OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Completion: The work shall be completed within 30 (Thirty) days from the date of Agr eement / LOI, under strict supervision of JE in charge and as per instructions of Engineer in- charge. D.) Penalty: A penalty @ ½ % per week, subject to maximum 10% of the late completion of work and shall be imposed and deducted from the firm’s bill. E.) Sample Collection: Collection of Sample Performa of Log- Sheet and Register will be done by the Contractor by each Sub- Station physically, and no any Performa will be provid ed through e-mail and Postal Dak. The Performa or sample will be made available back to t he concern Junior Engineer of each Sub- Station physically for final checking, before final pr inting and supply of entire material. F.) Engineer of Contract: Executive Engineer, Electricity Trans. Division, Sultanpur shall be the Engineer of the Contract for all the matter in this contract. G.) Payment: 90% payment shall be made to the contractor after successful completion o f work at site in satisfactory condition. The firm shall upload the bill (Tax- Invoice) on UPPT CL’s BTS portal for further processing of Payment by UPPTCL Headquarter Lucknow. Any de fect noticed in the material shall be reported to the firm by the concerned JE, for removal of defect OR free replacement of material within 07 days. Balance10% payment shall be kept as performance guarantee which will be released after 6 months from the date of delivery. Alternatively, if supplier deposits 10% amount of ordered value as performance Guarantee i n shape of FDR / B.G. pledged in favour of Executive Engineer, Electricity Transmission Divi sion, Sultanpur 100% payment shall be released. H.) General: All terms and conditions shall be governed as per general terms and conditio ns of form ‘B’ of U. P. Power Transmission Corporation Ltd. I.) In case of any dispute between purchaser and contractor, the decision of Superintendi ng Engineer, Electricity Transmission Circle, Sultanpur & the courts of Sultanpur juris diction will be final and legally binding on both the parties. .
