OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

• A)The successful bidder shall have to deposit the performance security of 3% of the value of the contract in shape of Deman d Draft, Fixed Deposit Receipt (FDR) from a commercial bank pledged to Accounts Officer, State Motor Garages Department , J&K within a period of 7 days after declaration as L1 in the Fi nancial bid, and the same shall be released after successful c ompletion of warranty period taken into account from the date of commissioning of the vehicles/supplies.
• B)The bidders shall submit a copy of Tax Clearance Certificate f rom Income Tax Department for the last 2 assessment years/ 6 assessment quarters.
• C)The bidders shall have to upload specifications as per the no menclature mentioned in the specifications column of BoQ ba sed GeM Bid of the “Refrigerated vehicle” and “Mobile Di sease Quality/Testing laboratory vehicle”, with the relevant Test Report Certificate(S) issued by any GoI recognized agenc y dedicated for Homologation & Testing of Automobiles, C&T v ehicles, etc.
• D)The bidders shall provide Name and Address of the firm (Addr ess of the Head Office and Local Branch Office.
• E)The bidders shall submit a copy of PAN Card.
• F)The bidders shall submit a copy of Goods & Service Tax Regis tration Certificate.
• G)The bidders shall submit a copy of the List of their Authorized Service Centers available in the UT of J&K (with contact numb ers of Service Heads).
• H)GST Return Certificate (latest).
• I)GST return certificate latest. ADDITIONAL TERMS & CONDITIONS
• 1.In case of breach of any part of agreement at any time at the end of the successful bidder (L1), the agreement shall be term inated summarily by the Department. Besides, penalty shall b e imposed by way of forfeiture of performance security of 3%, and the bidder shall be barred from supplying the vehicles in t he UT of J&K.
• 2.Disputes, if any, shall be settled by the Courts within the juris diction of J&K UT only (Srinagar/ Jammu).
• 3.Financial bid of only those bidders shall be opened who qualif y the technical bid.
• 4.The Department shall place the GeM purchase order in respe ct of the quantity mentioned in the BOQ figuring at schedule N o: I & II only after the completion of the Reverse auction. How ever the GeM contract in respect of quantity mentioned in the BOQ at Schedule No. III to V shall be placed as and when fund s/consent received from the concerned department. Further, the participant bidders shall have to participate in all t he schedules and have to quote the same rates as per the product in reverse auction bidding as well.
• 5.The L1 has to supply the “Refrigerated vehicle and “Mobi le Disease Quality/Testing laboratory vehicle”, strictly as p er the specifications laid in the given BOQ based GeM bid.
• 6.Warranty period of “Refrigerated vehicle” and “Mobile Di sease Quality/Testing laboratory vehicle”, shall be for a per iod of at least two (2) years from the date of commissioning of the supplies. In case of detection of any defects and/or prema ture failures of the same during the aforesaid period, the nece ssary repairs shall have to be carried out by the supplier free of cost (FOC).
• 7.Rates shall be quoted for destination i.e. The Directorate of Fishe ries Srinagar, and should be inclusive of all Taxes, Registration, Li fe Time Road Tax as applicable, Freight Charges as per Terms & Conditions mentioned in the BoQ based GeM Bid, for fully built-u p end product. However, any tax variation shall be allowed at the time of delivery of the supplies.
• 8.No interest shall be paid on Performance Security, and that of un successful bidders shall be returned immediately after completio n of the bidding process.
• 9.All the bidders shall have to upload the Letter of Acceptance of t he Clauses mentioned in the Terms & conditions of the bid duly s ealed and signed by the senior Executive of the company.
• 10.No terms & conditions of the bidders and/or L1/supplier shall be entertained by the Department.
• 11.The successful bidder (L1) shall have to enter into an agreement with the department, duly signed on the Judicial paper of Rs.100/- by the authorized senior executive of the successful bidder L1 (c ompany).
• 12.The State Level Purchase Committee can stop the process of pro curement at anytime and can exercise options whatsoever, in the interests of the Government.
• 13.State Level Purchase Committee reserves right to accept or reje ct any bid at any time without assigning any reason thereof.
• 14.Delivery should be made within 120 days from the date of a cceptance of prototype by the Department.
• 15.The supplier shall have to supply the vehicles manufactured during the year 2026 onwards.

• 17.Bidders shall submit their past client list with performance, if an

• 18.A certificate to the effect that the rates charged are not higher t han those being charged in the UT of J&K be recorded in the bill/invoices. 19. 100% payment shall be released within 30 days from the dat e of delivery/commissioning of “Refrigerated vehicle” and “Mobile Disease Quality/Testing laboratory vehicle” at Dir ectorate of Fisheries Kashmir , subject to below : a./Satisfactory inspection report to be carried out through 3rd party at the plant/body building site of the manufacturer at t he structural stage i.e. 1st Stage (Prototype). b./ Satisfactory inspection report at final stage. c./ Besides after registering the supplied vehicles from the co ncerned Registering authority.
• 20.Inspection of the “Refrigerated vehicle” and “Mobile Dis ease Quality/Testing laboratory vehicle” shall be carried ou t through 3rd party i.e Central Institute of Road Transport (CIR
• T)or any other designated agency of Government of India in p resence Technical committee of officers nominated by State M otor Garages Department at the plant/ body building site of th e manufacturer at the structural stage i.e. 1st Stage (Prototyp
• e)and at final stage (Commissioning site). The Inspection shal l have to be arranged by vehicle manufacturer/Successful bid der and shall bear all charges of 3rd party inspection expense s, including Boarding, Lodging, Air fare etc of the nominated o fficers and the successful bidder is required to communicate t he dates of inspection well in advance to this Department so t hat the required arrangements are made accordingly.
• 21.Both the Principal Vehicle Manufacturer (OEM) and the nomin ated authorized dealer/Fabricator shall be responsible for the warranty of the entire product and the after sale service withi n the UT of J&K. .

Participation by the bidder in RA process would be considered as their consent for extension in offer validity by 30 days by the date of RA initiation.
