OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 50 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 50% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Buyer Added text based ATC clauses Pre-qualification/ Eligibility Criteria:The bidder must have successfully supplied “Ethyl Acetate” as per IS-229-2021 to any Central Govt./State Govt. organization/PS U/Public Listed Company before the Bid Submission End Date. Note: The quoting firm must submit copy of original Purchase Order issued by the bu yer along with

  • (a)Supporting documents in support of successful supply & acceptance of minimum 60% of the ordered quantity OR
  • (b)Self-declaration of successful supply on prescribed format of “Annexure-S” (attach ed) along with the bid. Note: The above order must be placed within last 10 Years from the Bid publication d ate. Distribution of tender Quantity:As a strategic requirement, quantity distribution i n the ratio of 60:40 is being opted in the present bid. In case of 60:40 between L1 & L2, on denial of L1 rate by L2 firm, the quantity of L2 will be offered to L3, L4, L5, ...... .. firms sequentially. In case of denial by L2, L3, L4......., the fully quantity shall be loa ded on L1 firm subject to L1 firm has quoted for the full qty. Moreover in case of acce ptance of L1 rate by multiple firm viz. L2,L3,L4,L5..........the purchase preference will be given to lowest quoting firm. Packing Condition: Packing should be in galvanized iron drum only. Packing & Marking: Each container shall be marked with the following:
  • a)Name and grade of the material.
  • b)Indication of the source of manufacture.
  • c)Gross and net mass.
  • d)Month and year of manufacture, and
  • e)Batch or code number (if applicable). Test Certificate-Required, the firm shall provide test certificate with each consign ment in confirmation with bid specification Unloading at OFI Godown will be in contractor’s scope. Special Note:
  • 1.Right of Access: Rep of OFI, OFI’s Customer, and other regulatory authorities shall hav e access to supplier’s facility and all other facilities involved in fulfillment of the Purc hase Order, where they shall have access to all procedures, practices, processes, ass ociated documents, and records related to quality assurance, quality control, and co nfiguration control. The supplier shall notify OFI in writing to any significant facility or organizational changes such as company name, location, or senior quality managem ent. OFI reserves the right to audit for compliance of all the requirements.
  • 2.Record Retention: Supplier shall retain quality records for a minimum of 20 years fro m the date of acceptance in OFI in original form or in electronic form. The quality rec ords include COC, Test reports, Raw Material Test reports, Special Process certificatio ns, Route cards (if applicable) and Calibration records. This data shall be made availa ble upon request. Records shall be appropriately identified, secured and stored prop erly to prevent deterioration or damage and to prevent loss.
  • 3.Disposition Requirement: Supplier shall ensure that non-confirming products are iden tified and properly dispositioned as required by supplier’s procedures. Only product t hat confirms to specified requirements shall be shipped to OFI. Disposition of Use As I s or Repair for products shall require written authorization from OFI. OFI reserves the right to audit for compliance. Any reworked parts shall be re-inspected and / or teste d prior to shipment.
  • 4.Prevention of counterfeit parts: The supplier shall have a program in place to prevent delivery of counterfeit parts and materials to OFI. All parts, materials and as semblies delivered to OFI shall be procured directly from OEM or their authorized de alers/distributors. If it is determined in a specific instance that this is not possible, th e same to be intimated to OFI for their disposition. The supplier is responsible for the flow down of this requirement to its sub-tier vendors and their compliance to it. .
