OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

If any firm submits offer against the tender for any make other than the make as mentioned in the tender, the same will be considered as unsolicited and rejected. The tender has been displayed only for information regarding items being procured by NMDC Steel Limited and not for participation of any other makes/firms, which are not established / proved in NMDC Steel Limit ed. However, other firms who are capable of supplying the tendered items of any other makes as per the tech nical specification mentioned in the tender document, may submit their credentials to GM (Materials), NMD C Steel Limited, Nagarnar, Jagdalpur, Chhattisgarh – 494001, indicating tender reference no., for vendor re gistration for future tenders. Special conditions: · Payment Terms: 100% payment will be released within 30 days against receipt & acceptance of ordered it ems on submission of Original or Digitally signed Invoice(s). · Penalty Clause: -If the Seller fails to deliver any or all of the Goods within the original delivery period(s) sp ecified in the contract, the Buyer will reserve the right to levy/deduct/recover the penalty for the delay @ 0 .5% of the basic order value of the un-delivered quantity for each week or part thereof but subject to maxi mum 5% (five percent) of the total basic order value.

• a)Submission of Price fall certificate is mandatory on below mentioned format – Price Fall Certificate Bidder(s) shall submit the Price Fall certificate as per below format on their Letter Head while submit ting their offer. I/We undertake that we have not offered to supply / supplied / are not supplying same or similar prod ucts / systems or sub systems at a price lower than that offered against the GeM Bid No……………… ………………. dtd …………………….. in respect of any Organization/Ministry/Department of the Govt. of India or its Subsidiaries or other PSU or any other p rivate organization during the currency of the contract and if it is found at any stage that same or si milar product/systems or sub systems was supplied by the bidder to any Organization/Ministry/Department of the Govt. of India or its Subsidiaries or other PSU or any other private organization at a lower price during the currency of the contract, then that very price w ill be applicable to the present case and the difference in the cost would be refunded by the bidder t o buyer, if the contract has already been concluded. I/We also accept that:
• 1.I/We have to submit a copy of the last (latest) purchase order for the similar/ordered item(s) received from any Organization/Ministry/Department of the Govt. of India or its Subsidiaries or other PSU or any other private organization.
• 2.We will inform the purchaser of offer to supply/supply of the similar/ordered item(s) at a lower rat e to any Organization/Ministry/Department of the Govt. of India or its Subsidiaries or other PSU or an y other private organization during the currency of the contract.
