OPTION CLAUSE 50% : The buyer can increase or decrease the contract quantity or contract duration up to 50 percent at the time of issue of the contract. However, once the contract is issued, the contract quantity or contract duration can only be increased up to 50 percent. Bidders are bound to accept the revised quantity or duration. For lumpsum-based service contracts, the buyer may increase the scope of work and contract value up to 50 percent with the consent of the service provider

Successful Bidder has to upload scanned copy of the FDR document in place of PBG and has to ensure delivery of hard copy of Original FDR to the Buyer within 15 days of award of contract.

• 1.The ATC document may kindly be referred and read thoroughly before bidding.
• 2.The EMD is to be deposited through online transfer only and proof of payment is to be submitted as part of the confirmatory documents submitted by the bidder in the GeM bid.

• 4.The PSD to be deposited shall be 5% of Annualized contract value (Including fuel charges and GST) (i.
• e.2.5% of contract value as the subject contract is for 2 years) as per latest standard NIT modifications circulated by GM(E&M)/HOD, WCL HQ. However, GeM portal does not have the requisite functionality f or the same as the quoted amount sought is for Hiring charges only. Therefore, Initial performance sec urity to be deposited by the successful bidder shall be read as "IPSD is to be deposited by the contract or within 21 days of issue of LOA. The IPSD amount will be as sought in LOA or GeM contract W HICHEVER IS HIGHER. Please note that in case of non-deposition of full IPSD amount within stipulated time frame, the LOA/GeM contract is liable to be rescinded/terminated and the c ontractor is liable to be debarred from participating in the future tenders of WCL/CIL for a minimum period of one year".
• 5.In case of exemption of EMD the scanned copy of document (attested by notary public) in support of e xemption will have to be uploaded by the bidder during bid submission. However, this option is to be e nabled only in those cases where the exemption of EMD to some bidders is allowed as per NIT. The EM D exemption shall be accorded for MSE registered firms based on the availability of the following codes in the MSE registration (49223,49224 for Hiring of LMV tenders; 49231 for Hiring of truck tenders; 492 21,49225 for Hiring of buses; 86909 for Hiring of Ambulance). Please note that if EMD has not been su bmitted by the bidder and their MSE registration does not contain the above-mentioned codes for corre sponding tenders, then their bid is subject to rejection and appropriate action for recovery of said EMD will be initiated by the Area if applicable.
• 6.In case the L-1 Bidder fails to submit requisite documents online as p er NIT or if any of the information/declaration furnished by L-1 Bidder i s found to be wrong by Tender Committee during evaluation of scanne d documents uploaded by Bidder, which changes the eligibility status of the Bidder, then his bid shall be rejected and EMD of L-1 Bidder will be forfeited and retender as per the existing requirement will be done. No shortfall/ no documents to be recycled for ECV less than 50 Lakhs (Single cover tender).
• 7.The Contractor shall not employ or terminate his worker without the knowledge of the mi ne management.
• 8.Medical facilities shall be extended to contractor workers (limited to applicable company policy).
• 9.Recommendations of "11th conference on safety in mines held on 4th and 5th July 2013 at New Delhi" and further safety conferences shall also be applicable (limited to company poli cy).
• 10.Price Break Up to be submitted as per Format mentioned in the Price Break Up Document. The quoted amount shall be inclusive of Hiring Charges, Fuels Charges and GST. .
