OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Bidder financial standing: The bidder should not be under liquidation, court receivership or similar proceedings, should not be bankrupt. Bidder to upload undertaking to this effect with bid.

Bidders are advised to check applicable GST on their own before quoting. Buyer will not take any responsibility in this regards. GST reimbursement will be as per actuals or as per applicable rates (whichever is lower), subject to the maximum of quoted GST %.

  • I.Liquidated Damages: In the event of the Seller’s failure to deliver any or all of the Goods/Services with in the originally stipulated delivery period specified in the contract, the Buyer shall be entitled to deduct or recover Liquidated Damages for the delay. Unless exempted under Force Majeure conditions, damages will be levied at a rate of 0.5% per week or part thereof for the delayed period, subject to a maximum of 10% o f the contract value, without any dispute or controversy . II. Payment Terms: 100% payment will be released within ten (10) days of issue of consignee receipt-cu m-acceptance certificate (CRAC). III. Performance Security-cum-Warranty Bond: The successful bidder shall be required to submit a Pe rformance Security-cum Warranty Bond in the form of a Bank Guarantee amounting to 5% of the total cont ract value. This bond must remain valid for 44 months (comprising 36 months for warranty, 06 months for delivery, and a 2-month buffer period). The bond must be submitted within thirty (30) days from the date o f the contract. Failure to submit the bond within the specified timeline shall attract Liquidated Damages (L
  • D)at the rate of 0.5 % of the bond amount per week or part thereof of delay. In case the delay exceeds sixt y (60) days, the Supply Order/Contract is liable to be cancelled, and/or other appropriate actions may be i nitiated against the bidder as deemed necessary as per para 10 (IV) of buyer added bid specific terms and conditions of the bid document. IV. Bid Security Declaration in Lieu of EMD: Bidders may submit a Bid securing declaration accepting that if they withdraw or modify their Bids during the period of validity , or if they are awarded the contract and they fail to sign the contract, or to submit a performance security-cum-Warranty bond before the dea dline defined in the request for bid documents, they may be suspended for the period up to 2 years from b eing eligible to submit bids for contracts with any of the procuring entities of DD(R&D). Bidders are request ed to ensure that their offered items meet the attached specifications.

Warranty period of the supplied products shall be 3 years from the date of final acceptance of goods or after completion of installation, commissioning & testing of goods (if included in the scope of supply), at consignee location. OEM Warranty certificates must be submitted by Successful Bidder at the time of delivery of Goods. The seller should guarantee the rectification of goods in case of any break down during the guarantee period. Seller should have well established Installation, Commissioning, Training, Troubleshooting and Maintenance Service group in INDIA for attending the after sales service. Details of Service Centres near consignee destinations are to be uploaded along with the bid.
