OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 50 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 50% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Nominated Inspection Agency: On behalf of the Buyer organization, any one of the following Inspection Agency would be conducting inspection of stores before acceptance: Pre-dispatch Inspection at Seller Premises (applicable only if pre-dispatch inspection clause has been selected in ATC): NOT APPLICABLE Post Receipt Inspection at consignee site before acceptance of stores: INSPECTION AUTHORITY: CGM OFK JABALPUR OR HIS AUTHORIZED REP.

Buyer Added text based ATC clauses This Tender is governed by buyer added conditions attached with this bid along with GeM general terms and conditions. Please go through t he Bid conditions, Technical specification, delivery period, and Buyer a dded conditions before quoting. Important Conditions: This tender is Open Tender Enquiry being floated through GEM Custom Bid for procurement of item :- “GENERAL PURPOSE CUTTING OIL SOLU BLE TO SPECN: IS-1115-1986 (2ND REVISION).”

  • 1.Pre Qualification Criteria :
  • (A)Financial Turn Over Criteria : The minimum average annual financi al turnover of the bidder during the last 3 years, ending on 31st March of the previous financial year (i.e. 2025-26) should be minimum Rs. 7 l akhs. The bidders to submit Turn Over Certificate/Balance Sheet and P rofit & Loss Account/latest ITR duly certified by recognized chartered a ccountant for past 03 years as documentary evidence. MSEs (Micro & S mall Enterprises) as per latest orders issued by ministry of MSME and Start-ups registered with DPIIT will be exempted from financial turnov er criteria subject to conforming their technical offer & technical speci fications and on submission of valid Udyam Registration Certificate/Ce rtificate of Recognition.
  • (B)Bidder must have experience of successfully supplying the tender i tem or any IS/ME/JSS standard Industrial Oil/Chemical item to any Cent ral Govt. department/State Govt. department/PSU Companies/Public lis ted companies within last 2 years. In support the Bidders have to sub mit the copy of the same along with technical bid i.e. copy of supply or der with CRAC or acceptance certificate or CRAC. MSEs (Micro & Small Enterprises) as per latest orders issued by ministry of MSME and Start -ups registered with DPIIT will be exempted from experience subject to conforming their technical offer & technical specifications and on sub mission of valid Udyam Registration Certificate/Certificate of Recogniti on.
  • (C)A compliance statement of standard tender terms & conditions enc losed in buyer uploaded ATC document section with the bid and the Bi dder has to submit compliance statement completely filled & duly sign ed with seal of the firm.
  • (2)Firm must submit MSE certificate (URC) for availing MSE purchase preference.
  • (3)Option clause : 50%, applicable.
  • (4)FOR :- OFK Basis
  • (5)Payment terms : 100% payment within 30 days after acceptance of material.
  • (6)If any firm is found as debarred at any stage before placing of sup ply order, the Bid of that firm will not be considered for further evalua tion.
  • (7)Earnest Money Deposit (in favour of Chief General Manger/O F Kha maria) is to be submitted by the bidders except Micro and Small Enter prises (MSEs) having URC number as defined in MSE Procurement Polic y issued by Department of Micro, Small and Medium Enterprises (MSM
  • E)or are registered with the Central Purchase Organisation or the conc erned Ministry or Department (including OFs) or Startups as recognise d by Department of Industrial Policy and Promotion (DIPP). EMD is also not required from Central PSUs. EMD exemption for sellers will also be applicable as per latest GEM GTC. Bidders/Sellers exempted from sub mission of EMD must submit certified copy of Govt of India authority f or such exemption in lieu of EMD. The EMD may be accepted in the for m of Account Payee Demand Draft, Fixed Deposit Receipt, Banker's Ch eque or Bank Guarantee from any of the commercial banks or payment online in an acceptable form.   • (8)Bidder has to submit the MII document/certificate mentioning the %age of local content of material to be supplied.
  • (9)Performance Security deposit (in favour of Chief General Manger/O F Khamaria) is to be submitted by the supplier as per T.E. terms & con ditions within 30 days from the date of awarding of contract. The PSD may be accepted in the form of Account Payee Demand Draft, Fixed De posit Receipt, Banker's Cheque or Bank Guarantee from any of the com mercial banks or payment online in an acceptable form.   • (10)Bidder has to submit self-certification undertaking that none of hi s/her relative is working in the unit where he/she is going to bid for the tender.
  • (11)A Model ECS Mandate Format is being uploaded with the Bid. The Bidders are requested to submit this Mandate Format during tender fi nalization i.e. the firm has to submit completely and correctly filled Ma ndate Format at the time of supplying the material.
  • (12)i) MSDS of subject item should be provided by the firm at the time of supply. ii) Item should have manufacturing date and expiry date ind icated at the package at the time of supply. iii) Gunny bags, plastic co ntainer, steel boxes etc, which contains item should be in good/sound packing condition so that the material could be stored properly for lar ge durations until their use.
  • (13)Loading/unloading will be done by store/section/OFK’s hired labou rs and charges of loading and unloading of the materials will be deduc ted @ Rs.220/-per ton from contractors regular bill.
  • (14)NOTE:- Participating bidder’s may please be noted that GeM porta l is having functionality to monitor bids having same IP address used b y bidders/ sellers. GeM portal is capturing and reflecting the IP addres s used by buyer and participated bidders/ sellers. The received bids ha ving matching/common IP address with other participating bidders/sell er or buyers, their offer will be out rightly rejected and will not be con sidered for further evaluation.
  • (15)Bidder must attach all asked /required documents along with its b id. Non- submission of asked document may lead to rejection of the off er.
  • (16)The deviation from tender condition if any must be mentioned cle arly in compliance sheet and compliance sheet will be considered as fi nal statement of firm and documents submitted beside that will not be considered for deviations against tender or specification. (Deviations a gainst specification must be mentioned in compliance sheet, if it is in pages, page number of the same should be mentioned in compliance s heet).
  • (17)Relevant provisions of MIL STORE PURCHASE MANUAL-2023 shall also be part of Tender enquiry. .

Timely Servicing / rectification of defects during warranty period: After having been notified of the defects / service requirement during warranty period, Seller has to complete the required Service / Rectification within 10 days time limit. If the Seller fails to complete service / rectification with defined time limit, a penalty of 0.5% of Unit Price of the product shall be charged as penalty for each week of delay from the seller. Seller can deposit the penalty with the Buyer directly else the Buyer shall have a right to recover all such penalty amount from the Performance Security (PBG).Cumulative Penalty cannot exceed more than 10% of the total contract value after which the Buyer shall have the right to get the service / rectification done from alternate sources at the risk and cost of the Seller besides forfeiture of PBG. Seller shall be liable to re-imberse the cost of such service / rectification to the Buyer.
