase or decrease of HZLs lead price of Rs.100 per MT (exclusive of all statutory duties and taxes) or part there of the price of the battery quoted will be subject to an increase or decrease of Rs.0.65 per battery (exclusive of all statutory duties and taxes). In the event of variation in HZL price as declared by M/s HZL, adjustment in contract price upward/downward will be regulated with reference to the date of inspection offer. The price of HZL lead prevalent one month prior to the date of offering battery for inspection will be considered for computing the PVC.
