Buyer Added text based ATC clauses Medical Examination

  • (i)Mandatory Annual Health Examination: The Contractor shall, at its own cost and expense, arrang e for a comprehensive annual health examination for all its employees/contract labour who have com pleted 40 years of age within the stipulated timeline mentioned in the applicable OHS &WC (Occupati onal Health, Safety and Working Conditions) Rules.
  • (ii)Such examinations are to be conducted at our Sector-22 Hospital/ Health Centre and the cost of such s hall be borne by the Contractor . The payment for such medical examination at Sector 22 Hospital sh all be on payment of a nominal charge of Rs. 500/- as per Circular issued by RSP from time to time. Th e scope of the examination shall include, but not be limited to, the tests prescribed in form of the appl icable OSH& WC Rules.
  • (iii)The contractor(s) shall also undertake medical examination mandatorily at Company’s Hospital (Sec tor 22 Hospital) /Health Centre for their Contract labours other than at (i) above, engaged at the follo wing areas:
  • (a)Working at Height
  • (b)Engaged at Confined spaces/locations
  • (c)Hot metal handling including Crane operation jobs
  • (d)Heavy vehicle operation and loco operation jobs. For the above, the Contractor Employer is required to pay a nominal amount i.e. Rs. 300/- (Rupees three h undred only) for General Medical Examination along with audiometry test, spirometry test, vision test and vertigo test and Rs. 500/-(Rupees five hundred only) for comprehensive health check up including chest x- ray . The medical examination procedure & cost will be revised as per circular issued by RSP from time to time .
  • (iv)For Contract Workers proposed to be engaged for working in the area at (iii) above, Contractor shall submit Medical Examination Report at the time of submitting application for preparation of height pa sses or before actual deployment on the above jobs/in areas as notified through RSP circulars time t o time. In absence of Medical Fit Certificate issued from the Company Hospital, the Contract labour s hall not be allowed to engage at areas as notified by RSP through circulars from time to time. Biometric Attendance
  • 1.The contractor shall be responsible for enrollment and registration of their contract workers in the Contract Labour Management System(CLMS) Portal provided by RSP. No other means of d ata management of contract workers other than provided by Rourkela Steel Plant will be accep table.
  • 2.It is mandatory for the contractor to ensure that all contract workers employed by them mark t heir attendance using the facial recognition based Biometric machines as provided within pre mises of Rourkela Steel Plant (RSP)/Township areas . The deployment data captured through C LMS Portal will only be considered while issuance of NDC as per applicable RSP procedures.
  • 3.The Contractor will be required to pay a one-time rental charge of Rs.100 for each Contract ag ainst the use of the CLMS Portal . This amount shall be deducted from the first Running Accoun t Bill (RA Bill) of the contractor.
  • 4.The contractor shall use system generated forms necessary for getting clearances from Contra ct Labour cell (CLC) of HR department.
  • 5.The contractor will be bound to use attendance and security system installed/ implemented by RSP from time to time like RFID card/system etc. The clause shall be applicable for all contract s of Rourkela locations. Character and Antecdent verification The Contractor shall ensure that all personnel deployed under the contract hav e undergone Character and Antecedent Verification (CAV) through relevant syst em in vogue of the respective police authorities.This is a mandatory document while applying for gate passes for the personnel. The Contractor shall maintain digital and physical copies of all certificates and a cknowledgements, which must be produced upon demand by authorities. Other Clauses The Contractor shall be solely responsible for compliance wit h all statutory provisions including, but not limited to, the Co de on Wages (2019), the Code on Social Security (2020), and the OSH &WC Code (2020). The Contractor shall indemnify th e Principal Employer against any claims, penalties, or legal c osts arising from the Contractor’s failure to fulfill these oblig ations. A RELAXATION OF 15% IN FINANCIAL TURN OVER CRITERIA WILL BE ALLOWED FOR MSEs WHO ARE ELIGIBL E FOR PREFERENCE AND STARTUP THAT ARE RECOGNIZED BY DEPARTMENT FOR INDUSTRY & INTERNAL T RADE (DPIIT). .
