Bidders can also submit the EMD with Account Payee Demand Draft in favour of PFA/NWR payable at Jaipur . Bidder has to upload scanned copy / proof of the DD along with bid and has to ensure delivery of hardcopy to the Buyer within 5 days of Bid End date / Bid Opening date.

Bidders can also submit the EMD with Fixed Deposit Receipt made out or pledged in the name of A/C PFA/Jaipur . The bank should certify on it that the deposit can be withdrawn only on the demand or with the sanction of the pledgee. For release of EMD, the FDR will be released in the favour of the bidder by the Buyer after making endorsement on the back of the FDR duly signed and stamped along with covering letter. Successful Bidder can submit the Performance Security in the form of Account Payee Demand Draft also (besides PBG which is allowed as per GeM GTC). DD should be made in favour of PFA/Jaipur payable at jaipur . After award of contract, Successful Bidder can upload scanned copy of the DD in place of PBG and has to ensure delivery of hard copy to the original DD to the Buyer within 15 days of award of contract.

Buyer Added text based ATC clauses

• (1)Bidder will submit bid specific authorization, otherwise bid offer will not be consid ered.
• (2)Past Performance: The Bidder or its OEM {themselves or through re-seller(s)} sho uld have supplied same or similar Category Products (item having similar or higher s pecifications) for 80% of bid quantity of offered make, in at least one of the last three Financial years before the bid opening date to any Central / State Govt Organization / PSU. Copies of relevant contracts (proving supply of cumulative order quantity in any one financial year) to be submitted along with bid in support of quantity supplied in t he relevant Financial year.
• (3)Past performance: Copies of relevant proof of supply like CRAC, Receipt Note, Per formance certificate etc. must be submitted along with bid in support of quantity sup plied. Only contract copy shall not be considered as proof of successful supply.
• (4)No exemption to MSME or startup for performance criteria is allowed in this case, hence all the firms are advised to attach performance documents.
• (5)If MSME firm offers product of other manufacturer than they will be treated as tra der and MSE benefits shall not be available to them.
• (6). similar item/category definition to evaluate the performance of the firm is item h aving similar or higher specifications.
• (7)Inspection by RITES
• (8). Past performance shall be considered up to the last three financial year and current financial year up t o date of tender/ bid opening as per GeM conditions
• (9)During evaluation and comparison of bids, the purchaser may, at his discretion, a sk the bidder for clarifications on the bid. The request for clarification shall be given a sking the bidder to respond by a specified period. If the bidder does not comply or re spond by the date, his tender will be liable to be rejected. Depending on the outcome , such tenders are to be ignored or considered further. No change in prices or sub sta nce of the bid shall be sought, offered or permitted. No post bid clarification at the ini tiative of the bidder shall be entertained. The shortfall information /documents shall be submitted only in case of historical documents, which pre-existed at the time of th e tender opening and which have not undergone change, since then. So far as the su bmission of documents is concerned with regard to qualification criteria, after submis sion of the tender, only related shortfall documents shall be submitted for. For exam ple, if the bidder has submitted a supply order without its completion / performance c ertificate, the certificate can be asked for and considered. However, no new supply or der should be asked for so as to qualify the bidder.
• (10)Picture of the item available on GeM will not be considered part of offer/contract. Offer will be evaluat ed based in technical parameters and Contract will be based on same technical parameters.
• (11)The delivery period includes supply, installation and commissioning of the item. .
