OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

• (a)Stores will have to be dispatched to Officer Commanding 1066 Field Workshop, ( G R E F ) , Penengla, Bojoghari, Gangtok, Sikkim, Pin- 737103.
• (b)GST will be paid as applicable and no any other charges will be paid. No transportati on charge applicable.
• (c)Payment will be done on receipt of stores in full depth and range in good condition within 30 days by the consignee.
• (d)Quotation is liable for cancellation without assigning reasons.
• (f)The items and quantities mentioned in the schedule are subject to variation and can be increased or decreased. In case of any dispute, the decision of the Officer Commanding, 1066 Field Workshop (GREF) will be final and binding in all respects.
• (g)Quotations violating all or any of the conditions given above are liable for rejection without assigning any reasons thereof.
• 2.Liquidated Damages Clause:- In case your firm fails to supply the stores within the time specified in the supply order or any extension thereof, you shall be liable to pay liquidated damage s (LD) at the rate of a sum equivalent to 0.5% per week or part thereof for undelivered portion of s upply subject to maximum 10% of the value of supply order.

• 5.Inspection authority:- Board of officer as appointed by commander, HQ 758 BRTF.
• 6.Payment instruction:- By AO 758 BRTF.
• 7.Disposal of unserviceable/incorrect items :-Incorrect& unserviceable items, if any, foun d by the inspecting Board of Officers shall be lifted by the supplier under own arrangements within a month of supply of the store. In case supplier / fails to lift the rejected/surplus spares within abov e specific time, consignee may dispose of the same by the discretion of firm’s risk and cost.
• 8.Guarantee/Warrantee:-
• (i)The period of warranty shall be 06 month from the date of acceptance of the stores.
• (ii)The supplier will be responsible for free replacement of stores found defective withi n a period of 10 days from the date of intimation by the consignee.
• 9.Items of tender may be increase or decrease by CFA by 25% of total value of tender. TERMS AND CONDITIONS.
• 10.Extension of delivery period:-The purchase reserves the right to cancel the supply order/bal ance quantity not supplied within the delivery period on risk and cost of the supplier. However purc haser may grant extension of delivery period if same asked for by the firm within the delivery perio d subject to following conditions.
• (i)There are no charges in cost of Supply order.
• (ii)That the purchaser has the right to recover liquidate damage from contractor under the purchases of clause 2 of the contract for the stores which are not delivered within the d elivery period.
• 11.Taxes applicable are clearly mentioned as separate rate quoted as percentage (%) against remarks column of all items otherwise same will not be accepted.
• 12.Please acknowledge:-The receipt of acceptance of supply order to be sent within 07 day s of placing of Supply order failing which supply order will be deemed as accepted by you. .

Nominated Inspection Agency: On behalf of the Buyer organization, any one of the following Inspection Agency would be conducting inspection of stores before acceptance: Pre-dispatch Inspection at Seller Premises (applicable only if pre-dispatch inspection clause has been selected in ATC): Nil Post Receipt Inspection at consignee site before acceptance of stores: Nominated by BOO
