Buyer Added text based ATC clauses 1 Bidder shall comply with applicable GeM GTC/STC, bid conditions and Government procurement rules. 2 Bidder shall submit valid statutory and registration documents required in the GeM bid, including PAN an d Udyam/MSME documents wherever applicable. 3 The bidder shall be capable of supplying, deploying, configuring and supporting the products/services as per the published technical specification. 4 All offered software shall be genuine, properly licensed and supported for the period specified in the bid. 5 Quoted rates shall include the charges expressly specified in the BOQ/technical specification, including d eployment, installation, configuration and training wherever applicable. 6 Published requirements shall not be materially changed at the time of purchase. Any material clarificatio n or change shall be made through the prescribed GeM process. 7 Where a product demonstration is required, it shall follow the published schedule and objective evaluatio n criteria and shall be applied uniformly to applicable bidders. 8 Any sample or trial, where permitted and required, shall be evaluated only against objective and pre-dis closed requirements. 9 Eligibility relating to debarment shall be governed by applicable GFR provisions, GeM conditions and vali d orders of the competent authority. 10 The offered products/services shall correspond to the items expressly specified in the BOQ and technic al specification. 11 Hosting/server requirements, if applicable, shall be as specified in the bid, including the hosting period, security, backup and domain requirements. 12 Training shall be provided to designated staff as specified in the bid. Where on-site training is required, related responsibilities shall be stated in the bid. 13 Technical support shall be provided during the contracted support period. On-site support shall be prov ided where specifically required in the published SLA. 14 The bidder shall have lawful rights or authorization to supply, license, deploy and support the offered pr oducts/services. 15 Acceptance shall be based on verification/testing against the published technical specification and cont ract. 16 Applicable Government procurement preferences and statutory requirements shall be followed as per p revailing rules. 17 Disputes shall be dealt with in accordance with applicable GeM terms, the resulting contract and applic able law. 18 Pre-Bid Meeting / Demo Presentation at the buyer’s premises.
