Buyer Added text based ATC clauses INSTRUCTIONS TO BIDDERS FOR CUSTOM BID ON GeM

• 1.For detailed tender documents with Commercial Terms & Conditions (NIT), refer to documents attached link above at “BUYER UPLOADED ATC DOCUMENT” and the same shall be applicable. Bidders to downl oad and view the same by clicking the link.
• 2.Duly filled and signed all relevant formats attached in Annexure to be submitted without any deviation with the bid. ANNEXURE – I ACCEPTANCE MATRIX OF COMMERCIAL TERMS, ANNEXURE – II, ACCE PTANCE FORMAT OF TECHNICAL BID.
• 3.Reverse Auction: - Tender wherever reverse auction is being asked all the vendors has to be updated wi th the GeM standard procedure of reverse auction and response time. In case if any vendor failed to partici pate within the due date and time no further consideration on time extension will be granted as that provis ion is not available on GeM.
• 4.Order Placement Methodology: - Price shall be discovered through online bidding process to be con ducted through GeM portal and after conclusion of contract at GeM, the same order will be converted to G RSE, SAP Purchase Order with the terms & conditions. All Terms & Conditions, ICGRN (Inspection cum Goo ds Receipt Note), Payments will be governed and regularized through GRSE, SAP Purchase Order only.
• 5.It is a two-part bid hence request not to quote anything pertaining to price in technical bid. If any price i s submitted in the technical bid it will be rejected. All other terms & conditions as per GeM GTC attached w ith this ATC. All the vendors need to have a detail study on GeM GTC attached herewith. The clauses whic h are not elaborated/mentioned herein GeM GTC to be strictly followed. Clauses which are already elaborated herein same will supersedes the GeM GTC clause/s.
• 6.BANK GUARANTEE (PBG): Performance Bank Guarantee (PBG) to be submitted strictly as the GRSE fo rmat only attached at NIT.
• 7.EMD SUBMISSION: - Bidders need to submit EMD in form of bank D.D. in favour of “Garden Reach Shi pbuilders & Engineers Limited " payable at Kolkata and send the demand draft addressed to Arup Das, Ma nager (Purchase), Commercial Dept, 2nd Floor, Garden Reach Shipbuilders & Engineers Ltd., 61 Park, Gard en Reach Road, Kolkata – 700024. Scan the demand draft and attach it to EMD details in GeM portal. Non- submission of EMD amount will lead to rejection of offer. The bidder seeking EMD exemption, must submit the valid supporting document for the relevant category as per GeM GTC with the bid. Under MSME catego ry, (Only Micro & Small Enterprise) manufacturers for the goods are eligible for exemption from EMD. Medi um Enterprise & Traders are excluded from the purview of this. OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 50 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 50% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Participation by the bidder in RA process would be considered as their consent for extension in offer validity by 30 days by the date of RA initiation.
