FOR DESTINATION Firm are advised to quote with delivery term FOR destination, if firm will offer with delivery term FOR ex Works and delivery by Road/Rail then firm shall dispatch the stores in such a way that it shall reach the ultimate consignee before terminal date of delivery mentioned in the contract. In such cases merely the dispatch of material within contractual delivery period does not mean that firm has supplied the material within contractual delivery period but it shall reach to ultimate consignee on or before contractual delivery period as date of supply of material.

Tenderers who are OEM, must give undertaking for supply of spare parts for a period of expected life of the machine/equipment for 10 years from the date of installation and commissioning at the railway premises/place of inspection. Other tenderers must submit undertaking from OEM for supply of spare parts for a period of expected life of the machine/ equipment.

Technical-Compliances

1. Warranty/Guarantee shall be as specified in relevant specification. Where ever this clause is not covered in the specification, IRS Warranty/Guarantee clause will apply. Warranty/ Guarantee: 24 months from the date of commissioning.
2. The supplier shall depute their service engineer during the guarantee period to render free service immediately on receipt of call from the consignee.

Special Eligibility Criteria

Bidders to quote with tender specific authorization as per Railway Board Guidelines directly from OEM and the purchaser shall confirm the genuineness of OEM authorization. Offer without valid authorization from OEM shall be summarily rejected without any back reference and no representation will be entertained.

1. The tenderer must have supplied and commissioned successfully at least 01 (one) no. DHR crane of capacity 5 tons or more in the last 5 years to Indian railways or central govt./state organizations/PSUs of central and state undertakings.
2. The onus of submission of requisite documents (such as copies of Receipt note for stock items, receipt & acceptance for Non Stock items, capacity & capability credential, M&P required for manufacturing tendered item, T&P, Technical manpower, in house testing facilities, MSE credentials, financial credential PAN No/ITCC etc.) along with their e-offer regarding 'Bulk order' lies with the tenderer. In case the tenderer do not submit the requisite documents as detailed above along with their e-offer, the tender will be decided on the basis of their past supply performance records as available with SECR [if any].
3. In case tenderer participate as an authorized agent, then the performance as required above shall be that of the Principal, authorizing the agent. lt may so happen that the agent has credentials of past supply for a different Principal but this will not be considered as performance for placing bulk order in case of change of Principal.

Payment Terms

80% payment shall be made on receipt of the items in satisfactory condition, against suppliers challan certified by consignee gazetted officer, and inspection certificate issued by the nominated inspection agency. Balance 20% payment shall be made after successful installation, commissioning and acceptance of the equipment by consignee subject to submission of Bank Guarantee for 5% of the contract value for warranty obligations (format as per Annx.-VII of SECR General tender condition 2019 enclosed in the tender document), valid beyond 6 months period of warranty.Material will be accounted through UDM only.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Earnest Money Deposit (EMD)
1. EMD:- Firm shall submit EMD amount @2% of the estimated value of the tender rounded off to nearest higher Rs 10/-. Please read carefully correction slip no. 001 of SECR General Tender condition 2019 regarding Earnest Money Deposit which is applicable in this case.
2. Please note that submission of EMD is exempted only to those firms who are registered with UDYAM for tendered item / Indian Ordinance Factories/Other Railway and Government Departments/PSUs owned by Ministry of Railways and PSUs for the group of items that are manufactured by them. Firms appearing on the approved list of RDSO forthe tendered item shall be exempted for submission of EMD subject to approval status of the firm being valid on the date of tender closing. The Firm registered with PCMM, South East Central Railway/ Bilaspur for the trade group of the tendered item shall also be exempted for submission of Earnest Money Deposit according to the monetary limit of registration. Firm shall clearly indicate their registration number along with monetary limit of registration, if any. Tenderers must upload/submit valid documents for the exemption of EMD along with their bid. Note: If any tenderer neither submit EMD nor uploaded valid documents for exemption of EMD, then their offerwill be summarily rejected

Final inspection will be done by consignee with firm's representative at consignee's end for Prove out test & commissioning.
If any condition mentioned any where in the tender document,which contradict above conditions then the above conditions shall supersede.
Railway reserves the right to modify the requirement regarding staged inspection as per applicable STR/Specifications at later stage.
Training Contractor shall train the Railway staff regarding operation and maintenance of equipment during commissioning of M P.

Special Conditions

The bidder agrees to supply the tendered stores at the rates quoted by him in accordance with the IRS Conditions of Contract , General Tender Condition of SECR 2019, Correction Slip No.001, 002, 003,004,005,006, 007,008,009,010,011, 012,013,014,015 & 016 with latest updation till date of tender opening , special Conditions and other Conditions specified/attached with the tender .In case of any conflict with the standard terms and conditions mentioned in the SECR General Tender Condition 2019 ,Correction Slip No.001, 002, 003, 004,005,006, 007,008,009,010,011,012,013, 014,015 and 016 & tender conditions mentioned in this tender schedule , the tender conditions mentioned in this tender schedule will prevail.
Consequence of Failure
1. In case firm fails to execute the contract within original or extended delivery period, the purchaser will be entitled to impose Liquidated Damages(LD) for extension of Delivery Period or may decide to cancel the contract by forfeiting the Security Deposit submitted by the firm.
2. In case where SD has been exempted for any reason, and the supplier fails to supply goods as per the conditions of the contract , as amended from time to time, Purchaser shall have right to levy damages from the supplier for failing to comply with contractual conditions not by way of penalty, an amount equal to SD amount, as would have been applicable if the contract was with a non -exempted vendor. These damages shall be treated as outstanding recoveries against the vendor and dealt accordingly.
Security Deposit - The successful tenderer will have to deposit security money @ 5 % of contract order value (rounded off to nearest higher Rs 10/-) within 14 days of issue of supply order /Purchase order subject to the exemption as mentioned in SECR General Tender Conditions 2019 and correction slip no. 001,004 & 006 of SECR General Tender Conditions 2019. The security money has to be deposited in any of the forms mentioned in the SECR General Tender Condition 2019. 2. Tenderer are advised to read carefully SECR General Tender Condition 2019, Correction Slip No.001, 004 and.006 issued regarding revised EMD & SD which is applicable in this case.
All expenses of service engineer for attending the machine during warranty period will completely be bear by tenderer.
In the event of contractors' failure to have M&P commissioned by the time or times respectively specified in the letter of acceptance or contract, Purchaser may withhold, deduct or recover from the Contractor as penalty, a sum @ 1/2% (Half percent) of the price of M&P which the contractor has failed to commission as aforesaid for each week or part of a week during which the M&P may not have been commissioned, subject to an upper limit of 10% ( ten per cent) of contract value.
In addition to warranty obligations prescribed under specs attached with this tender, the warranty period would also cover comprehensive preventive maintenance, which will be inclusive of all spares, material and labour cost. All maintenance consumables like lubricants and grease except hydraulic oil/machine coolants shall form part of the scope of the preventive maintenance during the warranty.
