OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Bidder financial standing: The bidder should not be under liquidation, court receivership or similar proceedings, should not be bankrupt. Bidder to upload undertaking to this effect with bid.

Bidders are advised to check applicable GST on their own before quoting. Buyer will not take any responsibility in this regards. GST reimbursement will be as per actuals or as per applicable rates (whichever is lower), subject to the maximum of quoted GST %.

Data Sheet of the product(s) offered in the bid, are to be uploaded along with the bid documents. Buyers can match and verify the Data Sheet with the product specifications offered. In case of any unexplained mismatch of technical parameters, the bid is liable for rejection.

Installation, Commissioning, Testing, Configuration, Training (if any - which ever is applicable as per scope of supply) is to be carried out by OEM / OEM Certified resource or OEM authorised Reseller.

Manufacturer Authorization:Wherever Authorised Distributors/service providers are submitting the bid, Authorisation Form /Certificate with OEM/Original Service Provider details such as name, designation, address, e-mail Id and Phone No. required to be furnished along with the bid

• 7.Turnover Bidder Turn Over Criteria: The minimum average annual financial turnover of the bidder during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the bidder is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria.
• 8.Turnover OEM Turn Over Criteria: The minimum average annual financial turnover of the OEM of the offered product during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the OEM is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria. In case of bunch bids, the OEM of CATEGORY RELATED TO primary product having highest bid value should meet this criterion.

Escalation Matrix For Service Support : Bidder/OEM must provide Escalation Matrix of Telephone Numbers for Service Support.

ISO 9001: The bidder or the OEM of the offered products must have ISO 9001 certification.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Buyer Added text based ATC clauses

• 1.Only Original Equipment Manufacturers (OEM) or their authorized reseller is eli gible to participate in the bid. If the bidder is not the OEM, a valid, bid-specific a uthorization certificate issued by the OEM should be submitted and if the bidder claims to be the OEM, documentary evidence such as Factory Licence, Manufact uring Registration Certificate or any other valid proof should be submitted. With out such certificates, their bid may not be considered for further evaluation.
• 2.The Bidder should submit copies of Purchase Orders for similar equipment supplied to IITs, NITs, Central Universities, Government Research Organiza tions, Government Institutions, PSUs or other reputed Government Organiz ations during the last three (03) years. The bidder shall also submit corres ponding Installation Report or CRAC or any other satisfactory proof of succ essful delivery/ installation.
• 3.The original product catalogue/brochure of the equipment should be submi tted along with the technical bid. The catalogue shall clearly indicate the of fered make, model and specifications. Original catalogue should not be pri nted on letter head. Buyer reserves the right to seek clarification in case o f any discrepancy or ambiguity.
• 4.Genuine Authorization certificate in a proper channel of EDWinXP Software must be submitted along with the technical bid.
• 5.Bidder should submit valid ISO 9001 / ISO 45001/ISO 14001 certificate.
• 6.All equipment should carry 01 Year comprehensive onsite warranty from th e date of successful installation. The bidder must submit an undertaking on their letterhead regarding the provision of warranty; otherwise, the bid will not be considered.
• 7.The quoted prices should be strictly F.O.R. Destination and inclusive of GST , packing, forwarding, freight, unloading, installation, and commissioning at the designated site/location of NIT Patna.
• 8.Payment will be released only after satisfactory delivery, installation, com missioning, demonstration and acceptance of the equipment by the user d epartment and completion of all contractual formalities as per GeM provisi ons.
• 9.Bidder should not have been debarred/blacklisted by any State Governmen t / Central Government institution/department for any reason in the previo us 03 financial years. In this regard, the bidder has to submit an affidavit o n a non-judicial stamp paper of Rs. 100/- or above duly certified by a notar y as per the attached format (Annexure – II). The said affidavit must be iss ued against this tender.
• 10.If any information, declaration or document submitted by the bidder is fou nd to be false, fabricated, misleading or suppressed at any stage of the pro curement process, the bid shall be liable for rejection and suitable action, a s deemed fit, may be initiated against the bidder in accordance with the pr ovisions of GeM, GFR and other applicable Government guidelines.
• 11.The Buyer reserves the right to verify any information or document submitted by the bidder from the issuing authority, OEM or any other appr opriate source and may seek any additional document or clarification durin g the evaluation process. Failure of the bidder to furnish the required clarifi cation or documents within the stipulated time may result in rejection/disq ualification.
• 12.Earnest Money Deposit (EMD): Bidder has to submit bid security declaration in lieu of EMD as per Annexure – I attached under ATC. .
