  • A.Mandatory Terms and conditions:
  • 1.Performance Warranty Bond:- To cover the Buyer’s interest during warranty period, warranty Bond for an amount e qual to 5 percent of the contract/supply order value (inclusive of taxes and duties) wo uld be obtained from the seller prior to return of performance security bond. Warrant y bond should remain valid for a period of sixty days beyond the date of completion o f all warranty obligations. Warranty bond would be returned to the Seller on Successf ul completion of warranty obligations, under the contract. The specimen of bond can be provided on request. Your bill will not be processed until you submit the BG with d ate of validity.
  • i.Indigenous Bidder: They may be accepted in the form of Insurance Surety Bond s, Account Payee Demand Draft, and Fixed Deposit Receipt from a commercial bank (including e-Bank Guarantee) from any Indian Public or Private Scheduled Commercia l Bank (as notified by RBI) or online payment in an acceptable form. ii.Every Page of Technical Specification should be duly and sealed by appropriate A uthority of the Bidder iii)) Every Page of Bid Document must be duly signed and sealed by appropriate Authority of Bidder.
  • b.General terms and conditions:
  • 1.Kindly provide the following documents as given below

  • 2.Liquidated Damages:
  • a)In case the execution of the contract is delayed beyond the contracted period and the Buyer grants the Extension of delivery period, with or without liquidated damage s, the Seller must get the Bond revalidated. The specimen of bond can be provided o n request. In the event of the Seller’s failure to submit the Performance Security Bon d within 30 days of receipt of Supply Order / signing of the Contract or the agreed sc hedule, the buyer may deduct from the seller, a sum of 0.5% of the value of the BG f or every week or part thereof of delay as LD. Beyond 60 days, the procuring entity sh all cancel the Supply Order/Contract and impose a penalty equivalent to an EMD amo unt as mentioned in the RFP or the Supplier/bidder would be debarred from participat ing in any procurement / bidding process of DD (R&D) for a period not exceeding 02 years.
  • b)Compensation of loss on account of late delivery, where loss is pre- estimated and mutually agreed to, is termed as LD. Law allows recover y of pre-estimated loss, provided such a term is included in the contract. For imposition of LD, there is no need to establish actual loss due to late supply. The legal position with regard to claim for LD is as follows: 1) Whatever the quantum of the loss sustained, the claim cannot exce ed the sum stipulated in the contract. 2) Only reasonable sum can be calculated as damages, which in a give n situation may be less than the sum Stipulated. 3) What is a reasonable sum would depend on facts. 4) Court may proceed on the assumption that the sum stipulated reflec ts the genuine pre-estimates of the parties as to the probable loss and such clause is intended to dispense with proof thereof. 5) The distinction between penalty and LD has been abolished by the Indian Contract Act and in every case, the Court is not bound to award more than ‘ reasonable compensation’ not exceeding the amount so named. The Buyer may deduct from the Seller, as agreed, liquidated damages at the rate of 0. 5% per week or part thereof, of the basic cost of the delayed stores which t he seller has failed to deliver within the period agreed for delivery in the co ntract. LD can also be levied on the Seller on the basic cost of the stores su pplied partially within the scope of the order/ contract that could not be pu t to use due to late delivery of the remaining stores. The maximum quantu m of LD would be 10% of the total order value.
  • 3.MII CONTENT CERTIFICATE: Firms must submit the MII Content as per format attached in Buyer Added Spe cific Terms & Condition.
  • 4.Epbg / PSB - Performance Security Bond should be for an amount equal to 5% of the contract va lue (inclusive of taxes and duties) in favour of the Director CHESS, Hyderabad for saf eguarding the Buyer’s interest in all respects during the currency of the contract. In c ase the execution of the contract is delayed beyond the contracted period and the B uyer grants the extension of delivery period, with or without liquidated damages, the Seller must get the Bond revalidated., The specimen of bond can be provided on requ est. In the event of the Seller’s failure to submit the Performance Security Bond withi n 30 days of receipt of Supply Order / signing of the Contract or the agreed schedule, the buyer may deduct from the seller, a sum of 0.5% of the value of the security dep osit amount for every week or part thereof of delay as LD. Beyond 60 days, the procu ring entity shall cancel the Supply Order/Contract and impose a penalty equivalent to an EMD amount as mentioned in the RFP or the supplier/bidder would be debarred fr om participating in any procurement / bidding process of DD(R&D) for a period not e xceeding 02 years.
  • 5.Additional Terms & Conditions:
  • a)The firm has to fill the index page (page attached) along with the page no. in a sequence at the time of uploading the documents in tendering.
  • b)The firm has to send a sheet (Page attached) & any changes from the aforem entioned format shall be liable for cancellation of the bid.
  • c)Firms are requested to submit bid security declaration form in lieu o f EMD Certificate (those who are registered with Defence Organization and PSUs). d)Those Firms who were MSE (Micro and small enterprises) as register ed in UDYAM are only exempted for EMD.
  • e.Termination of Contract: "The decision of Termination of Contract/Closur e of the Supply Order would be taken by the approval of Competent Author ity." .

Warranty period of the supplied products shall be 1 years from the date of final acceptance of goods or after completion of installation, commissioning & testing of goods (if included in the scope of supply), at consignee location. OEM Warranty certificates must be submitted by Successful Bidder at the time of delivery of Goods. The seller should guarantee the rectification of goods in case of any break down during the guarantee period. Seller should have well established Installation, Commissioning, Training, Troubleshooting and Maintenance Service group in INDIA for attending the after sales service. Details of Service Centres near consignee destinations are to be uploaded along with the bid.
