OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Buyer Added text based ATC clauses

  • 1.Payments shall be made to the Seller within 90 days (45 days for Micro and Small Enterprises and 60 da ys for Medium Enterprises, as per the relevant act in force) on receipt and acceptance of material.
  • 2.Vendor to offer delivery schedule in line with BHEL tender requirement (i.e., 90 days from date of PO).Of fers of vendors whose quoted delivery does not fall under BHEL' s requirement range, may not be consider ed.
  • 3.Breach of Contract, Remedies and Termination- In case of breach of contract, BHEL may resort to recove r 10% of the total contract value through various financial remedies such as security instruments like Perfo rmance Bank Guarantee, bills of the supplier, retention amount etc. with BHEL or opt for legal remedies.Fu rther, levy of liquidated damages, debarment, termination, de- scoping, short-closure, etc. shall be applied as per provisions of the contract.
  • 4.Offers of vendors who are debarred / under interim suspension in BHEL Bhopal or at BHEL corporate lev el shall not beconsidered in the tender. The list of debarred firms is available on the BHELwebsite (www.bh el.com ).
  • 5.If any seller has any objection/ grievance against these additional clauses or on any aspect of this bid , t hey can raise their representation against the same by using the Representation window provided in the bi d details field in Seller dashboard after logging in as seller within 4 days of bid publication on GeM.
  • 6.For the items in bid, applicable GST rate is @18% and Cess rate @ zero% for GST registered firm / bidder . As cess is not applicable on these items, it is mandatory to quote cess rate as zero%. Bids with Cess rate other than zero% are liable to be rejected at any stage of tender even after price bid opening.
  • 7.Unless covered under force majeure conditions, a penalty of 0.5% of the undelivered portion per week of delay (or part thereof) will apply, up to a maximum of 10% of the undelivered order value. The undelivered value will be considered item-wise or lot-wise as per the purchase order.
  • 8.IMPORTANT NOTE FOR BILL SUBMISSION: The facility for online invoice registration and document uploa d has been enabled in the SUVIDHA Portal (https://suvidha.bhel.in/suvidha/) for all BHEL Suppliers and Con tractors with an aim to streamline the receipt of invoices and other documents such as test certificates dir ect from vendor. It will facilitate faster clearance of vendor bills for payment. However, hardcopies are also required which should be sent to concerned purchase officer.
  • 9.Grievance Redressal Mechanism: To promote transparency and ensure fair treatment of all bidders, a structured Grievance Redressal Mecha nism is in place to address any concerns or issues arising during the tendering process or in subsequent b usiness dealings with the company. Suppliers/ Contractors are requested to follow the below escalation pro cess for grievance resolution: First Level: Any grievance should initially be addressed to the designated Dealing officer, whose contact d etails are provided in the NIT /Contract. Second Level: If the issue remains unresolved, it may be escalated by lodging a formal grievance throught he SUVIDHA portal: (https://suvidha.bhel.in/suvidha/). Responses will be provided in accordance with the d efined escalation matrix.
  • 10.Vendor to submit 4 sets of TC/GC with all test results along with material supply.
  • 11.Bidders causing inordinate delay in supply of items maybe rejected in the next tenders. .
