Bidder financial standing: The bidder should not be under liquidation, court receivership or similar proceedings, should not be bankrupt. Bidder to upload undertaking to this effect with bid.

Bidder shall submit the following documents along with their bid for Vendor Code Creation:

• a.Copy of PAN Card.

• c.Copy of Cancelled Cheque.
• d.Copy of EFT Mandate duly certified by Bank.

Malicious Code Certificate: The seller should upload following certificate in the bid:-

• (a)This is to certify that the Hardware and the Software being offered, as part of the contract, does not contain Embedded Malicious code that would activate procedures to :-
• (i)Inhibit the desires and designed function of the equipment.
• (ii)Cause physical damage to the user or equipment during the exploitation.
• (iii)Tap information resident or transient in the equipment/network.
• (b)The firm will be considered to be in breach of the procurement contract, in case physical damage, loss of information or infringements related to copyright and Intellectual Property Right (IPRs) are caused due to activation of any such malicious code in embedded software.

OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 50 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 50% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Warranty period of the supplied products shall be as given in specifications from the date of final acceptance of goods or after completion of installation, commissioning & testing of goods (if included in the scope of supply), at consignee location. OEM Warranty certificates must be submitted by Successful Bidder at the time of delivery of Goods. The seller should guarantee the rectification of goods in case of any break down during the guarantee period. Seller should have well established Installation, Commissioning, Training, Troubleshooting and Maintenance Service group in INDIA for attending the after sales service. Details of Service Centres near consignee destinations are to be uploaded along with the bid.

• 10.Ration Item ATCs Demurrage charges In case the rejected items are not lifted by the firm within 48 hrs, the demurrage charges at the rate of 0.5% of total contract value will be charged per day. Weight of packing material will not be included in quantity supplied and only net weight of the items will be counted. The packing should be of standardized weights of appropriate size. All such fi rms shall invariably enclose copy of valid SSI/NSIC/MSE registration certificate t o claim EMD exemption and to submit EMD declaration. All Benefits as per Govt. Guide lines are applicable to MSE firms. The EMD amounts of unsuccessful bidders will be returned after finalization of the order. EMD amount of successfu l bidder will be released after submission of PBG 6 . Price Break up format is to be forwarded to the mail I D bids- shipbuilding@hslvizag.in at the time of bid submission to HSL with password pro tection and the same should be inline with the price submitted in the portal. In case of ambiguity in quoted prices, prices which are advantageous to HSL shall be considered
• 7.Your offer price in GeM portal shall include P&F, Freight and transit insurance and MTC charges etc.
• 8.Class inspection charges/MTC Charges/Type approval charges if any are to be included in your quote. Order shall be placed as per the quoted rate in GeM port al. Extra charges if any beyond GeM rates shall not be entertained.
• 9.E-PBG/ISB @5% of the order value is to be submitted within 30 days from th e date of placement of order by HSL as per the HSL PBG format which is enclose d in declarations.
• 10.Comply the guarantee clause as per tender tech spec.
• 11.Any delay in supply beyond the time period as per order shall be liable for L D at the rate of 0.5% per week after due date for the part of delayed order subj ect to a maximum 10% of order value.
• 12.Applicable Loadings towards any commercial deviations is not applicable for the tenders floated through GeM portal. Hence offers taking deviations towards commercial terms shall be rejected commercially.
• 13.HSL will release SAP purchase order initially as per the delivery time lines sti pulated in the tender terms and conditions i.e as per TTS. Hence delivery time li nes shall be considered from SAP PO only but not as per GeM PO. .
