OPTION CLAUSE 25% : The buyer can increase or decrease the contract quantity or contract duration up to 25 percent at the time of issue of the contract. However, once the contract is issued, the contract quantity or contract duration can only be increased up to 25 percent. Bidders are bound to accept the revised quantity or duration. For lumpsum-based service contracts, the buyer may increase the scope of work and contract value up to 25 percent with the consent of the service provider

Buyer Added text based ATC clauses The bidders are advised to read the complete bid document along with the documents attached with the bi d under “Buyer uploaded ATC document”.

• 1.Apart from compliance of different Acts/Laws/Codes mentioned in the GeM bid/GTC/SLA, special attenti on of bidders is drawn towards compliance of extant Labour laws/codes by the contractors in respect of payment of minimum wages to drivers, issue of appointment letters and pay slips to the drivers. It may be noted that documents in support of payment to drivers i.e. bank statements of both firm and drivers, proof of deposit of EPF/ESIC etc., as applicable, will have to submitted by contractors along with tax inv oice/bill for claiming payment.
• 2.Bidders are requested to quote rates considering above requirement of compliance of payment of mini mum wages / EPF/ESIC deposit etc.
• 3.A minimum of 03 vehicles will have to be provided by successful bidder under the contract having follo wing parameters-
• a.The vehicles should fall under Premium Sedan or Premium SUV or Luxury Sedan or Luxury SUV se gments as defined by GeM and,
• b.The vehicles should have their manufacturing year in 2024, 2025 or 2026 and,
• c.The vehicles should be owned by the firm (service provider) or proprietor or any of the partners of the firm and.
• d.The vehicles should be registered in the state of Uttar Pradesh.
• 4.Following documents (as applicable) must be submitted along with the bid – 4.1 Documents pertaining to Financial Turnover of the firm, as per details mentioned in the bid. Exempt ion to MSEs and Startups is applicable on submission of requisite document. 4.2 Documents pertaining to Past Experience of the firm, as per details mentioned in the bid. Exemptio n to MSEs and Startups is applicable on submission of requisite document. 4.3 A format (Annexure-1) has been attached with the bid under “Buyer uploaded ATC document” whic h is to be submitted by bidder along with the bid providing following details of minimum 03 vehicles: Make/Model (Classification) of vehicle, Segment of Vehicle as per GeM, Manufacturing year of Vehicle, Registration Number, State of Registration of Vehicle and Name of owner.
• (i)The vehicles mentioned in Annexure-1 should fall under Premium Sedan or Premium SUV or Lu xury Sedan or Luxury SUV segment only as defined by GeM.
• (ii)The manufacturing year of vehicle should be 2024, 2025 or 2026. The manufacturing year as mentioned in the registration certificate shall be considered for this purpose.
• (iii)The vehicles should be owned by the firm (service provider) or proprietor or any of the partner s of the firm.
• (iv)The vehicles should either be registered in the state of Uttar Pradesh or a notarized affidavit as described below should be submitted. Please note that non submission of Annexure-1 will lead to rejection of offer. Copy of registration certificates of above 03 vehicles is to be submitted along with the bid. In case the vehicles mentioned in Annexure-1 are not registered in Uttar Pradesh at the time of bidding, th e firm will have to submit a notarized affidavit stating either of the following statement–
• (a)Firm will get its 03 vehicles already owned by firm/ proprietor/ partner, re-registered in U.P. withi n 30 days of award of contract. OR
• (b)Firm will purchase new vehicles in the name of firm/ proprietor/ partner and get it registered in U.
• P.within 30 days of award of contract. Non-submission of above notarized affidavit, where applicable, will lead to rejection of offer. Non-compliance of affidavit at later stage will result into banning of firm and other actions as per law. Payment to the firm shall be withheld till the firm submits proof of re-registration/registration of vehicles in U.P.
• 5.Firm should have a registered office in Lucknow. Documentary proof must be submitted along with the bid. If an office at Lucknow is not available at the time of bidding then firm shall open an office in Lucknow within 30 days of award of contract. If firm does not have any registered office in Lucknow then fir m has to submit a notarized affidavit with the bid that it will open an office in Lucknow within 30 days of award of contract. A supervisor on the payroll of firm shall be appointed by the firm in the office at Lucknow and a c omplaint redressal mechanism with landline / mobile phone working on 24 X 7 basis shall be provi ded. In the event of non-compliance of above two conditions, payment of bills shall be withheld an d contract is liable to be cancelled. Non submission of above notarized affidavit, where applicable, will lead to rejection of offer.
• 6.Payment of Extra per KM charges and Extra hour charges will be made as per GeM SLA for monthly b asis cab and taxi hiring services.
• 7.Toll and Parking will be paid extra as per actual on production of documentary evidence.
• 8.Bidders seeking exemption from submission of Earnest money should submit requisite document to support their claim of exemption.
• 9.Additional terms and conditions applicable in contract will be as per Annexure-3 attached under “B uyer uploaded ATC document”. Para 20 of Annexure-3 is superseded by para 5 above.
• 6.Before starting execution of contract, firm shall submit a list of vehicles and names of the drivers offer ed against the contract to the Stores Directorate and any subsequent change in vehicles/drivers shoul d also be intimated to Stores Directorate.
