OPTION CLAUSE 25% : The buyer can increase or decrease the contract quantity or contract duration up to 25 percent at the time of issue of the contract. However, once the contract is issued, the contract quantity or contract duration can only be increased up to 25 percent. Bidders are bound to accept the revised quantity or duration. For lumpsum-based service contracts, the buyer may increase the scope of work and contract value up to 25 percent with the consent of the service provider

Bidders can also submit the EMD with Account Payee Demand Draft in favour of Sr. DFM/NGP/CR payable at NAGPUR . Bidder has to upload scanned copy / proof of the DD along with bid and has to ensure delivery of hardcopy to the Buyer within 5 days of Bid End date / Bid Opening date.

Buyer Added text based ATC clauses 1.Bidders are hereby advised to carefully read the Tender Document, including the Special Terms & Condit ions of Contract before submitting their offer. Conditional offers shall not be entertained and will be summ arily rejected. Bidder shall submit the documents as demanded under bid evaluation criteria along with the bid. In case the Net Current Assets (as seen from the Balance Sheets ) are negative, only the Banking refer ences will be considered. Otherwise, the aggregate of the Ne t Current Assets and submitted Banking references will be considered for working out the Liquidity . The banking reference should be from a Scheduled Bank in India and it should not be more than 3 mont hs old as on date of opening of bids.
• 2.All bidders must submit a valid GST Registration Certificate, clearly indicating the firm’s t ype of entity/composition along with details of all stakeholders and submit the necessary cr edentials mentioned in the bid form along with Annexure-V and V(A) to reference -Para 6.1 of ITT. Non-submiss ion of the requisite credentials as mentioned in the GeM Bid Document including minimum eligibility criteria, Work Done Certificates in the prescribed formats shal l lead to rejection of the bid. No re presentation in this regard shall be entertained under an y circumstances.
• 3.Bidders must submit only relevant and limited documents, properly scanned and legible, strictly as required under the stated eligibility criteria. Submission of any irrelevant or unrel ated documents that do not pertain to the specified eligibility criteria may result in rejectio n of the bid. No claim s or representations from the bidder shall be entertained in such case

• 4.Railway reserves the right to verify all statements information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the railway, mak e available all such information, evidence and documents as may be necessary for such ve rification.
• 5.Action will be taken as per Railway board instructions on the bidder, in case of any incorr ect infor mation / documents submitted in support of credential. It may result the contract s hall be terminated, Bid security / Earnest Money Deposit / Performance Guarantee / Securit y Deposit of contract will be forfeited by Railway and agency will be barred for doing busin ess on entire Indian Railways for 5 (Five) years.
• 6.Railway reserves the right to validate authenticity of any document submitted by the bid der from its issuing authority. • 7.Contract terms and conditions shall be governed by “IRS conditions” issued by Ministry o f Railways.
• 8.Minimum 7 days’ time will be given from the date of placement of contract for starting the services. However, depending on the Railways Requirement, Railways reserves the righ t to “extend the time”/ “give more than 7 days’ time” for starting the services in certain cas es. Further, Railway reserves the right to terminate the contract in-case the firm fails to start the services within the give n time period. Bidders not willing to accept this condition must not participate in this tender. Bids if submitted shall be considered as deemed accept ance of this condition. Any deviation regarding this or remark’s anywhere including in uploa ded document seeking more than 7 days’ time for star ting the services will not be accepte d or considered while consideration of the offer. The purchase may, at his discretion ignore any such deviation, if quoted, while is suing the contract. No further claim by the bidder sh all be admissible in such cases.
