OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Actual delivery (and Installation & Commissioning (if covered in scope of supply)) is to be done at following address GCE, KALAHANDI, BHABANIPATANA AT- Bandopala Post-Bhabanipatana Engineering College SO DIST- KALAHANDI ODISHA, PIN- 766003 .

Bidder financial standing: The bidder should not be under liquidation, court receivership or similar proceedings, should not be bankrupt. Bidder to upload undertaking to this effect with bid.

Manufacturer Authorization:Wherever Authorised Distributors/service providers are submitting the bid, Authorisation Form /Certificate with OEM/Original Service Provider details such as name, designation, address, e-mail Id and Phone No. required to be furnished along with the bid

Without prejudice to Buyer’s right to price adjustment by way of discount or any other right or remedy available to Buyer, Buyer may terminate the Contract or any part thereof by a written notice to the Seller, if:

• i)The Seller fails to comply with any material term of the Contract. ii) The Seller informs Buyer of its inability to deliver the Material(s) or any part thereof within the stipulated Delivery Period or such inability otherwise becomes apparent. iii) The Seller fails to deliver the Material(s) or any part thereof within the stipulated Delivery Period and/or to replace/rectify any rejected or defective Material(s) promptly. iv) The Seller becomes bankrupt or goes into liquidation.
• v)The Seller makes a general assignment for the benefit of creditors. vi) A receiver is appointed for any substantial property owned by the Seller. vii) The Seller has misrepresented to Buyer, acting on which misrepresentation Buyer has placed the Purchase Order on the Seller.

• 7.Turnover Bidder Turn Over Criteria: The minimum average annual financial turnover of the bidder during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the bidder is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria.
• 8.Turnover OEM Turn Over Criteria: The minimum average annual financial turnover of the OEM of the offered product during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the OEM is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria. In case of bunch bids, the OEM of CATEGORY RELATED TO primary product having highest bid value should meet this criterion.

Escalation Matrix For Service Support : Bidder/OEM must provide Escalation Matrix of Telephone Numbers for Service Support.

Availability of Service Centres: Bidder/OEM must have a Functional Service Centre in the State of each Consignee's Location in case of carry-in warranty. (Not applicable in case of goods having on-site warranty). If service center is not already there at the time of bidding, successful bidder / OEM shall have to establish one within 30 days of award of contract. Payment shall be released only after submission of documentary evidence of having Functional Service Centre.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

To be eligible for award of contract, Bidder / OEM must possess following Certificates / Test Reports on the date of bid opening (to be uploaded with bid): ISO 9001, ISO 14001, ISO 45001, ISO 50001(NABCB accredited); Green Co, GRIHA, Green Pro, IGBC, BIFMA compliance (minimum 15 listed products on official BIFMA website) & BIFMA LEVEL certification (Level 1/2/ 3 with minimum 6 certified products in any level on official BIFMA website), BIS license copies for IS 17631 to IS 17635:2022; India Design Mark certification for last three year .

ISO 9001: The bidder or the OEM of the offered products must have ISO 9001 certification.

The bidder is required to upload, along with the bid, all relevant certificates such as BIS licence, type test certificate, approval certificates and other certificates as prescribed in the Product Specification given in the bid document.

Successful bidder will have to ensure that adequate number of dedicated technical service personals / engineers are designated / deployed for attending to the Service Request in a time bound manner and for ensuring Timely Servicing / rectification of defects during warranty period, as per Service level agreement indicated in the relevant clause of the bid.

Warranty period of the supplied products shall be 1 years from the date of final acceptance of goods or after completion of installation, commissioning & testing of goods (if included in the scope of supply), at consignee location. OEM Warranty certificates must be submitted by Successful Bidder at the time of delivery of Goods. The seller should guarantee the rectification of goods in case of any break down during the guarantee period. Seller should have well established Installation, Commissioning, Training, Troubleshooting and Maintenance Service group in INDIA for attending the after sales service. Details of Service Centres near consignee destinations are to be uploaded along with the bid.

Timely Servicing / rectification of defects during warranty period: After having been notified of the defects / service requirement during warranty period, Seller has to complete the required Service / Rectification within 15 days time limit. If the Seller fails to complete service / rectification with defined time limit, a penalty of 0.5% of Unit Price of the product shall be charged as penalty for each week of delay from the seller. Seller can deposit the penalty with the Buyer directly else the Buyer shall have a right to recover all such penalty amount from the Performance Security (PBG).Cumulative Penalty cannot exceed more than 10% of the total contract value after which the Buyer shall have the right to get the service / rectification done from alternate sources at the risk and cost of the Seller besides forfeiture of PBG. Seller shall be liable to re-imberse the cost of such service / rectification to the Buyer.

Bidders can also submit the EMD with Account Payee Demand Draft in favour of PRINCIPAL GCE KALAHANDI payable at BHABANIPATANA . Bidder has to upload scanned copy / proof of the DD along with bid and has to ensure delivery of hardcopy to the Buyer within 5 days of Bid End date / Bid Opening date.

Successful Bidder can submit the Performance Security in the form of Fixed Deposit Receipt also (besides PBG which is allowed as per GeM GTC). FDR should be made out or pledged in the name of PRINCIPAL, GCE, KALAHANDI, BHAWANIPATNA A/C (Name of the Seller). The bank should certify on it that the deposit can be withdrawn only on the demand or with the sanction of the pledgee. For release of Security Deposit, the FDR will be released in favour of bidder by the Buyer after making endorsement on the back of the FDR duly signed and stamped along with covering letter. Successful Bidder has to upload scanned copy of the FDR document in place of PBG and has to ensure delivery of hard copy of Original FDR to the Buyer within 15 days of award of contract.

• 1.Bidder must be an original equipment manufacturer (OEM) or an authorised dealer of the OEM.
• 2.An undertaking from the OEM/ reseller is required stating that they would facilitate regularly with technology/ product update s and extend all support for the warranty in confirmation with t his tender for the quoted items.
• 3.Wherever authorised dealers are submitting bids, it is mandat ory to submit the OEM authorisation certificate on Letter Head f rom OEM with name, seal, sign, contact number and email ID.
• 4.Bidder & OEM need to submit PAN, GST Certificate.
• 5.Dedicated /Toll Free Telephone No. for Service Support: BIDDE R/OEM must have Dedicated/Toll Free Telephone No. for Servic e Support.
• 6.Escalation Matrix for service support OEM must provide an esc alation matrix of telephone numbers with telephone numbers f or service support.
• 7.A Notarized affidavit by the bidder that it has never been black listed by any Govt. Department & funded autonomous bodies must be uploaded along with the technical bid, failing which the bid shall be rejected. The same original bid-specific affidavit sh all be submitted before the award of the bid by the lowest eval uated successful OEM/bidder.
• 8.Certification: The OEM should have the following valid certifica tes and all the ISOs should be accredited from NABCB along wit h IAF-certified agency:
• a)AIOTA for Education Furniture Range, Office Furniture in cluding Seating Systems, Storage System range Certificat
• e.The same shall be checked from the AIOTA website.
• b)The OEM must be producing furniture products certified under India Design Mark, with at least one product certifi ed in each of the last three years (2023,2024 & 2025). A screenshot from the official website (indiadesignmark.in) must be submitted as proof.
• 9.The Bidder/OEM should be a member of BIFMA, and at least 15 Nos (Fifteen products) of the OEM should be enlisted under BIF MA at www.bifma.org.
• 10.The bidder or its OEM shall submit the Manufacturing Factory License and Trademark certificate. A copy of both documents s hall be enclosed as proof of compliance.
• 11.The bidder or its OEM must submit the BIS License copy for IS 17631:2022, IS 17632:2022, IS 17633:2022, IS 17634:2022, an d IS 17635:2022 as applicable as per the order of the Departm ent for Promotion of Industry and Internal Trade dated 13/02/20 25.
• 12.OEM must have an OEM/OEM authorised service centre in Odis ha. However, in case of the address of the OEM authorised serv ice centre, proof of authorisation has to be produced on the OE M letterhead.
• 13.The OEM shall have a factory of its own for manufacturing th e furniture and the factory shall contain the machinery menti oned below. Pipe Cutting Machine, CNC Tube/Pipe bending machine, Hydrau lic Brake Press/ Mechanical Press, Lazer Sheet Processing Mach ine/Lazer Cutting Machine, Post Forming Machine/Edge Bandin g Machine, Panel Saw Machine/ CNC Beam Saw Machine, Spindle Molder Machine, Multi Boring Machine, MIG / TIG Weldi ng, In House Powder Coating Line with baking oven and powde r application/ Automatic Powder Coating Booth, CNC Router Ma chine The OEM/Bidder should submit a Third-Party Feasibility R eport regarding the machinery, which must be from any of the Inspection /certification bodies listed under NABCB. The same will be verified from the NABCB website.
• 14.A bid compliance undertaking must be submitted by the bidde r/OEM citing that all items will be provided as per the attached specifications.
• 15.The product warranty will be one year for manufacturing defec ts. Undertaking from OEM Letter Head should be produced.
• 16.Rates per unit of furniture must be quoted inclusive of supply & installation, transportation/delivery at the site.
• 17.This is a bunch bid, so the bidder must quote for all the items; a single-item quotation will not be acceptable.
• 18.Non- compliance of tender terms, non- uploading of required d ocuments, lack of clarity of the specifications, contradiction & s upporting literature etc. and submission of forged information may lead to rejection.
• 19.The buyer reserves the right to accept/reject any/all bids with out assigning any reasons therefore. All relevant documents with respect to the above points must be uploaded with the tender documents. Th e bidder has to quote and supply the materials customised as per the specification sheet attached in the bi d-specific ATC. The specifications mentioned elsewhere in this document will be regarded as generalised r equirements for the case of participation and should not guarantee acceptance of the product. There is a s tandard tolerance of ±5%. .
