OPTION CLAUSE 50% : The buyer can increase or decrease the contract quantity or contract duration up to 50 percent at the time of issue of the contract. However, once the contract is issued, the contract quantity or contract duration can only be increased up to 50 percent. Bidders are bound to accept the revised quantity or duration. PAYMENT OF SALARIES AND WAGES: Service Provider is required to pay Salaries / wages of contracted staff deployed at buyer location first i.e. on their own and then claim payment from Buyer alongwith all statutory documents like, PF, ESIC etc. as well as the bank statement of payment done to staff.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

• I)SPECIAL TERMS AND CONDITIONS: 1) The contractor shall be responsible for maintaining of log book/register for observi ng all statutory obligations in respect of the safety of equipment’s and personnel in a ccordance with rules and acts i.e. EPF, ESIC,Professional Tax etc. Contractor shall rep lace the working personal immediately. 2) OFCH will not be party to any kind of dispute that may arise between the contracto r and contractual individual to be engaged by them. All other standard terms and con dition including Penalty/Fine clause as per GeM SLA/GTC will be applicable. In case, if the dispute between the contractor and labourer is not getting settled and the servic es that are to be fulfilled by the contract agreement are being adversely effected, OF CH will take action as per the penalty clauses and at the max close the contract and f orfeit the PSD and disburse the minimum wage payment to labourer engaged being t he principal employer as per rule, and if any legal action is required further the decisi on will be taken by competent authority. 3) Services & prices on FOR O F Chanda basis. 4) Inspection at OFCH premises. In case of the non-availability of the personnel because of any other reason, the fir m will provide replacement to the satisfaction of OFCH on the next working day. 11)The information shall be confidential in nature. Therefore, the firm is to mak e sure that the same is not leaked out in any manner to lend in unauthorized ha nds. The firm entrusted with the work shall sign a Non-Disclosure Agreement wi th OFCH and same to be notarized on Rs. 100 stamp paper. 12)False declaration or omissions will result in disqualification and forfeiture of t he security deposit. 13)Firm to claim the present month bill before 7th day of succeeding month. 14)Vendor has to submit full set of GST Certificate along with bid documents giving details of managing/whole-time directors and key managerial persons. 15) 100% payment within 30 days after completion of service at OFCH along wit h all requisite documents. The firm has to submit proof of GST remittance which shall be verified before release of payment. 16)The firm has to submit relevant document to claim exemption for Experience and Turnover. 17)) Scope of Work and Other Terms and Conditions as per Annexure -A and An nexure-B enclosed. 18) TE is for hiring of service of skilled/unskilled workers from locally available bidder s only i.e. reserved for class-I local supplier. 19) New Labour Codes are Applicable : i)As per New labour code payment of contract worker done before before 7th day of succeeding month. ii) Iss ue of Appointment letter to every Employee iii) Issue of payment slip t o Contract worker. iv) LIN(labour identification Number required v)Ann ual health Examination/Test of Engaged Contract workers. . 20) The firm is required to submit a Performance Security Deposit equivalent to 5% o f the contract value in the form of an Insurance Security Bond.
