OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Data Sheet of the product(s) offered in the bid, are to be uploaded along with the bid documents. Buyers can match and verify the Data Sheet with the product specifications offered. In case of any unexplained mismatch of technical parameters, the bid is liable for rejection.

For hazardous chemical/item, all precautionary measure as per regulation from the point of transportation/ handling/ storage/ safety/ health/ environment to be undertaken/ specified before dispatch. During dispatch, proper symbol for the hazard/ MSDS/ Batch No./ date of manufacturing/ Gross Weight/ Net Weight/ shelf Life etc are to be written/ printed/ pasted on the body of the packing.

Shelf Life: The Product/Spare parts to be supplied as part of the services must have minimum 12 Months Shelf Life. On the date of supply, minimum 12 Months usable shelf life should be available / balance.

• 6.Purchase Preference (Centre) Purchase preference to Micro and Small Enterprises (MSEs): Purchase preference will be given to MSEs as defined in Public Procurement Policy for Micro and Small Enterprises (MSEs) Order, 2012 dated 23.03.2012 issued by Ministry of Micro, Small and Medium Enterprises and its subsequent Orders/Notifications issued by concerned Ministry. If the bidder wants to avail the Purchase preference, the bidder must be the manufacturer of the offered product in case of bid for supply of goods. Traders are excluded from the purview of Public Procurement Policy for Micro and Small Enterprises. In respect of bid for Services, the bidder must be the Service provider of the offered Service. Relevant documentary evidence in this regard shall be uploaded along with the bid in respect of the offered product or service. If L-1 is not an MSE and MSE Seller (s) has/have quoted price within L-1+ 15% of margin of purchase preference /price band defined in relevant policy, such Seller shall be given opportunity to match L-1 price and contract will be awarded for percentage of 25% of total value.

Nominated Inspection Agency: On behalf of the Buyer organization, any one of the following Inspection Agency would be conducting inspection of stores before acceptance: Pre-dispatch Inspection at Seller Premises (applicable only if pre-dispatch inspection clause has been selected in ATC): Not Applicable Post Receipt Inspection at consignee site before acceptance of stores: At Destination by Indenter group

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Buyer Added text based ATC clauses ​Buyer Added Additional Terms and Conditions

• 1.Brand / Make of Laboratory Chemicals
• i.The bidder shall quote products of reputed and established manufacture rs of laboratory/analytical chemicals, such as Merck, Supelco/Sigma-Aldrich , Thermo Fisher Scientific/Qualigens, Rankem, SRL, CDH, Loba Chemie, Spectrc hem, Finar, or equivalent reputed make, meeting the stipulated technical specif ications. ii. The bidder shall clearly indicate the Brand/Make offered against each qu oted item in the Technical Compliance Sheet. iii. Equivalent reputed brands/makes shall also be acceptable, subject to the offe red product fully conforming to the specified grade, assay/purity and all oth er applicable technical and quality requirements.
• 2.Certificate of Analysis / Test Report
• i.Each supplied chemical shall be accompanied by the manufacturer's Certif icate of Analysis (COA)/Test Report , as applicable, covering the relevant pa rameters stipulated in the technical specifications. ii. The Batch/Lot Number mentioned in the COA/Test Report shall correspond t o the Batch/Lot Number of the material supplied.
• 3.Packaging and Labelling:
• a.All chemicals shall be supplied in new, original, properly sealed manufac turer's packing.
• b.The packing shall conform to the specified requirements. Manufacturer's stan dard commercially available pack size may be accepted, provided the total sup plied quantity meets or exceeds the required quantity and the offered product c omplies with the stipulated technical specifications.
• c.The supplied material shall bear appropriate labelling indicating, as applicabl e: Chemical/Product name Brand/Manufacturer Grade Batch/Lot Number Manufacturing date Expiry/Retest date Applicable hazard/safety symbols
• d.Packaging shall be suitable for safe transportation, handling and storage of th e respective chemical.
• 4.Shelf Life: The chemicals supplied shall have minimum 80% residual shelf life at the t ime of delivery and, in any case, a minimum usable shelf life of 12 mon ths from the date of supply.
• 5.Replacement of Damaged / Defective Material:
• i)Any material received in damaged, broken, leaking or otherwise unaccep table condition, either at destination or found during inspection, shall be repla ced by the Seller/Supplier within 20 days from the date of intimation by t he Buyer, without any additional cost to the Buyer. ii) In case of failure to replace such material within the stipulated period, the mat erial shall be liable for rejection and payment against the rejected material shall not be released.
• 6.Detailed Technical Compliance Sheet: The bidder shall submit a detailed item-wise Technical Compliance Sheet and Bidder declaration (provided in Buyer added document based ATC s), along with the bid. · The Compliance Sheet shall be submitted on the bidder's own letterhead, duly signed by the authorised signatory. · Under "Specifications of Quoted Item", the bidder shall provide the actual o ffered specifications, including grade, assay/purity, GC assay, water, residue, ap pearance and other applicable parameters. · Under "Packing Details of Quoted Item", the bidder shall clearly indicate th e offered pack size and number of packs , as applicable. · Merely mentioning "Complied", "Yes", "Accepted" or "As per Tender Spe cification" without providing actual offered specifications shall not be consider ed detailed technical compliance.
• 7.Supporting Technical Documents: The specifications declared in the Technical Compliance Sheet shall be supporte d by the manufacturer's COA/Test Report/Product Technical Data Sheet , as applicable. The offered material shall conform to all applicable parameters specified in the tender.
• 8.Inspection and Acceptance:
• i)Acceptance of the supplied materials shall be subject to satisfactory complianc e with the applicable QAP requirements provided under the Document Based Bu yer Added ATCs. ii) Any material not conforming to the stipulated technical specifications and QAP requirements shall be liable for rejection.
• 9.Liquidated Damages: Liquidated Damages (LD) shall be applicable as per the relevant provisions of G eM General Terms and Conditions (GTC), including applicable amendments/revi sions forming part of the bid/contract.
• 10.Payment Terms: 100% payment shall be made within 10 days after satisfactory receipt, inspection and acceptance of the supplied quantity by ONGC, subject to submission of the requisite documents and fulfilment of the contractual conditio ns.​ .
