OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Manufacturer Authorization:Wherever Authorised Distributors/service providers are submitting the bid, Authorisation Form /Certificate with OEM/Original Service Provider details such as name, designation, address, e-mail Id and Phone No. required to be furnished along with the bid

• 3.Sample Clause After award of contract – Successful Bidder shall have to get advance sample approved from buyer before bulk manufacturing / starting bulk supplies. Successful Bidder shall submit 1 samples for Buyer's approval, within 5 days of award of contract. Buyer shall, as per contract specifications framework, either approve the advance sample or will provide complete list of modification required in the sample within 5 days of receipt of advance sample. Seller shall be required to ensure supply as per approved sample with modifications as communicated by Buyer. If there is delay from buyer side in approval of advance sample – the delivery period shall be refixed without LD for the period of delay in sample approval. In case, the sample is found to have major deviations / not conforming to the Contract specifications, the buyer at its discretion may call for fresh samples for approval before allowing bulk supplies or may terminate the contract after notifying the deviations to the seller. Unless otherwise provided in the contract, all samples required for test shall be supplied by the contractor free of cost. Where under the contract, the contractor is required to submit an advance sample, any expenses incurred by the contractor on or in connection with the production of stores in bulk, before the sample has been approved unconditionally shall be borne by the Seller and he shall not claim any compensation in the event of such sample being found unacceptable by the Buyer / Consignee.

• 1.Documents required for seller: The bidder are advised to upload all the documents carefully till closing date of bid. No documents which uploaded or submitted after closing date of bid or during Technical clarification not be considered.
• 2.OEM Authorization Certificate:- OEM self certificate/ OEM Authorization Certificate should b e uploaded (OEM Verified Reseller & OEM Verified Catalogue).
• 3.Rate Certificate: A rate certificate should be provided stating that the rates being charged ar e Special Hospital Rates and are in no way higher to those quoted/charged by your firm from the DGS&D New Delhi/Other State Govt. Departments/Health Institutions in India. In case any differe nce is found at a later stage your firm will refund the same accordingly.
• 4.Quality Assurance:​ Seller must provided test report of the product from NABL Accredit labs(if applicable).
• 5.Valid License/Certificates: The seller must uploaded the valid License/Registration certificat e of sales for Medicines/Medical consumables/Medical Equipment/Medical Instrument/Software’s/ etc. as per Government instructions (if applicable).
• 6.MSME & EMD Preference:- MSME preference & EMD exemption will be given to the state of bid inviting authority i.e. Haryana State only.
• 7.MII Declaration :- The seller applied for MII preference has to provide self certification for cla ss-1 local supplier/class 2 local supplier with percentage of local content along with location(s) at which the local value addition is made.
• 8.In case of re-sellers, if the reseller has not been approved as an authorized re-seller i.e. all stoc ks tagged as “Reseller” Not Verified by the OEM on GeM, the re-seller is required to give an unde rtaking as under while uploading the product, while accepting any order and while participating i n any bid: “I hereby undertake that I have made arrangements for getting the stores from authorized distri butor / dealer / channel partner of the OEM of the offered product. At the time of delivery of good s, I will provide necessary chain documents to prove that the supplied goods are genuine and ar e being sourced from authorized distributor / dealer / channel partner of the OEM. In case of any complaint from the Buyer / Consignee about genuineness of the supplied products, I shall be res ponsible for providing genuine replacement supplies.”
• 9.Note:- Any terms and conditions provided by GeM(By Default) which is not the requirement of t he Buyer will be considered nullified. .

Participation by the bidder in RA process would be considered as their consent for extension in offer validity by 30 days by the date of RA initiation.
