  • 3.Turnover Bidder Turn Over Criteria: The minimum average annual financial turnover of the bidder during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the bidder is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria.
  • 4.Turnover OEM Turn Over Criteria: The minimum average annual financial turnover of the OEM of the offered product during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the OEM is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria. In case of bunch bids, the OEM of CATEGORY RELATED TO primary product having highest bid value should meet this criterion.

Bidder financial standing: The bidder should not be under liquidation, court receivership or similar proceedings, should not be bankrupt. Bidder to upload undertaking to this effect with bid.

Bidders are advised to check applicable GST on their own before quoting. Buyer will not take any responsibility in this regards. GST reimbursement will be as per actuals or as per applicable rates (whichever is lower), subject to the maximum of quoted GST %.

Buyer Organization specific Integrity Pact shall have to be complied by all bidders. Bidders shall have to upload scanned copy of signed integrity pact as per Buyer organizations policy along with bid. Click here to view the file

Data Sheet of the product(s) offered in the bid, are to be uploaded along with the bid documents. Buyers can match and verify the Data Sheet with the product specifications offered. In case of any unexplained mismatch of technical parameters, the bid is liable for rejection.

Experience Criteria: The Bidder or its OEM {themselves or through reseller(s)} should have regularly, manufactured and supplied same or similar Category Products to any Central / State Govt Organization / PSU for 3 years before the bid opening date. Copies of relevant contracts to be submitted along with bid in support of having supplied some quantity during each of the year. In case of bunch bids, the primary product having highest value should meet this criterion.

Installation, Commissioning, Testing, Configuration, Training (if any - which ever is applicable as per scope of supply) is to be carried out by OEM / OEM Certified resource or OEM authorised Reseller.

Malicious Code Certificate: The seller should upload following certificate in the bid:-

  • (a)This is to certify that the Hardware and the Software being offered, as part of the contract, does not contain Embedded Malicious code that would activate procedures to :-
  • (i)Inhibit the desires and designed function of the equipment.
  • (ii)Cause physical damage to the user or equipment during the exploitation.
  • (iii)Tap information resident or transient in the equipment/network.
  • (b)The firm will be considered to be in breach of the procurement contract, in case physical damage, loss of information or infringements related to copyright and Intellectual Property Right (IPRs) are caused due to activation of any such malicious code in embedded software.

Manufacturer Authorization:Wherever Authorised Distributors/service providers are submitting the bid, Authorisation Form /Certificate with OEM/Original Service Provider details such as name, designation, address, e-mail Id and Phone No. required to be furnished along with the bid

OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 50 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 50% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

The successful bidder has to supply all essential accessories required for the successful installation and commissioning of the goods supplied. Besides standard accessories as per normal industry practice, following accessories must be part of supply and cost should be included in bid price: As given in the Technical Specifications enclosed under Buyer Added Bid Specific ATC .

IMPORTED PRODUCTS: In case of imported products, OEM or Authorized Seller of OEM should have a registered office in India to provide after sales service support in India. The certificate to this effect should be submitted.

Availability of Service Centres: Bidder/OEM must have a Functional Service Centre in the State of each Consignee's Location in case of carry-in warranty. (Not applicable in case of goods having on-site warranty). If service center is not already there at the time of bidding, successful bidder / OEM shall have to establish one within 30 days of award of contract. Certificates

The bidder is required to upload, along with the bid, all relevant certificates such as BIS licence, type test certificate, approval certificates and other certificates as prescribed in the Product Specification given in the bid document.

Warranty period of the supplied products shall be 2 years from the date of final acceptance of goods or after completion of installation, commissioning & testing of goods (if included in the scope of supply), at consignee location. OEM Warranty certificates must be submitted by Successful Bidder at the time of delivery of Goods. The seller should guarantee the rectification of goods in case of any break down during the guarantee period. Seller should have well established Installation, Commissioning, Training, Troubleshooting and Maintenance Service group in INDIA for attending the after sales service. Details of Service Centres near consignee destinations are to be uploaded along with the bid.

Successful bidder will have to ensure that adequate number of dedicated technical service personals / engineers are designated / deployed for attending to the Service Request in a time bound manner and for ensuring Timely Servicing / rectification of defects during warranty period, as per Service level agreement indicated in the relevant clause of the bid.

Timely Servicing / rectification of defects during warranty period: After having been notified of the defects / service requirement during warranty period, Seller has to complete the required Service / Rectification within 3 days time limit. If the Seller fails to complete service / rectification with defined time limit, a penalty of 0.5% of Unit Price of the product shall be charged as penalty for each week of delay from the seller. Seller can deposit the penalty with the Buyer directly else the Buyer shall have a right to recover all such penalty amount from the Performance Security (PBG).Cumulative Penalty cannot exceed more than 10% of the total contract value after which the Buyer shall have the right to get the service / rectification done from alternate sources at the risk and cost of the Seller besides forfeiture of PBG. Seller shall be liable to re-imberse the cost of such service / rectification to the Buyer.

  • 23.Past Project Experience Proof for Past Experience and Project Experience clause: For fulfilling the experience criteria any one of the following documents may be considered as valid proof for meeting the experience criteria:a. Contract copy along with Invoice(s) with self-certification by the bidder that service/supplies against the invoices have been executed.b. Execution certificate by client with contract value.c. Successful Bidder can submit the Performance Security in the form of Fixed Deposit Receipt also (besides PBG which is allowed as per GeM GTC). FDR should be made out or pledged in the name of AIIMS Patna A/C (Name of the Seller). The bank should certify on it that the deposit can be withdrawn only on the demand or with the sanction of the pledgee. For release of Security Deposit, the FDR will be released in favour of bidder by the Buyer after making endorsement on the back of the FDR duly signed and stamped along with covering letter. Successful Bidder has to upload scanned copy of the FDR document in place of PBG and has to ensure delivery of hard copy of Original FDR to the Buyer within 15 days of award of contract.

Buyer Added text based ATC clauses

  • 1.Delivery period of 75 days includes Supply, installation, testing, commissioning of Goods and LD will be charged accordingly on total in case of delay in any part.
  • 2.L1 will be determined based on the total value, which includes the cost of equipment ( whole set) with warranty, required Standard Transducers, required accessories/consum ables/reusables/disposables, CAMC charges, and all expenses related to the supply, ins tallation, testing, and commissioning of the goods. Note: The system manufacturer shall additionally provide onsite product training and access to an ultrasound education website for end users during installation, at no additional cost.
  • 3.Bidders must submit valid CDSCO License(s)/State Licensing Authority (SLA) License(s) applicable to the category/class of the Medical Device being offered.
  • 4.CAMC of the Medical Equipment whose CAMC rates is already specified in Contract document will be started automatically after completion of warranty period. Intimation regarding the initiation of CAMC can be given by both the parties. Performance Bank Guarantee deposited if any by seller wil l be returned after receiving the fresh PBG of 5% of Equipment value for the specified CAMC durati on.
  • 5.Any common parameter displayed under additional specification parameter will supersede the ca talogue specification. The bidder shall comply with all the specifications stipulated in the Buyer uploaded ATC document and provide all required accessories/consumables/reusables/disposables in the prescribed quantiti es along with the equipment. The specifications under Buyer Added Bid Specific ATC shall be treated as mandatory technical compliance requirements for the purpose of technic al evaluation. Compliance with these specifications shall form part of the technical evaluation.
  • 6.The bidder shall submit a satisfactory past performance certificate for the same make and model being quoted, duly signed & stamped by the Head of the Institution or an A uthorized Signatory of the concerned institute/organization. Submission of this certific ate is mandatory, and it shall form part of the technical evaluation. Failure to submit t he same may lead to rejection of the bid.
  • 7.Bidders must deposit the Earnest Money Deposit (EMD) preferably online via NEFT/RT GS/internet banking to the following account and Bidder to indicate bid number and na me of bidding entity in the transaction details filled at the time of on-line transfer.   • 8.Demonstration may be asked from the participated bidders during the technical evalu ation stage on bidder's own cost.
  • 9.One Bid per Principal: Only one bid will be considered from a single principal. This means:-
  • a)If a manufacturer submits a bid, the bids of its authorized dealer for the same item wil l not be considered and the Earnest Money Deposit (EMD) for the dealer’s bid will be r eturned.
  • b)An agent cannot represent two different manufacturers or quote on their behalf in the same tender inquiry.
  • c)A manufacturer can only authorize one agent / dealer to bid on its behalf.
  • d)If related entities (e.g., holding company with multiple manufacturing units, sister con cerns) submit multiple bids, all proposal may be disqualified.
  • 10.Bid Specific OEM Certificate:- The OEM certificate, if submitted by the bidder, must be specific to this bid. It should clearly menti on the Bid number and item name, and must also include the OEM’s official contact details (email, phone number and address) to enable cross – verification of its authenticity by the procuring entit

  • 11.This item is listed at S.N.190 under GTE exemption list dt 17.02.2025. Non-local/Class 1/Class 2 supplier can participate in this bid.
  • 12.Common IP addresses: The received bids having matching/common IP address with either Bidder(s)/Seller(s) or Buyer, sha ll be summarily rejected and shall not be considered for further evaluation.
  • 13.Penalty: The following Penalties shall be imposed at any stage, under this tender for non-performance:
  • a.Imposition of Liquidated Damage;
  • b.Forfeiture of EMD/Performance Security;
  • c.Termination of Contract;
  • d.Blacklisting/Debarring of bidder
  • 14.Termination: Without prejudice to Buyer’s right to notice adjustment by way of discount or any other right or re medy available to Buyer, Buyer may terminate the Contract or any part thereof by a written notice to the Seller, if the Seller:
  • a.fails to comply with any material term in the Contract, or any part thereof within the stipulated Delivery Period;
  • b.informs Buyer of its inability otherwise becomes apparent that the Seller is unable to deliver the Materials or any part thereof within the stipulated Delivery Period;
  • c.fails to rectify any rejected defective Materials promptly;
  • d.makes or becomes bankrupt, goes into liquidation;
  • e.makes a general assignment for the benefit of creditors;
  • f.A receiver is appointed for any substantial portion of property owned by the Seller;
  • g.has misrepresented to Buyer, acting on which misrepresentation Buyer has placed th e purchase order on the seller.
  • 15.Affidavit: "The successful bidder shall submit an affidavit on Rs. 100/- non-judicial stamp paper that it has n ot been blacklisted/debarred in past by any Government/Semi government / PSU and there is no v igilance/ CBI/any other case pending against the successful bidder/supplier.” 16. “Dispute Resolution & Governing Law” : In the event of any dispute/difference, the Parties herein shall endeavor to settle such dis pute amicably. If the parties fail to settle their dispute/difference amicably within 30 days, the matter ma y be referred by either party for resolution of dispute through Mediation, in accordance wi th the Mediation Act, 2023. The cost of Mediation shall be shared by the parties equally. The courts at Patna shall have exclusive jurisdiction on the issues arising from this Contra ct.
  • 17.Bidder / OEM has to give an undertaking that after expiry of warranty period, it will pr ovide Comprehensive Maintenance Service for next 8 years for the offered products at the rate not more than 5% of contract price per annum. Buyer reserves the right to enter in to a CAMC agreement with the Successful Bidder / OEM after expiry of the Warranty period at the quoted rate and the payment for the CAMC charges would be made Biannually after rendering of t he CAMC Services of the relevant CAMC period. Performance Security of the successful bidder shal l be forfeited if it fails to accept the CAMC contract when called upon by the buyer. CAMC would in clude cost of equipments with accessories, spare parts, consumables except single used consuma bles (Upload the undertaking). The original Performance Security of contract will be returned o nly after submission and verification of CAMC Performance Security.

  • (17)Availability of Service Centres: Bidder/OEM must have a Functional Service Centre i n the Bihar in case of carry-in warranty. (Not applicable in case of goods having on-site w arranty). If the Bidder/OEM does not have a functional Service Centre in Bihar at the time of bidding, the successful Bidder/OEM shall submit an undertaking co nfirming that a functional Service Centre will be established within 30 days fro m the date of award of the contract. Payment shall be released only after submission of documentary evidence confirming th e establishment and functioning of the Service Centre.
  • (18)Bidder / OEM has to give an undertaking that after expiry of warranty period, it wil l provide Comprehensive Maintenance Service for next 8 years for the offered products a t the rate not more than 5% of contract price per annum.

  • (a)This is to certify that the Hardware and the Software being offered, as part of the con tract, does not contain Embedded Malicious code that would activate procedures to :-
  • (i)Inhibit the desires and designed function of the equipment.
  • (ii)Cause physical damage to the user or equipment during the exploitation.
  • (iii)Tap information resident or transient in the equipment/network.
  • (b)The firm will be considered to be in breach of the procurement contract, in case physi cal damage, loss of information or infringements related to copyright and Intellectual Pro perty Right (IPRs) are caused due to activation of any such malicious code in embedded software. .
