• The tenderer shall clearly specify whether the tender is submitted on his own (Proprietary Firm) or on behalf of a Partnership Firm / Company / Joint Venture (JV) / Registered Society / Registered Trust / Hindu Undivided Family (HUF) / Limited Liability Partnership (LLP) etc. The tenderer(s) shall enclose the attested copies of the constitution of their concern, and copy of PAN Card along with their tender. Tender Documents in such cases are to be signed by such persons as may be legally competent to sign them on behalf of the firm, company, association, trust or society, as the case may be.(For details please refer to Para 14, 15,17 & 18 of Chapter 4 of Annexed Document).

Important Note:-

  1. The Power of Attorney duly Notarized shall be submitted even if such specific person is authorized for above purpose through Partnership Deed/Memorandum of Understanding/Article of Association or such other document.
  2. In case one or more of the members of JV is/are partnership firm(s)/Proprietary firm/HUF/Companies/LLP Firm(s)/Society(s)/Trust(s), the required documents of each individual member of JV shall be submitted along with the documents to be submitted on behalf of the JV.
  3. Non submission of above documents or submission of incomplete documents shall lead to summarily rejection of the offer.

• Tenderers should have valid OEM Certificate for Cummins make Diesel Engine on the closing date of tender. The tenderers shall submit scanned copy of the said OEM Certificate along with the tender offer. Non submission of scanned copy of OEM Certificate shall lead to summarily rejection of offer.

• The quantities specified in the tender schedule are only approximate and liable to vary. The Railway reserves the right to increase/decrease and/or delete or include any of the quantities as specified in schedule and no extra rate will be allowed on this account.

• Railway reserves the right to ask clarification with respect to documents available/attached with the E-tender, if required.

• Mandatory Special Condition of contracts on Police Verification of Staff/labour deployed by the contractors on Railway premises applicable for both Works and Service Contracts.

• Indian Railways Standard General Conditions of Contract -April 2022 with updated advance correction slip and Annexed Documents & upload documents are part of the tender document.

• No manual tenders sent by Post/FAX/Courier or in person shall be accepted

• Payment of Bid Security shall be accepted either in cash through e-Payment Gateway or as Bank Guarantee bond from a Scheduled Commercial Bank of India. No other mode of payment shall be accepted. Any firm recognized by Department of Industrial Policy and Promotion (DIPP) as 'Startups' shall be exempted from payment of Bid Security. Labour Cooperative Societies shall submit only 50% of above Bid Security.

• In case the date of closing mentioned in the NIT Header of e- tender document is declared a holiday/bandh/strike etc. on any account, the date of closing tender online will not be changed as the application in the website of IREPS does not permit submission of any offer after closing date and time of the tender.

• For more details, the Instructions to the Tenderers vide Chapter- 2 and all other details available in the Annexed Document to the E-Tender Document may be referred to.

• The tender shall be finalised based on submitted documents & no post tender correspondence shall be entertained. However, if any clarification is required by the Railway, the same will be sought from the tenderer which need to be provided by tenderer(s) within stipulated time failing which his/their offer(s)shall be dealt based on available information with Railways interpretation only.

• Tender No. eT-CRW-MCS-EL-11-2026 is being processed on Single tender with OEM(M/s Cummins India Limited), hence no Technical Eligibility criteria & Financial Eligibility criteria is required for this Tender (Vide Railway Board Letter No.2019/Elect(G)/165/1,dtd.22.04.2020 The Technical Eligibility criteria & Financial Eligibility criteria as contained in GCC 2022 or any amendment thereafter for works contract may be dispensed with in cases of bidders, who are either OEMs or sources approved by RDSO for related works contracts).

• Any corrections, Erasures and / or alterations in documents made by tenderer(s) in his/their entries must be attested by him / them. Otherwise, his/their offer are liable to be rejected.

• Any deviations made by tenderer(s) in his/their offer is lead to be summarily rejection of offer.

Special Conditions

• Damage to Railway Property or Private Life and Property:-The Contractor shall be responsible for all risk to the work and for trespass and shall make good at his own expense all loss or damage whether to the works themselves or to any other property of the Railway or the lives, persons or property of others from whatsoever cause in connection with the works until they are taken over by the Railway, although all reasonable and proper precautions may have been taken by the Contractor. In case the Railway shall be called upon to make good any costs, loss or damages, or to pay any compensation, including that payable under the provisions of the Workmen's Compensation Act or any statutory amendments thereof to any person or persons sustaining damages as aforesaid by reason of any act, or any negligence or omissions on the part of the Contractor; the amount of any costs or charges including costs and charges in connection with legal proceedings, which the Railway may incur in reference thereto, shall be charged to the Contractor. The Railway shall have the power and right to pay or to defend or compromise any claim of threatened legal proceedings or in anticipation of legal proceedings being instituted consequent on the action or default of the Contractor, to take such steps as may be considered necessary or desirable to ward off or mitigate the effect of such proceedings, charging to Contractor, as aforesaid; any sum or sums of money which may be paid and any expenses whether for reinstatement or otherwise which may be incurred and the propriety of any such payment, defence or compromise, and the incurring of any such expenses shall not be called in question by the Contractor.
