OPTION CLAUSE 50% : The buyer can increase or decrease the contract quantity or contract duration up to 50 percent at the time of issue of the contract. However, once the contract is issued, the contract quantity or contract duration can only be increased up to 50 percent. Bidders are bound to accept the revised quantity or duration. For lumpsum-based service contracts, the buyer may increase the scope of work and contract value up to 50 percent with the consent of the service provider

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Registration / Empanelment Requirement: Contract shall be awarded to only such sellers , who are registered / empanelled / approved / enlisted with THDC INDIA LTD. for the required goods / service category on the date of bid opening. Prospective bidders (if not already registered), are advised to get themselves registered with the said registration authority before bid opening date. (It is certified that the registration is granted by the registering agency as per Rule 150 of GFR following a fair, transparent and reasonable procedure.)

Bidders can also submit the EMD with Account Payee Demand Draft in favour of THDC INDIA LTD. payable at RISHIKESH . Bidder has to upload scanned copy / proof of the DD along with bid and has to ensure delivery of hardcopy to the Buyer within 5 days of Bid End date / Bid Opening date.

Bidders can also submit the EMD with Fixed Deposit Receipt made out or pledged in the name of A/C THDC INDIA LTD. . The bank should certify on it that the deposit can be withdrawn only on the demand or with the sanction of the pledgee. For release of EMD, the FDR will be released in the favour of the bidder by the Buyer after making endorsement on the back of the FDR duly signed and stamped along with covering letter. Buyer Added text based ATC clauses SCOPE OF WORKs

• 1.Periodic comprehensive Checking & cleaning of 15 Nos Cassette Air conditioner units along with 03 Nos indoo r split unit & 04 Nos Microprocessor-Controlled cooled package unit with 16.5 TR three Circuit With three nos outdoor unit (attached BoQ) once in a quarterly & Unlimited emergency/Breakdown visits as when required.
• 2.The corrective and preventive maintenance report, in original, shall be submitted by the maintenance agency on a quarterly basis, duly signed by the user and Services (Electrical) Department, THDCIL, Rishikesh.
• 3.Supply and fixing all spares and consumables required for maintenance and testing, complete in all respects, shall be in the scope of the agency and payment of all spare parts shall be borne by the agency.
• 4.Attending Breakdown calls and fault diagnosis shall be attended within 03 days after receipt/registration of th e complaint; otherwise, a penalty @Rs.1000 per day against delay shall be deducted from RA bill of the maint enance agency.
• 5.The maintenance agency shall furnish the contact telephone number, mobile number, fax number, e-mail, etc ., on which complaints shall be lodged. An unlimited number of calls shall be attended in case of any breakdo wn. In the event of the maintenance agency failing to set right the air-conditioner within one week from the d ate of registration of complaint, THDC shall be free to get the work executed from any suitable source at the r isk and cost of the maintenance agency.
• 6.THDCIL shall have the right to terminate the contract by giving 30 days’ notice to the maintenance agency.
• 7.The normal working hours of THDCIL offices at Rishikesh & EC road office Dehradun are 9:00 AM to 6:00 PM, with a flexible half hour lunch break from 1:00 PM to 2:00 PM. Saturdays and Sundays are holidays, in additio n to national holidays, however, in case of breakdown, execution of work will have to be done.
• 8.The validity of the work/contract shall remain in force for a period of six (06) months from the date of comme ncement/award of work, unless otherwise extended or terminated earlier by THDCIL in accordance with the a pplicable terms and conditions.
• 9.Contractor will be fully responsible for any accident or mishaps involving workers engaged by the Contractor, and the Contractor would pay claims made on this part. The Contractor shall indemnify the THDC India Limite d from any claims arising out of accidents, disabilities of any nature or death arising out of provisions under la w, or any other nature in respect of all workers engaged by the contractor. Payment Terms: -
• 10.Payment shall be made in two instalments, subject to satisfactory performance and submission of requisite r eports duly signed by the user and the authorized representative of the Services (Electrical) Department THD CIL. The first instalment, equivalent to 50% of the contract value, shall be payable on a quarterly basis, submi ssion of invoice with supporting documents and the balance 50% shall be payable after successful completion of the work/contract.
• 11.Performance Security @ 5% of the total award value shall be deposited by the maintenance agency within 15 days of award of the contract to THDCIL, Rishikesh. The same shall be refunded after successful completion o f the contract.
