OPTION CLAUSE 25% : The buyer can increase or decrease the contract quantity or contract duration up to 25 percent at the time of issue of the contract. However, once the contract is issued, the contract quantity or contract duration can only be increased up to 25 percent. Bidders are bound to accept the revised quantity or duration. For lumpsum-based service contracts, the buyer may increase the scope of work and contract value up to 25 percent with the consent of the service provider

  • 1.The Seller shall not assign the Contract in whole or part without obtaining the prior written consent of buyer.
  • 2.The Seller shall not sub-contract the Contract in whole or part to any entity without obtaining the prior written consent of buyer.
  • 3.The Seller shall, notwithstanding the consent and assignment/sub-contract, remain jointly and severally liable and responsible to buyer together with the assignee/ sub-contractor, for and in respect of the due performance of the Contract and the Sellers obligations there under.

  • 6.Past Project Experience Proof for Past Experience and Project Experience clause: For fulfilling the experience criteria any one of the following documents may be considered as valid proof for meeting the experience criteria:a. Contract copy along with Invoice(s) with self-certification by the bidder that service/supplies against the invoices have been executed.b. Execution certificate by client with contract value.c. Any other document in support of contract execution like Third Party Inspection release note, etc.Proof for Past Experience and Project Experience clause: For fulfilling the experience criteria any one of the following documents may be considered as valid proof for meeting the experience criteria:a. PAYMENT OF SALARIES AND WAGES: Service Provider is required to pay Salaries / wages of contracted staff deployed at buyer location first i.e. on their own and then claim payment from Buyer alongwith all statutory documents like, PF, ESIC etc. as well as the bank statement of payment done to staff.

Bidders can also submit the EMD with Account Payee Demand Draft in favour of Pay and Account Officer, Cabinet Affairs payable at New Dehi . Bidder has to upload scanned copy / proof of the DD along with bid and has to ensure delivery of hardcopy to the Buyer within 5 days of Bid End date / Bid Opening date.

Successful Bidder can submit the Performance Security in the form of Account Payee Demand Draft also (besides PBG which is allowed as per GeM GTC). DD should be made in favour of Pay and Account Officer, Cabinet Affairs payable at New Delhi . After award of contract, Successful Bidder can upload scanned copy of the DD in place of PBG and has to ensure delivery of hard copy to the original DD to the Buyer within 15 days of award of contract.

Buyer Added text based ATC clauses BID SPECIFIC TERMS & CONDITIONS

  • a)Bidder must submit agreement to ATC on their letter head and all the undertakings with latest date d uring which the bid remains live. Bidder must upload self-attested bid document.
  • b)The service providers must have experience of successful execution/ completion of orders of monkey handling services in the last 01 (one) year to any Central Government Ministries/ Departments/ Public Sector Companies/ Nationalized Banks. Copies of contracts/ work orders in support of Past Experience of Similar Services along with names, address and contact details of clients shall be uploaded with the bid for verification by the Buyer.
  • c)Company/ firm office in Delhi NCR (valid documents to be enclosed).
  • d)This is two bid system and only those parties who qualify in the technical bid, their financial bid will be opened.
  • e)Firms quoting minimum wages inclusive of EPF/ESI & GST less than the minimum wages prescribed by Govt. of NCT of Delhi as applicable on date of issuance of this bid shall not be considered as responsive bidders irrespective of them being L1 firms.
  • f)Overtime allowance will be admissible on a case-to-case basis as per prevailing rates.
  • g)The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase or decrease the ordered quantity by up to 25% of the contracted quantity during the currency of the c ontract at the contracted rates. Bidders are bound to accept the orders accordingly.
  • h)Duration of the service contract may be extended up to 6 months beyond the initial contract duration (subject to satisfactory performance and mutual consent).
  • i)Bidder must enclose GST return for the last 01 years i.e. 2025-26.
  • j)The bidder should have registered with EPF and ESI department. Latest ESIC and EPF Challan return al ong with ECRs for last 01 year to be enclosed with the bid.
  • k)The contract can be terminated at any time on account of unsatisfactory services upon review of perf ormance by the Competent Authority in the Cabinet Secretariat. The decision of the Competent Author ity shall be binding on the service provider. No claims for compensation of loss of revenue due to such decision shall be entertained. The unsatisfactory service shall mean and include non-compliance and n on-fulfillment of any of the contractual obligations by the service provider or poor performance or viola tion of any of the terms and conditions of the Bid/Contract and failure on its part to correct the discrep ancies/ shortcomings, brought to its notice in writing by the Section.
  • l)Bid specific documents are mandatory to be submitted. No exemption in this regard will be entertaine
