Special Financial Criteria

Financial Capacity The Bidder shall have a minimum Net Worth (the "Financial Capacity") of of 5% (Five percent) of the Estimated Project Cost of the Project at the close of the preceding Financial Year . The tenderer shall not have total amount of dispute in their pending litigation more than Fifty percent (50%) of the tenderer's Net Worth. The tenderer shall be examined for all pending litigation from all contracts completed or all ongoing contracts. The tenderer shall provide detailed information of all such pending litigations in the prescribed proforma given in Appendix-VIII. The details of all pending litigation shall comprise of all such Arbitration cases and also all pending Court cases irrespective of whether these litigations have been initiated by the tenderer against their Employer/Authority/Client or by the Client/Employer/Authority against the tenderer. The amount of disputes shall also comprise of all the claim amount and also all counter-claim amount in such Arbitration/Court cases.Moreover, the eligibility criteria will be as per attached RFP document.

Special Technical Criteria

2.2.2.1Technical Capacity ((Refer to Para 2.2 of the RFP for complete details):- For demonstrating Technical Capacity and experience (the "Technical Capacity"), the Bidder shall, during the last 5 (five) previous financial years and the current financial year up to the Base month (not to be read with para-2.1.13).
1. have received payments for construction of Eligible Project(s), or has executed construction works by itself in a PPP project, such that the sum total thereof, as further adjusted in accordance with clause 2.2.2.4 (i) &
2. is more than 2.5 (two and half) times the Estimated Project Cost (the "Threshold Technical Capacity").Provided that at least one fourth of the Threshold Technical Capacity shall be from the Eligible Projects in Category 1 and/ or Category 3 specified in Clause 2.2.2.4 (i) & (ii)(ii)Completed (executed) or Substantially completed$ (executed) at least one Eligible Project of Railway Sector as mentioned in clause 2.2.2.4/iii of value of not less than [50% (thirty-five) per cent] of the Estimated Project Cost However, in case of Consortium/Joint Venture, the other members of Consortium/Joint Venture (who are not considered for satisfying this technical Capacity under this clause) also must have Completed (Executed) or Substantially completed$ at least one Eligible Project of Railway Sector as mentioned in clause 2.2.2.4/iii of value of not less than [10% (ten) per cent] of the Estimated Project Cost.
3. Completed (executed) or substantially completed$ (executed) at least one similar work of value of not less than [20% (Twenty percent)] of the estimated project cost.OR(b) Completed (executed) or substantially completed$ (executed) at least two similar works of value of not less than [10% (Ten percent)] of the estimated project cost.Moreover, the eligibility criteria will be as per attached RFP document.

General Instructions

TENDERER MUST GO THROUGH THE TENDER DOCUMENTS TO ACCERTAIN AND GET THEM KNOWLEDGE OF GENERAL CONDITIONS OF CONTRACT, TENDERING CONDITIONS OF E TENDERING AND DOUBLE BID SYSTEM. THE TENDERER MUST ALSO GO THROUGH THE OTHER DOCUMENTS SUCH AS SPECIAL CONDITION, SPECIFICATIONS, DRAWINGS, SCOPE OF WORK ETC ATTACHED AS DOCUMENTS ON THE WEBSITE.
IMPORTANT INSTRUCTIONS TO TENDERERS
1. The offer will be evaluated based on certificates enclosed with the original offer only. The Railways will not enter into any correspondence to get these certificates subsequently and the offer shall be evaluated based on the documents submitted along with the offer.
2. Please note that the completion certificate issued by an executive must indicate the following necessary information : Description of work, organization for whom executed, value of contract at the time of award and date of scheduled completion of work, final value of contract( i.e. actual completion cost), actual date of physical completion of work.
All rates quoted in the tender shall be deemed to be inclusive of all Taxes royalties payable by the contractor s to the Government or public body or local authority and no additional amount will be paid or claim entertained on this account by the Railway

It is the responsibility of the Contractor to arrange the Payment of the labour employed for the work through Bank as per Minimum Wages Act
I n case o f any wrong information submitted b y tenderer, the contract shall be terminated, Earnest Money Deposit (EMD), Performance Guarantee (PG) and Security Deposit ( S D ) of contract forfeited and agency barred for doing business on for 5 (five) years.

The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the Railway, make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification, by the Railway shall not relieve the bidder of its obligations or liabilities hereunder nor will it affect any rights of the Railway thereunder.
1. In case of any information submitted by tenderer is found to be false forged or incorrect at any time during process for evaluation of tenders, it shall lead to forfeiture of the tender Earnest Money Deposit besides banning of business for a period of upto five years.
2. In case of any information submitted by tenderer is found to be false forged or incorrect after the award of contract, the contract shall be terminated. Earnest Money Deposit (EMD), Performance Guarantee and Security Deposit available with the railway shall be forfeited. In addition, other dues of the contractor, if any, under this contract shall be forfeited and agency shall be banned for doing business for a period of upto five years.

The execution of work shall be jointly planned to suit the priority of work and same will be generally followed. However, due to change in priorities, in the execution of particular phase of work, the same will have to be done and followed for proper execution in phase with Engineering works.
Prices quoted by the contractor should be firm commercially and inclusive of all taxes, duties leviable on works contract. If any successful tenderer shall produce documentary evidence of taxes/ duties paid by him to the State Government/Central Government while claiming the payment , no such extra payments will be paid to the successful tenderer.
The date of publishing of tender on IREPS website shall be treated as date of publication of tender notice for the purpose of calculation of sufficient notice period for tender i.e. 21 days
Corrigendum Notice on IREPS Railway may modify the tender documents, other related documents and tender schedule by issuing online corrigendum on IREPS (www.ireps.gov.in) 15 days prior to the tender closing date.

Special Conditions

Special condition of contract for mandatory updation of Labour data on Railway's shramik kalyan portal by contractor. (As per Railway board letter no. 2018/CE-I/CT/4 dated. 17.10.2018).The special condition is as under:- Contractor is to abide by the provisions of payment of wages act & minimum wages act in term of clause 54 and 55 of Indian Railway General condition of contract. In order to ensure the same, an application has been developed and hosted on website 'www.shramikkalyan.indianrailways.gov.in'. Contractor shall register his firm/company etc. and uploaded requisite details of labour and their payment in this portal. These details shall be available in public domain.
