Special Eligibility Criteria

    1. Tenderers with satisfactory past performance for the tendered item or item similar to the tendered item ( with same/equivalent drawing) within last 03 years from date of tender opening to any Zonal railway or Railway PUs shall only be eligible for full/ bulk order.Other source may be considered for development order up to 20% of the net procurement quantity, provide the firm submits documentary proof along with his offer in support of their credentials / satisfactory performance.
    2. The Tenderer should enclosed detailed documents like PO Copy,R/Note & Other document along with his offer in support of his fulfillment of eligible criteria.Otherwise the offer will be summarily rejected.No Post Contract correspondence will be done in this regard.
    3. Offers of Firm quoting higher DP will be ignored

Statutory Variation Clause

  • Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

  • IRS Conditions of Contract The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.

General Instructions

  • Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by the bidder.

  • The Rates and other financial terms quoted in relevant columns of financial bid will only be ruling terms for acceptance. Such terms quoted anywhere else should be ignored.

  • Consequence of Failure

    1. In case firm fails to execute the contract within original or extended delivery period, the purchaser will be entitled to impose Liquidated amages(LD) for extension of Delivery Period or may decide to cancel the contract by forfeiting the Security Deposit submitted by the firm.
    2. In case where SD has been exempted for any reason, and the supplierfails to supply goods as per the conditions of the contract, as amendedfrom time to time, Purchaser shall have right to levy damages from the supplier for failing to comply with contractual conditions not by way ofpenalty, an amount equal to SD amount, as would have been applicable if the contract was with a non -exempted vendor. These damages shall be treated as outstanding recoveries against the vendor and dealt accordingly.

  • If vendor quotes delivery period as range bound period then the lower value of that range will be considered for delivery period.

  • Unloading by the firm at the designated place at consignee premises.
