  • 4.Terms and Conditions stipulated in ATC will supersede those in GeM GTC and STC in case of any conflicti ng provisions.
  • 5.Bidders are required to submit the documents as mentioned in the check list appended below while sub mitting their bid and submit the duly filled check list online on GeM portal in ‘Additional ATC documents’.
  • 6.Instructions for filling the Price Bid: As per “Tender Document”. Bidders to quote the total amount inclu sive of GST for all BOQ items at one place.
  • 7.Eligibility for Participation: As per NIT All participating vendors in this tender shall submit their enlistment cert ificate issued to them with mention of AATO & EC values for the item cat egory (CEG) or submit any other proof of their enlistment in which AATO & EC along with CEG is mentioned.
  • 8.Bid Security: As per NIT
  • 9.MSEs seeking exemption for EMD and Purchase Preference shall selec t appropriate option on GeM portal (separately for each i.e. EMD & pur chase preference) and should enclose copy of UDYAM registration cer tificate, failing which they run the risk of their bid being passed over a s ineligible for the benefits applicable to MSEs.
  • 10.EMD exemption: Micro and Small Enterprises (MSEs) having UDYAM Registration, for goods produced and services rendered, shall be exempted from paying Earnest Money Deposit. Such registered bidders will h ave to submit UDYAM Registration Certificate, as proof of being MSE on GeM Portal.
  • 11.To avail MSE benefit in respect of EMD exemption and purchase preference, Bidder should be a manufact urer/service provider of offered product/service. Traders are excluded from purview of MSE benefit.
  • 12.EMD exemptions as per GeM GTC shall be applicable.
  • 13.Instructions for filling in the Price Bid:
  • (1)The Bidder is required to quote Lumpsum Price (Including GST) in GeM Bid for all the BOQ items. Bidders are requested to kindly go through the Schedule of Quantities and Quote the entire package cost inclusive of GST.
  • (2)The Premium (%) or Discount (%) shall be derived considering total quoted am ount Inclusive of GST with respect to NTPC's Estimate, Incl GST. This Premium (%) or Discount (%) shall be loaded on each item to calculate individual Item rates, In cl. GST
  • (3)The Break-Up of applicable GST is required to be quoted in Attachment-14 as per the provisions of the bidding documents.
  • (4)Bidders are requested to must check the total package cost against the estim ated cost of NIT before submission of GEM Bid online to avoid any confusion later. After opening of technical Bids, Bidders are not allowed to modify/change the rate s/amount whatsoever.
  • (5)Other terms and Conditions shall be as GCC & SCC of Civil. In case after price bid opening Bidder claims that the rates were quoted erroneously/inadvertently, u nintentionally, accidentally the Bidder shall be liable for action as per terms and c onditions of NIT.
  • 15.Evaluation and Splitting criteria: As per Scope of W ork 16.0 Bidder to upload Enlistment certificate, Attachment 14 -Declaration of GST, Attachment -17 Compliance to “Conflict of Interest” provisions, Att achment 15- UNDERTAKING FOR COMPLIANCE OF IMPORTANT CONDITIO NS OF TENDER BY BIDDER, MSE certificate (if applicable), Power of Attor ney, Declaration Attachment-3L (i) , Site Visit Certificate in Additional ATC Documents.
  • 17.Scanned copy of the EMD e-BG/ISB shall be uploaded by Seller in the online bid and hard cop y of ISB will have to be submitted directly to the Buyer within 5 working days of bid opening, fail ing which the bid may be treated as incomplete & may lead to rejection of the bid by buyer with out making any reference to the seller. Bidders are requested to refer details regarding the same in BDS of tender documents.
  • 18.In case of award Bidder must submit the CPG or initial CPG (ICPG) or additional bank guarantee within a period of 15 days from the date of issue of LOA/PO/LOI.
  • 19.Bidders may please note that GeM is showing the IP addresses used by the Buyer and the Bidder(s) /Selle r(s). The received bids having matching/common IP address with either Bidder(s)/Seller(s) or Buyer, shall be outrightly rejected & shall not be considered for further evaluation All the terms & conditions shall be as per NTPC mentioned in ATC. If any contradic tion arises between ATC and GeM terms & conditions, Terms & conditions mentio ned in ATC shall prevail. Explanatory Notes for calculation of local content as per Revised Public Procurement (Preferenc e to Make in India) Order 2017, dated 19.07.2024 issued by DPIIT
  • (a)Imported Items sourced Locally from resellers/distributors shall be excluded from calculation of L ocal content.
  • (b)The License fees/Royalties paid/technical charges paid out of India shall be excluded from Local c ontent calculation.
  • (c)Procurement/Supply of repackaged/refurbished/rebranded imported products as understood com monly shall be treated as reselling of imported products and shall be excluded from calculation o f Local content. The definition of repackaged/refurbished/rebranded imported products is as follows: ‘Refurbishing’ means repair or reconditioning of an imported product does not amount to manuf acture because no new goods come into existence. ‘Repackaging’ means repacking of imported goods from bulk pack to smaller packs would not ord inarily amount to manufacture of a new Item. ‘Rebranding’ means relabelling or renaming or change in symbol or logo/makes or corporate im age of a company/organization/firm for an imported product would amount to rebranding.
  • (d)To ensure that imported items sourced locally from resellers/distributors are excluded from calcu lation of local content, bidder to furnish the cost of such locally sourced imported items (Inclusive of taxes) along with break-up on license/royalties paid/technical expertise cost etc. sourced from outside India. For items sold by bidder as reseller, OEM certificate for country of origin to be sub mitted.
  • (e)For contracts involving supply of multiple items and where evaluation is done on overall basis, w eighted average of all items to be taken while calculating the local content. 1.2 We confirm that we have read and understood the explanatory notes for calculation of local cont ent given above and our local content calculation complies with the same. 1.3 # (Applicable/Not Applicable) We understand that Buyer/Employer may seek any relevant docu ment as a proof of Manufacturing/Local value Addition at any time during the bid evaluation, incl uding certificate from the statutory auditor or cost auditor (in the case the bidder is a company) or from a practicing cost accountant or practicing chartered accountant (in respect of bidders oth er than companies) certifying the percentage of local content and place of value addition. In addi tion, the aforesaid certificate from the statutory auditor/cost auditor/ cost accountant/ chartered accountant may also be sought after placement of order. Or ## (Applicable/Not Applicable) We undertake that a certificate from the statutory auditor or cost auditor (in the case the bidder is a company) or from a practicing cost accountant or practicing c hartered accountant (in respect of bidders other than companies) certifying the percentage of lo cal content shall be submitted by us at the time of execution of the project, or where it is not po ssible to provide certification at the time of execution of project, prior to submission of our last b ill for payment.# # (This para is applicable in all packages with estimated value (excluding taxes & duties) exceeding INR10 Crores.) 2.0 We further confirm that we are presently not debarred / banned by any other procuring entity for violation of ‘Public Procurement (Preference to Make in India), Order 2017’ (PPP-MII Order) dated 15.06.2 017 and its subsequent revisions / amendments issued by Department for Promotion of Industry and Inte rnal trade (DPIIT). 3.0 We agree to furnish any information as a proof of the above to your satisfaction as and when required. Note: 1) In case a Bidder has been banned/debarred by any other procuring entity for violation of ‘Public Pro curement (Preference to Make In India), Order 2017’ (PPP-MII Order) dated 15.06.2017 and its subsequent re visions / amendments issued by Department of Industrial Policy and Promotion (DIPP), the same may be decl ared by Bidder by striking off para above and declaring the details of banning using additional sheets. 2) Bidder may also enclose additional sheets in similar format (if required), for providing details pertaining to local value addition. Note: In procurement of goods, the aforesaid declaration regarding local content shall be filled and signed by Manufacturer in case bidder is an authorized dealer, and the same may be enclosed as additional sheet with t he Bid Form. 3) False declarations will be dealt in line with the Fraud Prevention Policy and Policy & Procedure for Debarm ent of Business Dealings.
