Custom Bid For Services - UT Testing Of Pressure Vessels

• 1.The Seller shall not assign the Contract in whole or part without obtaining the prior written consent of buyer.
• 2.The Seller shall not sub-contract the Contract in whole or part to any entity without obtaining the prior written consent of buyer.
• 3.The Seller shall, notwithstanding the consent and assignment/sub-contract, remain jointly and severally liable and responsible to buyer together with the assignee/ sub-contractor, for and in respect of the due performance of the Contract and the Sellers obligations there under.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Buyer Added text based ATC clauses 1) Vendors to provide compliance of Tender document Annexure A with seal & sign and same to b e uploaded along with technical bid (Document details please refer Buyer added Bid specific ATC) 2) Tender is Two Bid system (Technical & Commercial Bid) Technical bid to mentioned only techni cal details. In technical bid commercial details nowhere should mentioned , if commercial details a re mentioned offers are liable for rejection. 3) While submitting Price offer in GEM , firm has to quote including GST and any other charges applicable that also considered to include along with Price. Apart from GEM no other Charges will be not payable. 4) Payment term:

• a)For MSE Vendor (Micro & Small)= 100% Payment -45 Days from date of receipt of material / co mpletion of Service at BEML , Bangalore subject to clearance of quality / BEML User department.
• b)For Non MSE Vendor- 100% Payment -60 days from date of receipt of material / Completion of Service at BEML Bangalore subject to clearance of quality / BEML User Department.
• c)As per GOI from April (01.04.2026) onwards all the payment will be process through TReaDs Pla tform (M1 Exchange / RXIL) for all MSME Vendors (Micro, Small & Medium). Vendors requested to r egister Treads Platform for processing Payment. If already registered please ignore. 5) In Case L1 / L2 vendor’s prices are same, Buyer Selection only is final preference for order plac ement 6) In the event of failure to deliver or dispatch the stores (equipment) within the stipulated date/pe riod in a cordance with the specifications mentioned in the Purchase order and in the event of bre ach of any of the terms and conditions mentioned in the Purchase order, BEML reserves the right.
• i)To recover from the successful tenderer, a sum of 0.5 % (half percent) of the price of any stores which the successful tenderer has not been able to supply as aforesaid for each week or part of a week during which the delivery of such stores may be in arrears limited to 10%. Liquidated Damag e clause is applicable. ii) To purchase elsewhere, after due notice to the successful tenderer on the account and at the ris k of the defaulting supplier the stores (equipment) not supplied or others of similar description wit hout cancelling the supply order in respect of the consignment not yet due for supply.
