OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Buyer Added text based ATC clauses [A] Bidders must attach following documents as applicable (in addition to any other document(s) required as per specification & bid), failing which offer shall be summarily rejected, without any back reference [1] Documents in support of successful supply performance from Central / State Govt Organization [2] Documents in support of MSE registration. (for claiming MSE benefits) [3] Documents in support of Make in India policy i.e. % of local content in the offered product purchase pre ference. [4] In case of authorized dealer, firm must attach bid specific authorization from OEM. [5] All essential documents related to medical equipment to be disclosed at the time of technical suitability . [B] INSPECTION CLAUSE: Consignee Inspection and Evidence based Demo to be provided before technical suitability. [C] Non submission of document(s) shall be treated as non compliance to the specification, eligibility and t erms & conditions of bid, Offer of such bidders shall be rejected without any back reference. [D] Bidders to take note of GeM GTC one bid per bidder Para 29 policy. In a tender, either the authorized a gent/dealer on behalf of the Principal/OEM or the Principal/OEM itself can bid but both can not bid simultan eously for the same item in the same tender. [E]. If an authorized agent/ dealer submits bid on behalf of the Principal/OEM, the same agent/ dealer shall not submit a bid on behalf of another Principal/OEM in same tender for the same item/product. Bidders are advised to take note of the “One Bid per Bidder” policy stipulated under P ara 29 of the GeM GTC. Accordingly:

  • (i). For the same item/product in a BID/tender, either the Principal/OEM itself or its aut horized agent/dealer may submit a bid. Both cannot participate simultaneously.
  • (ii). An authorized agent/dealer submitting a bid on behalf of a Principal/OEM shall not submit another bid on behalf of any other Principal/OEM for the same item/product in t he same tender.
  • (iii). Multiple offers from the same OEM through different bidders are not permitted (in terms of NR vigilance advise system improvement letter no. E-S/Vig/SI/GeM GTC Compli ance/2025 dated 03.07.2025) The OEM is advised to issue tender-specific authorization to only one firm for the particular item/product.
  • (iv). In case multiple bidders submit offers representing the same OEM, or otherwise vi olate the above provisions, the offers of all such bidders shall be disqualified in accord ance with Para 29 of the GeM GTC and as per NR policy. [F] Warranty Clause : [i] 60 months from the date of commissioning. [G] GSTN No. 07AAAGM0289C1ZL [H]. COMPREHENSIVE ANNUAL MAINTENANCE CONTRACT (CMC) CLAUSE:
  • i.The Complete Equipment/ M&P shall be covered by CMC for a period of Two Years after expiry of wa rranty period for the proper upkeep and maintenance of the quoted Equipment. Tenderers along with t heir offers shall also quote CMC charges on a yearly basis for period of Two years for the purpose of future reference/ guidance of the consignee. The quoted CMC charges shall include the following:
  • i.Cost of preventive maintenance visits during the year (Two visits in each year. Detailed itemized breaku p of jobs to be done in each visit shall be furnished in the offer). ii. Cost of all spares required for preventive maintenance. iii. Cost of breakdown Maintenance visits during the year. iv. Cost of all spares required for Breakdown Maintenance. v. Boarding, lodging, transportation, medical fa cilities and all other incidental expenses. vi. All duties, taxes and levies applicable. However, the cost of co nsumables required for day-to-d ay operation would not be included in the scope of CMC. The CMC prices f or each year will be firm. The CMC charges shall be separately payable in Indian Rupees only. Railways re serve the right for entering or not entering into Comprehensive Annual Maintenance Contract (CMC) on the basis of rates quoted by the Contractor in their tender against CMC charges. In case of non-compliance, th e offer will be summarily rejected. [I] Commissioning & Proving Test
  • i.The contractor shall arrange commissioning of the equipment at the consignee premises. The tender ers shall carry out necessary proving test to demonstrate the performance of equipment, after its su ccessful commissioning to the entire satisfaction of the consignee. ii. The Contractor or his agents shall commission the machine within stipulated time as shown in the contr act. This time frame will be applicable from the date of intimation from the consignee in respect of readine ss of the machine for commissioning in cases where the machine is to be installed by the consignee. The ti me schedule includes the time for installation in cases where installation is also to be undertaken by the c ontractor. iii. The time allowed for commissioning of machine shall be deemed to be the essence of the contrac
  • t.In case of delay in commissioning of the machine on the part of the contractor, the purchaser shall be en titled to recover and the contractor shall be liable to pay a penalty at the rate of 2% of t he price of the M& P for each and every month or part thereof for which commissioning is delayed, provided always that the e ntire amount of penalty to be paid under the provision of this clause shall not exceed 10% of the total cont ract value. Failure to install / commission the machine within stipulated time after intimation from the cons ignee will be taken as breach of contract and purchase r will be at liberty to forfeit the Security Money furn ished by the supplier without any prejudice to their rights under the contract. iv. Continuance of commissioning work after expiry of stipulated ti me will also constitute a default for the purpose of the Clause above. The decision of the Purchase r on whether the delay in commissioning has ta ke n place for reason(s) attributed to the contractor shall be final and binding. [J] Training- The contractor during commissioning of the equipment will also train Railway staff in operat ion and maintenance of equipment supplied. [K] Maintenance Manual & Spare Parts- Contractor is required to supply 2 copies of operation and mainten ance manual and lists of Spare parts along with the equipment .
