OPTION CLAUSE 25% : The buyer can increase or decrease the contract quantity or contract duration up to 25 percent at the time of issue of the contract. However, once the contract is issued, the contract quantity or contract duration can only be increased up to 25 percent. Bidders are bound to accept the revised quantity or duration. For lumpsum-based service contracts, the buyer may increase the scope of work and contract value up to 25 percent with the consent of the service provider

  • 3.Buyer Added Bid Specific SLA Text Clause(s) 1.: The expenditure on petrol/diesel will be borne by the contractor. Reporting station and r unning km charges will be effective from HQ of concerned officer as reckoned by concerne d officer from actual meter reading taken daily. 2.: Railway shall not pay for the diesel/patrol/mobile oil separately as the same is deemed t o be included in the rates quoted. 3.: No. garage facility or parking facility inside a locked compound shall be provided by the Railway for the period and vehicle is required to be parked by the Contractor at his own cos
  • t.4.: Contractor will have to maintain the vehicle at his own cost and the Railway will not pay for the vehicle maintenance charges. Railways will not be liable for giving off time for vehic le maintenance and suitable replacement vehicle will have to be provided in lieu in case a vehicle is required to be taken for maintenance. 5.: An expert and experienced Driver with valid driving licence shall be provided with the v ehicle. Vehicle shall accompany all legal and valid document along with tools and tackles w ith spare tyre. The driver must be issued proper uniform and identity card, which he must b ear on his person at all times while performing duty. 6.: There will be no weekly off day as such. The actual daily payment will be paid on the ba sis of hire charges.
  • 7.In case of sickness/emergency/injury/unfitness or inability of the drivers to continue perf orming their duty Safely and Satisfactorily to the concerned officer, the Railway reserves th e right to demand a change of Driver at anytime. Accordingly, it will be the duty of Contrac tor to make available suitable alternative driver to the satisfaction of concerned officer or h is authorized representative thereof within 1 hour failing which the Railway reserves the rig ht to impose suitable penalty as determined by DRM (W)/RNY. 8.: In case of break down, vehicles will have to be replaced within 1 (one) hour and if vehicl es are not provided within such period, suitable penalty as determined by DRM (W)/RNY for the entire period for which the vehicle/suitable replacement in lieu thereof is not made avai lable to the Railways may be imposed upon the contractor by the Railways. 9.: It would be contractors responsibility to pay any damage/compensation arising out of an y accident. Railways shall not reimburse any of such payment made by contractor. The con tractor shall abide by all statutory regulation like PF Scheme, Employees State Insurance A ct, Motor Vehicles Act and Other Rules etc. 11.: Railway will have no liability for vehicles or driver in case of any accident due to any c ause. 12.: Railway will have right to impose suitable penalty as determined by DRM (W)/RNY in c ase of late/non-availability of vehicle demand. 13.: Vehicle will be maintained to the highest standard. In case of any failure on road, Railw ay will have right to impose suitable penalty as determined by DRM (W)/RNY. 14.: The vehicle must turn up within half an hour in case emergencies even in off duty hour
  • s.The Contractor must provide Mobile/Land line No. to concerned officer wherein the call is to be made in off duty hours. In case the vehicle does not turn up within half an hour, the R ailway can engage other vehicle for the work and Contractor will be penalized double the c ost of paid by the Railways. In case of emergencies, the drivers may have to perform round the clock duty for which the Contractor will arrange the relief. The contractor will be paid th e normal charges as quoted by him deducting free charges even in case of emergencies. N o extra charges will be paid in case of emergencies and the vehicle called in off hours for i mportant Railway work.
  • 15.The Hired vehicle must have restarted commercial guide lines.
  • 16.All toll charges/Tax borne by the agency. Performance Guarantee (P.G) The successful bidder shall have to submit a Performance Guarantee (PG) equivalent to 5 % of the contract value within 30 days from the date of issue of Letter of Acceptance, vali d up to stipulated date of completion plus 60 days so that contract agreement can be exec uted. Performance guarantee at rate of 5% of the contractual value shall be deposited by t he successful bidder. The successful bidder shall have to submit a Performance Guarantee
  • (PG)valuing 5% of the contract value, within 30 (thirty) days from the date of issue of Lette r of Acceptance (LOA). Extension of time for submission of PG beyond 30 (thirty) days and upto the date of submission of PG from the date of issue of LOA may be given by the Autho rity who is competent to sign the contract agreement. However, a penal interest of 15% pe r annum shall be charged for the delay beyond 30 (thirty days, i.e. from 31st day after the date of issue of LOA. In case the contractor fails to submit the requisite PG after 60 days fro m the date of issue of LOA, a notice shall be served to the contractor to deposit the PG imm ediately how ever not exceeding 90 days from the date of issue of LOA). In case the contrac tor fails to submit the requisite PG even after 90 days from the date of issue of LOA, the co ntract shall be terminated duly forfeiting EMD and other dues, if any payable against that c ontract. The failed contractor shall be debarred from participating in re- tender for that wor
  • k.In case 90th day is a bank holiday or office closure next working day should be consider ed as the last day for submission of the PGs. Decision of Authority competent to sign the Co ntract Agreement would be final in case of any dispute.
