Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Buyer Added text based ATC clauses 1.0 MSE & Start-up Exemption for Turnover: Yes (i.e For MSE / Start-up bidders, relaxation of 20% on financ ial criteria of MAAT (bidder turnover) is considered i.e. an MSE / Start-up bidder meeting 80% of MAAT (bid der turnover) requirement for this package shall be considered qualified on this aspect). 2.0 MSE & Start-up Exemption of Experience Criteria: Yes (i.e For MSE / Start-up bidders, relaxation of 20% on experience criteria (financially) is considered i.e. an MSE / Start-up bidder meeting 80% of experience cr iteria (financially) requirement for this package shall be considered qualified on this aspect). 3.0 GRID-INDIA reserves the right to relax/waive-off minor deviations with respect to QR as stipulated in th e bid document, the decision of GRID-INDIA in this regard shall be final & binding on bidders. 4.0 Bidders need to submit the documents uploaded in 'Buyer uploaded ATC document' clause of bid docu ment. 5.0 Quantity Variation: The Purchaser reserves the right to increase or decrease the quantities of items un der the contract but without any change in unit price or other terms and conditions. Such variation shall n ot be subjected to any limitations for the individual items but the total variation in all such items under the contract shall be limited to +/- 25 % (plus/minus twenty-five percent) of the total contract price. Bidders ar e bound to accept the orders accordingly. Additional licenses shall be procured only for the remaining cont ract period, as per requirement and payment shall be made on pro-rata basis. 6.0 Blacklist Declaration: The Bidder, including its Original Equipment Manufacturer (OEM), shall not have been blacklisted/debarred by any Central Government, State Government, Public Sector Undertaking (PSU ), or any other Government organization at any point in time. The Bidder is required to submit a duly notar ized Undertaking/Declaration Certificate affirming the above condition. The undertaking must clearly state that neither the Bidder nor the OEM has been blacklisted or debarred by any such authority. Failure to sub mit this undertaking, or submission of false information, shall render the bid liable for rejection and may le ad to further action as deemed appropriate by NERLDC. 7.0 Regional Support Centre Requirement: The Original Equipment Manufacturer (OEM) shall have an oper ational Regional Support Centre located in the region where the proposed solution is to be deployed. The s aid Support Centre must possess a valid Goods and Services Tax (GST) registration for that respective regi on.The Bidder shall submit a Undertaking confirming the existence of such Regional Support Centre(s). Th e undertaking must clearly include:Complete postal address of the Support Centre(s), Contact details (pho ne number, email, etc.), Proof/details of valid GST registration for the respective region. Non-submission of the undertaking or furnishing incorrect/incomplete information may result in rejection of the bid by NERLD

• C.8.0 ISO Certification Requirement: The Original Equipment Manufacturer (OEM) must possess valid and cur rent certifications for the following ISO/IEC 27001 (Information Security Management) and ISO 9001 (Qualit y Management Systems).The Bidder shall submit copies of the relevant certificates issued by accredited c ertification bodies, clearly indicating their validity period. All certifications must be valid as on the date of bid submission. Non-submission of the above certifications or submission of expired/invalid certificates sha ll render the bid liable for rejection. 9.0 OEM Authorization Form: The Bidder must be either the Original Equipment Manufacturer (OEM) or an authorized reseller having a direct purchase and support agreement with the OEM for the products quoted in this tender. In case the Bidder is not the OEM, a valid authorization letter from the OEM, issued by its co mpetent authority, must be submitted along with the bid. 10.0 Cyber Security: The Bidder shall ensure that the security of NERLDC’s IT infrastructure is not compro mised and shall be responsible for maintaining robust cyber security throughout the contract period. The B idder must promptly act on threat intelligence, advisories, and inputs received from authenticated sources to continuously enhance the cyber security posture of NERLDC. A formal declaration confirming complianc e with these requirements shall be submitted by the Bidder. 11.0 Technical and Requirement Compliance : The Bidder shall submit a duly signed Technical Compliance Statement against the Technical Specifications specified by NERLDC. The Bidder shall indicate compliance with each of the specified requirements on a point-by-point basis. Any deviation from the specified require ments shall be clearly identified and suitably explained by the Bidder in the Compliance Statement. The Bi dder shall also submit a duly signed copy of the Statement of Requirements document, confirming complia nce with the all the requirements specified therein by NERLDC. 12.0 Escalation Matrix and Support Structure: The bidder shall submit, as part of the bid, a detailed escalation matrix for both the bidder and the OEM. The escalation matrix shall clearly indicate the contact details, roles/responsibilities, and escalation hierarchy for technical, service, and management personnel. The submitted matrix shall be used for coordination and issue resolution during the commissioning phase and shall be updated, if required, prior to commencement of commissioning activities. Submission of the e scalation matrix along with the bid is mandatory and shall form part of the bidder's scope of work. 13.0 OEM Experience Criteria: The OEM whose solution is proposed must have successfully supplied and e xecuted a minimum of three (3) EDR/XDR/MDR solution orders for any Central Government Ministry/Depart ment, State Government Department, Government of India organization, or PSU during the last three (3) y ears. The Bidder shall submit copies of Purchase Orders/Work Orders along with Execution/Implementation Certificates or other documentary evidence of successful completion. 14.0 OEM Experience in Endpoint/Cyber Security Solutions: The OEM shall have a minimum of ten(10) year s of experience in Endpoint Security and/or Cyber Security solutions. The bidder shall submit documentary evidence demonstrating that the OEM has been offering such products for at least 10 years and/or an OEM declaration letter on official letterhead confirming the same. 15.0 Bidder Experience in Endpoint/Cyber Security Solutions: The Bidder/vendor must have successfully su pplied and executed a minimum of one (01) EDR/XDR/MDR solution orders for any Central Government Min istry/Department, State Government Department, Government of India organization, or PSU during the last three (3) years. The Bidder shall submit copies of Purchase Orders/Work Orders along with Execution/Impl ementation Certificates or other documentary evidence of successful completion. 16.0 Government of India has notified several technical regulations inter alia including "Electronics and IT Goods (Requirements for Compulsory Registration) Order, 2021", "Mandatory Testing and Certification of T elecom Equipment (MTCTE)" and various other Quality Control Orders (QCOs) to ensure safety, security an d other public interest requirements. To ensure the same, Grid-India have the right to undertake any third- party testing and verification of the products at any stage of the procurement process/after completion of procurement. In case of non-compliance, the bidder may be terminated immediately or in case of successf ul bidder, the bidder may be blacklisted from future participations in Grid-India tenders. 17.0 In case of any overlap between the GeM terms & conditions and the terms of the Additional Scope of Work, then the terms of the Additional Scope of Work shall hold precedence. .

Installation, Commissioning, Testing, Configuration, Training (if any - which ever is applicable as per scope of supply) is to be carried out by OEM / OEM Certified resource or OEM authorised Reseller.
