• 2.Terms and Conditions stipulated in ATC will supersede those in GEM GTC i n case of any conflicting provisions.
• 3.The Bidder shall be held solely responsible for non-submission of bids on t he e-tender portal due to any reasons within the due date/ time. NTPC sha ll not be held responsible or liable in any manner for the same. Bidders sh all follow the guidelines/instructions available on the e-tender portal and a re advised to submit their bids well before the due date and time to avoid any inconvenience or risk of non-submission.
• 4.GeM is capturing and showing the IP addresses used by the Buyer and the Bidder(s) /Seller(s). The received bids having matching/common IP addres s with either Bidder(s)/Seller(s) or Buyer, shall be outrightly rejected & sha ll not be considered for further evaluation.
• 5.It shall be deemed that bid submitted by the bidder is unconditionally acc epted with all the clauses mentioned in BID (including attachment-9, 13 & appendix of ATC) which is in line with GeM seller undertaking Sl. 3.0 "I hav e read all the Bid conditions including the GeM GTC, STC and also all the cl auses incorporated by the Buyer in ATC and various corrigendum of the bi d . I hereby confirm acceptance and compliance of all the conditions including GTC, STC and ATC and Corrigendum conditions. I also confirm th at all the product(s) offered is/are fully compliant with the specifications a sked for in the bid, including the additional specification parameters incor porated by the Buyer in the bid document."
• 6.Bidders are required to submit all documents specified in the Checklist pr ovided under the GeM Additional Text-Based ATC Clauses along with their bid. The duly filled-in Checklist shall also be uploaded online on the GeM p ortal as part of the bid submission.
• 7.PBG option has been selected NO on GeM Bid. However, Vendor shall be r equired to submit PBG/SD as per GCC/SCC/STC
• 8.Bidders are advised to mention their prices at the designated place only o n the GeM portal as the same shall only be considered for evaluation and price content mentioned / uploaded along with any other documents in th eir bid shall not be considered in any case
• 9.Acceptance of the following clauses on the GeM portal, in reference to the subject tender, shall be deemed as unconditional acceptance of all terms and conditions specified in the Additional Terms and Conditions (ATC) doc ument i.e. Acceptance of Attachment-13, as well as any other clauses stat ed elsewhere in the bid document, irrespective of their location or context : 1.Regulatory/Statutory Compliance of Service 2.Compliance of Service to Scope of Work (SOW), Special Terms and Conditions (STC), Service Level Agreement (SLA), etc. .
