Buyer Added text based ATC clauses 1.0) Procurement shall be made from OEM or their authorized dealer. Authorized dealer must upload bid s pecific authorization from OEM only. Sub-dealership/sub-authorization shall not be considered. Offer witho ut valid authorization shall be summarily rejected without any back reference. 2.0) Bidder must clearly mention whether bidder is offering own product or product of other OEM. If bidder has participated in bid by selecting product of other OEM, it shall be assumed that bidder is offering produ ct of other OEM and in this case, bidder must submit valid authorization along with bid. 3.0) Bidder must upload compliance/para-wise compliance to specification attached in buyer added bid sp ecific ATC, failing which offer shall be summarily rejected without any back reference. 4.0) Detailed original technical brochure containing technical specifications in support of quoted make/mo del of item(s) must be uploaded along with offer. 5.0) Technical evaluation of offer shall be strictly based on specification attached in ATC. 6.0) Bidder to declare local content of offered product 7.0) Only those documents which were uploaded by bidders/sellers along with their original bid shall be co nsidered for technical evaluation. Any documents submitted after the date of closing shall not be consider ed for evaluation. Further, any document uploaded during representation stages shall also not be consider ed for evaluation. 8.0) Item supplied against contract (placed against this bid) shall be accepted only if item is meeting all te chnical specification uploaded in ATC. 9.0) Bidder to offer CMC Charges along with offer and agree to enter for CMC after expiry of warranty peri od. 10.0) Compliance of Restrictions under Rule 144 (xi) of GFR 2017 as per DOE Order. Bidder must submit following certificate for above Rule 144(xi) of GFR 2017. Certificate for Compliance of OM of DoE (Ministry o f Finance) dated 23.07.2020: "I have read the clause regarding restrictions on procurement from a bidder o f a country which shares a land border with India; I certify that the bidder is not from such a country or, if f rom such a country, has been registered with the Competent Authority. I hereby certify that the bidder fulfi ls all requirements in this regard and is eligible to be considered. [Where applicable, evidence of valid regi stration by the Competent Authority shall be attached.]" If such certificate given by a bidder whose bid is a ccepted is found to be false, this would be a ground for immediate termination and further legal action in a ccordance with law. Non-submission of this Certificate shall lead to summarily rejection of offer Note:- Documents asked in the bid must be submitted by bidder along with offer, failing which offer shall be summarily rejected without any back reference. 11.0) Bidder must submit all documents mentioned in Bid ATC documents. In the absence of all certificates, offer will be summarily rejected without any back reference. .
